Notice of Intent for Other than Full and Open Competition

Solicitation No.: 114-2019-GGI

Special Notice

Agency: US Agency for International Development (USAID)

Office: Overseas Missions

Location: USAID/ Georgia

USAID/Georgia intends to negotiate a non-competitive modification of contract number AID-114-C- 15-00001 awarded to Tetra Tech ARD to implement the “Good Governance Initiative” (GGI) in Georgia. The proposed modification to the contract will increase the total estimated cost (TEC) by $3,318,864 from $11,299,926 to $14,618,790 and extend the original end date by 18 months from January 4, 2020 to July 4, 2021. The above contract was awarded to Tetra Tech ARD after a full and open competition on January 5, 2015.

The Mission anticipates using AIDAR 706.302-70(b)(3)(i) impairment of foreign assistance objectives as the statutory justification to negotiate non-competitively with only one source, Tetra Tech ARD.

Per AIDAR 706.302-70 Impairment of foreign aid programs, full and open competition need not be obtained when it would impair or otherwise have an adverse effect on programs conducted for the purposes of foreign aid, relief, and rehabilitation. A full and open competition could cause a failure to realize long-term gains under GGI after the critical October 2020 Parliamentary elections.

Under this action, Tetra Tech will continue supporting the Government of Georgia (GOG) to implement critical and timely program interventions to support public administration and Parliamentary reform. The activity will support implementation of civil service and local government decentralization reforms to strengthen transparency and accountability of governance. It will strengthen evidence-based policy development and lawmaking, and institutional oversight of GOG, including building the capacity of Parliament to enhance its oversight function. GGI will work with GOG and civil society representatives to enhance public participation, raise awareness of reforms, and ensure institutionalization of monitoring mechanisms. The activity will continue supporting the Open Government Partnership process since that has proven instrumental for promoting the transparency and accountability agenda within government.

This is not a request for proposals. However, the Government may consider all expressions of interest received within fifteen (15) calendar days after date of publication of this notice. A determination not to compete this proposed contract modification based upon responses to this notice, if any, is solely within the discretion of the Government. Information or responses received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.

Therefore, any responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to USAID and would not hinder USAID/Georgia's objectives.

Please direct any responses to this notice to Mr. Justin Gunnoe, Contracting Officer, at jgunnoe@usaid.gov with a copy to Ekaterine Gamezardashvili at egamezardashvili@usaid.gov.
