SECTION A

REQUIREMENTS AND PRICES

A-2 DAILY AVAILABILITY AND FLIGHT RATE

Using Excel file posted in SAM or request a pdf to fill in using appendix 7, offerors shall fill in the item number, proposed aircraft information and the following three rates for evaluation:

Daily Availability Rate: Availability Rate shall cover Pilot, Aircraft and other fixed costs for a 14 hour period, Mobilization and De-mobilization to and from the Designated Base and lodging/ ground transportation/meals and incidental expenses for personnel while at the Designated Base listed in the Bid Items. All proposed availability rates shall be evenly divisible by 56

Hourly Flight Rate: A rate that covers fuel, scheduled maintenance costs, data plans and other use costs associated with the aircraft. Flight Rate: The Hourly Flight Rate will be subject to adjustment in accordance with the terms of clause (Economic Price Adjustment Specified Flight Rate).

Optional Pilot Rate: A fixed daily rate for Optional Pilot Services to mitigate pilot duty restrictions (36/6) as defined in B-28. This rate is intended to cover one (1) additional pilot for one (1) shift, 14-hour period).

The government shall reimburse the contractor for the following items:

Extended Standby Rate: The Extended Standby Hourly Rate will be subject to adjustment in accordance with the terms of B-19 Extended Standby Hourly Rate.

Miscellaneous Charges: Examples are airport landing fees, tie-down charges, hanger rental, etc. these costs will be paid by the government when authorized by CO/COR in accordance with the terms of B-37.98/*.

A-3 AIRCRAFT

Performance Requirements:

(1) Multiengine turbine aircraft capable of a minimum 240 KTAS at 18,000 feet pressure altitude, ISA+10C:

SECTION B

TECHNICAL SPECIFICATIONS

B-3 GOVERNMENT FURNISHED PROPERTY

If Government Furnished Property (GFP) is provided, the Contractor shall be required to sign a property receipt document. Upon Government request, GFP shall be returned to the Government in accordance with GFP (Short Form) FAR Clause 52.245-1 Alternate 1 (JAN 2017).

B-4 AIRCRAFT REQUIREMENTS

(a) The aircraft shall be in airworthy condition throughout the performance period.

(b) The aircraft shall be in airworthy condition throughout the performance period. All equipment shall be installed and operable or be deferrable by an FAA approved Minimum Equipment List (MEL). Some items required by this contract cannot be placed on an MEL as non-operational unless approved by a government Aviation Safety Inspector or the CO. These items include:

(i) Emergency Locator Transmitter

(ii)VHF-AM Radios (at least two must be operational)

(iii) VHF-FM Radio (at least one must be operational)

(iv) Transponder (at least one must be operational)

(v) Static pressure, altimeter, and automatic altitude reporting system (at least one must be operational and connected to an operational transponder)

(c) All aircraft furnished under this contract shall be operable, free of damage, and in good working order. Aircraft systems and components shall be free of leaks, except within limitations specified by the manufacturer.

(d) The aircraft interior shall be clean and neat. There shall be no un-repaired tears, rips, cracks, or other damage to the interior. All interior materials shall meet FAA standards.

(e) The aircraft exterior finish, including the paint, shall be clean, neat, and in good condition (e.g., no severe fading or large areas of flaking or missing paint etc.). Military or other low visibility paint schemes are unacceptable. Any corrosion shall be within manufacturer or FAA acceptable limits.

(f) All windows and windshields shall be clean and free of scratches, cracks, crazing, distortion, or repairs, which hinder visibility. Repairs such as safety wire lacing and stop drilling of cracks are not acceptable. Prior to acceptance, all temporarily repaired windows and windshields shall have permanent repairs completed or shall be replaced.

SECTION B

TECHNICAL SPECIFICATIONS

B-33 FOOD AND DRINK

During days of high incident activity when the Government deems it necessary to provide food and drink refreshments to flight crews for sustained operations, the Government will furnish such items at Government expense.

B-34 PAYMENT FOR OVERNIGHT ALLOWANCE AT ALTERNATE BASE

The Contractor shall receive an overnight allowance for the primary to stay at a location other than the designated base. The Government will pay the Contractor the actual cost of lodging up to the current standard maximum rate that is allowed (or high rate, if applicable with coordination of government representative (CO, COR, ATGS)) as established by the Federal Travel Regulations (FTR), Rates are available at: https://www.gsa.gov/travel/plan-book/per-diem-rates.

(a) Overnight allowance will not be paid when the aircraft is assigned to its designated base listed in the Bid Items.

(b) The appropriate rate for meals and incidental expenses will be paid unless the Government makes three meals available to the Contractor.

(c) The Contractor's lodging will be paid only when lodging is not furnished by the Government.

If the Contractor elects to not utilize Government provided lodging, there is no reimbursement for lodging or transportation costs incurred by the Contractor. When the FTR rate changes, the change in overnight allowance to the Contractor will become effective on the effective date of the FTR change.

(d) The Flight Use Report shall clearly show the county or city where the overnight occurred.

High-rate claims for subsistence that do not include this information will be reduced to the standard rate.

