This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested based on the requirements outlined in this combined synopsis/solicitation. A written solicitation will not be issued.

This solicitation is issued as a Request for Quotation (RFQ), for a firm fixed price contract. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-97. All responsible sources may submit a quote in response to this solicitation, which shall be considered. A contract may be awarded resulting from this solicitation to the responsible quoter whose quote conforms to the solicitation and is most advantageous to the Government.

The United States Forest Service (USFS) intends to award one contract for the acquisition of items listed below. The Government intends to select one contractor; however, the Government reserves the right to award no contract at all, depending on the quality of the quotes and prices submitted.

Description of Requirement:

The Tongass National Forest requires service work on the Ketchikan Ranger District involving towing, dry docking, and exterior hull, deck, and appurtenances preparation and painting, service to crane, winches, and cables.

For specific work performance information, see the attached Statement of Work/Specifications.

The Contractor shall furnish all labor, materials, equipment, supervision and transportation to perform all work listed on the schedule of supplies/services.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

Addenda: In addition to the requirements in the basic clause, please submit a short narrative (maximum of 5 pages) addressing the following evaluation criteria:

(1) Technical Capabilities:

a. Facility and Capacity: Submit information regarding the facility at which you intend to dry dock the barge. The Forest Service will assess the proposed facility to handle dry docking in accordance with Section 00200 below.

b. Towing Method and Vessel: Submit your proposed vessel information on page 1 under the Schedule of Supplies/Services. The Forest Service will verify that the towing method and towing vessel are in compliance with the requirements of 46 CFR 27. Use of a non-compliant method or vessel renders a quote unawardable.

(2) Qualifications of Key Personnel: Submit your proposed captain information on page 1 under the Schedule of Supplies/Services. The Forest Service will verify that the proposed vessel Captain has a current USCG Towing Operations endorsement and meets other applicable USCG towing regulations. Use of a non-compliant vessel operator renders a quote unawardable.

(3) Prior Experience: Submit a list of prior projects involving maintenance of barges at the proposed facility. The Forest Service may evaluate the extent of experience the vendor has performed similar barge drydock maintenance work through a variety of information sources, including but not limited to, the narrative submitted as part of the quote.

(4) Past Performance: Submit a list of project owners that ordered barge maintenance work from your company within the past three (3) years. The Forest Service will assess the quoter’s ability to successfully perform this work based on the history of performance.

(5) Price: Fill out and submit Unit Prices and Amounts within the Schedule of Supplies/Services on Page 1.

This information will be used by the Government for evaluation (see Evaluation of Quotes below for a list of Evaluation Criteria to respond to).

52.212-3, Offeror Representations and Certifications – Commercial Items (Nov 2017) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision— “Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation”, means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
