Total number of aircraft:

B.3 SCOPE OF CONTRACT

(a) The intent of this solicitation, and any resultant contracts, is to obtain services of commercially provided aircraft fully operated by qualified personnel and equipped to meet specifications for use in administration and protection of Public Lands. The Government intends to award multiple Firm-Fixed-

Price (FFP), with an Economic Price Adjustment (EPA) type contracts, for a base year and three option years not to exceed four years total. The contracts will have fixed priced availability rates and fixed price with economic price adjustments for the flight rates. One aircraft will be awarded for CLINS 1 through 5.

More than one aircraft may be awarded for CLIN 6. Due to the volatile fluctuation in aviation fuel prices;

the flight rates will be adjusted based on increases and decreases to the prices of aviation fuel as indicated in the economic price adjustment clause specified in the contract. This smokejumper contract program requires the Contractors to provide their aircraft services during certain Mandatory Availability

Periods (MAPs) for the exclusive use of the Government. They are paid a daily availability rate during the MAP and an hourly flight rate when they are flown. We specify an exact period of time the aircraft must be available and the Contractor receives a firm-fixed-priced payment for each day of availability.

We also have fixed hourly/unit flight rates that the vendor receives for each hour that the aircraft is flown. However, if the aircraft is never flown the vendor does not receive any payment for flight time.

(b) The Contractor and their employees must be cooperative and work as a team in accomplishing the mission. Contractor's employees may be replaced if found to be uncooperative or the Contracting

Officer (CO) may terminate this contract.

(c) During the Mandatory Availability Period (MAP) and any extensions thereof, the aircraft will be made available for the exclusive use of the Government.

(d) Aircraft furnished under this contract will be operated from the designated or alternate bases throughout the contiguous United States.

(e) The Government has interagency and cooperative agreements with all State and local agencies, private landholders, Department of Interior, Department of Defense, Department of Energy, through the coordination dispatch system as specified in the National Interagency Mobilization Guide, and may dispatch aircraft under this contract for such cooperative use.

(f) Use will include, but is not limited to, the following:

(1) Transportation of personnel, equipment, and supplies for fire suppression and other USFS administration activities.

(2) Transporting and dropping smokejumpers.

(3) Transporting and dropping paracargo.

(4) Reconnaissance.

(5) Testing of parachutes and other aerial equipment.

(6) Air Tactical Operations

(7) Search and Rescue

(g) Aircraft will be required to perform over rough, mountainous terrain typical of National Forest areas in the western United States at elevations varying from sea level to 13,000 feet, often encountering extremely unfavorable atmospheric conditions.

B.4 CERTIFICATIONS AND OPERATIONS

(a) Contractors must be currently certificated under 14 CFR Part 135 or 14 CFR Part 121. The Contractor must have a Federal Aviation Administration (FAA) approved operating specifications manual that includes the aircraft by serial number on aircraft listing (D085). With the exception of authorized USFS deviations, aircraft shall be maintained and operated in accordance with the requirements of their operating certificate. FAA Exemptions and/or Department of Transportation (DOT) grants of exemption as identified in the following paragraphs. The aircraft shall be maintained in accordance with the FAA Operations

Specifications, Operations Manual, General Maintenance Manual (GMM), etc., as applicable, regardless of status as Public Aircraft. Aircraft performing a "public aircraft operation" does not alter the requirement for compliance with appropriate 14 CFR as follows:

(1) Terrain Awareness and Warning System (TAWS) - TAWS should be deactivated for smokejumping and paracargo delivery. The system should be reactivated at the completion of smokejumping or paracargo operation. This procedure shall be accomplished with appropriate checklists and procedures, notwithstanding any requirements of 14 CFR part 135.154.

(2) The aircraft shall be operated to the standards of 14 CFR Part 135 or 121, as appropriate when carrying passengers for other than firefighting missions.

(iii) It is the Contractor’s responsibility to ensure that employees who may perform a function subject to this special permit receive training on the requirements and conditions of this handbook/guide (Interagency Aviation Training (IAT) Module A-110).

Documentation of this training shall be retained by the company in the employee’s records and made available to the Government as required.

(iv) The pilot shall ensure personnel are briefed of specific actions required in the event of an emergency. The Pilot shall be given initial written notification of the type, quantity, and the location of hazardous materials placed aboard the aircraft before the start of any project. Thereafter, verbal notification before each flight is acceptable. For operations where the type and quantity of the materials do not change, repeated notification is not required.

(v) It is the responsibility of the Contractor to ensure that Contractor employees have received training in the handling of hazardous materials in accordance with 49 CFR 172.

Aircraft offered must conform to the same standard configuration and performance capability of the model aircraft as originally approved as a smokejumper aircraft.

(2) Any flight exceeding 15 minutes of Instrument Flight Rules (IFR) along the planned route must have two qualified instrument rated pilots. Autopilots authorized by Part 135 may be used in lieu of a second pilot. The Contracting Officer may require two pilots on any IFR flight or any administrative flights. (See Section G.10 for payment provisions for additional pilot.)

(d) The flight crew shall provide a pre-takeoff briefing describing the location of the emergency exits and appropriate evacuation and in flight procedures. The briefing may be waived for smokejumper and paracargo operations.

(e) Short takeoff and landing (STOL) operations from other than established airports may be permitted provided they are specifically approved in advance in accordance with Forest Service Manual (FSM)

5700.

(f) A passenger may occupy the copilot's seat during certain operations unless a two-pilot operation is required.

(g) Smokejumper Seats, Side Facing Seats. The Government will provide seating to accommodate fully equipped smokejumpers and their equipment. The smokejumper bench seats will be installed by the

Contractor upon request of the Government. This will require the removal and storage of the required