(e) In the event that FTR rate(s) are not available, the CO/COR shall be notified, and the Flight Use Report documented accordingly.

(f) Itemized receipts must support claims for reimbursement and must be kept on file by the Contractor. Copies of receipts shall be provided to the Government upon request.

B-35 RELIEF PILOT TRAVEL EXPENSE

(a) When Contractor's aircraft is dispatched away from the designated base, the Government will authorize payment for additional necessary and reasonable costs involved in transporting authorized relief crewmembers to and from alternate bases when approved in advance by the Contracting Officer. Examples of acceptable expenses are airline tickets; car rentals; privately owned vehicle (POV) at the government mileage rate (Internet site http://www.gsa.gov/mileage) and charter airplane showing aircraft make/model, flight time, hourly rate and departure and destination locations.

(b) Unless authorized in advance by the CO, the expense for charter resources shall not exceed reasonable costs by common carrier and are only authorized for mandatory relief exchanges resulting from duty limitations.

CONTRACT CLAUSES

C-8 452.246-70 INSPECTION AND ACCEPTANCE (FEB 1988)

The Contracting Officer or the Contracting Officer's duly authorized representative will inspect and accept the supplies and/or services to be provided under this contract.

C-9 ECONOMIC PRICE ADJUSTMENT SPECIFIED FLIGHT RATE

(a) Entitlement to an Adjustment. During the contract period, including any renewal, the hourly flight rate may be adjusted as set forth herein to reflect increases and/or decreases in the cost of aviation fuel. The hourly flight rate will be adjusted upward whenever the Contractor notifies the CO in writing that the reference price is more than five percent (5%) higher than the base price. The hourly flight rate will be adjusted downward whenever the CO notifies the Contractor in writing that the reference price is more than five percent (5%) lower than the base price. The adjusted price shall apply to flight time occurring after receipt of said notice.

(b) Calculation of Adjustment. An adjustment to the hourly flight rate will be made by calculating the difference between the reference price and the base price, multiplied by the hourly fuel consumption rate for the type aircraft involved, as shown in the Airplane Fuel Consumption Chart in the Attachments Section.

(c) Reference Price. The reference price is the commercial fuel price in effect at the time of adjustment. The reference price will be determined by the price of fuel supplied from the below airport. The reference price shall become the base price for any subsequent adjustment. Fuel price changes will be subject to review by the Government. Acceptance by the Government of a proposed price adjustment is subject to review and acceptance of the data submitted.

We noticed that the contract has exhibits and attachments asking for specific lists that are more for a helicopter and not for fixed wing aircraft. Are we allowed to use our forms or do we need to make them fit your forms? Weight and Balance and Equipment List to be specific.

Weight and Balance forms submitted are required to have all of the information identified by the exhibit. Helicopter specific lateral CG may be marked Not Applicable (NA). The Equipment list forms submitted are required to have all of the information identified by the exhibit including the weight, Arm and Moment for each installed item.

You must submit in the form specified.

Do we need to carry over to FS-5700-0020 or can we use the OAS carding in place of or include it with the FS-5700 form? If we use the FS-5700 form for submission, we don’t have an inspector available to sign the form.

No government signature is required. The government uses the FS- 5700-0020 to evaluate pilot experience against contract minimums.

Can you clarify when the optional pilot pay would come into play? We are reading these two different ways.

When ordered by the government to mitigate 36/6 flight hour requirements during increased activity. The Optional Pilot is not a contract requirement however if the proposal contains rates then the government may order under a bilateral agreement for a specified time period during increased demand.

B-13 "(b) To mitigate 36/6 flight hour and duty limitations the CO/COR/ATGS may order an additional pilot. When additional pilots are ordered the Contractor will be reimbursed for approved transportation costs and RON per the FTRs and the rate specified in the schedule of items. “Optional Pilot” “Fixed Daily Rate” will be added as “other charges” on the ABS invoice.

5 C-9 Is the fuel price reevaluated at 10% or 5%. There seems to be a discrepancy in the wording of the contract. It says ten percent but has 5% in parenthesis next to it.

The government provides the following correction: "five or (5%)"

If a replacement aircraft is offered during scheduled downtime, will aircraft models such as 690A, B, or C be considered “equal” replacements?

Clear as written: "the Contractor may substitute or replace the aircraft with an approved (carded) aircraft equal to or greater than the awarded performance at no cost to the government to include positioning of replacement aircraft"

7 B-5 (b)

After contacting various OEMS regarding an OEM/TC holder inspection program or supplement for aerial supervision mission, we discovered that due to the short notice of the requirement, they would be unable to provide an inspection program in the limited time given. Would it be possible give vendors and OEMs an extended period, similar to the 12 month PED tolerance requirement, after award to draft a suitable program? This will allow the OEM time to provide a thoroughly researched program, rather than a “quick fix”.

Proposals must contain documentation of communications with the OEM/TC holder providing evidence that the development of an inspection program meeting the specifications of the contract is in progress. The RFP will be updated to allow up to 12 months from the date of award to meet this requirement.

As vendor’s upgrade and modernize their fleet, will the USFS consider single engine aircraft in the future? These aircraft would provide newer accessories/avionics, greater speed, fuel efficiency, and comfort.

10 B-5, (d)

Does it mean to state all OEM programs “applicable” to the airframe will be in compliance?

If the OEM has any of the programs identified either recommended or mandatory for the aircraft offered those programs shall be complied with. This is for the entire aircraft not just the airframe.

11 B-5 (l)

On pages 26,27, and 28 where it talks about Maintenance personnel requirements, is it the Governments intent to only have mechanics that meet these requirements work on the aircraft? We can think of several instances where we have used other mechanics that were on an approved drug and alcohol program that performed minor Maintenance such as changing a tire and getting us back in service quickly without having to fly someone on the approved list to where ever the aircraft may be nationally.

Yes. Additional mechanics and maintenance providers may be added to the list at any time provided they meet the requirements of the contract. "Only the maintenance facilities and/or maintenance personnel identified may perform maintenance and inspections."

12 B-5 (b)

We have reached out to the TC holders and are waiting for answers back, if they do not get back to us about a recommended IP or supplement would proof of emails that we have asked for this information but have not received it still qualify us for the Bid? We can provide the things we have learned and do the last 10 years of flying in this fire environment that go above and beyond the Manufacturers program such as cleaning filters etc. more often than recommended

Why is Alaska checked? The government and its partners have land management responsibilities in AK. This may require operations in AK at an alternate base during the contract period. Due to this probability it must be covered in the contractors 135 OPSS.

Please explain: The contractor shall provide the flat rate time for all scheduled inspections? Do we provide a rate for maintenance time?

This flat rate time shall be provided in days and shall account for the maintenance personnel duty limitation requirements of this contract.

If there is not a published flat rate time for the inspection(s) the contractor shall provide amount of inspection day(s) for accomplishment of each scheduled and special inspection based on performing the inspection in a maintenance facility and accounting for the duty limitation of this contract. Inspection flat rate time shall not include corrective action for discrepancies identified by the inspection. Scheduled inspection performance may not exceed five

(5) MAP days. The inspection days for each inspection and special inspection shall be provided with the contractor proposal.

Small Business with only a couple of AC, not large enough to make having a DOM feasible, Plan is to coordinate with maintenance facility at designated base for priority service? Is this or other similar support action acceptable?

The maintenance manager (DOM) shall be the person identified in the Operations Specifications to meet the requirements of 14 CFR 119 and 135.

The hosting region has operational control over the resource when assigned. The National Interagency Coordination Center has strategic control over the resource and may move the resource to a higher priority region.

If the aircraft is assigned outside of the 11 bases listed does the gov pay per diem?

The government intends to award one item to each designated base. When an awarded item is away from its awarded "designated base" then perdiem, travel, MIE will be paid in accordance with section B-34.

At the end of the mandatory availability days and there is still a need would the aircraft become a national CWN aircraft or revert back to its region CWN contract?

Extensions for services before or after the MAP when ordered by the government and agreed to by the contractor will be paid under optional use rates in accordance with B-30.

22 A-3 The 4 hour fuel requirement at 17,500 ft and max cruise does that include fuel reserve or does fuel reserve need to be added to that?

A-3, (1) and (2) is defined as 4 hours total fuel.

23 B-13, Would the USFS consider additional pay for a Gyro stabilized Io/EO camera for lightning detection and additional pilot if needed for detection in the area where the aircraft is based for detection flying at night separate from daytime ATGS flying?

The contract does not have specifications for technologies beyond the requirements. The government will review all offers to include unsolicited proposals and make a determination of suitability and value. Additional equipment must have a separate availability and or use rate.

Will all future contracts EU LFW be national contracts or will there still be regional EU contracts

25 B-5 What is the perceived problem and why to the level of a STC above an approval for 135 certificate

The reference and question are not specific enough to determine a response. The requirements remain as stated.

26 B-7 (b) (5) (v)

PG 20 (B) tolerance: what if someone brings a piece of equipment outside of these tolerance, or within but has harmonics that go outside the band.

The government and its employees must abide by the "documented procedures and training" related to this section. See same section (C ). This section shall be incorporated in preflight briefings.

27 B-5 (h) Light maintenance, Example -Tire change, bulb replacement, A/C, etc. require airframe specific A&P?

Clear as written: "Only the maintenance facilities and/or maintenance personnel identified may perform maintenance and inspections." See question 11

(b) All equipment shall be installed and operable or be deferred per an FAA approved Minimum Equipment List (MEL) with the following limitations: (1) Items required by this contract may not be deferred unless approved by a USFS Aviation Safety Inspector or the CO.

(2) The following equipment cannot be deferred except as identified in (1) above:

The government provides the following correction: "(b) The aircraft shall be in airworthy condition throughout the performance period.

All equipment shall be installed and operable or be deferrable by an FAA approved Minimum Equipment List (MEL). Some items required by this contract cannot be placed on an MEL as non-operational unless approved by a government Aviation Safety Inspector or the CO. These items include:"
