Solicitation 11-258-SOL-00010

INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

A.

General Instructions To simplify the evaluation of the proposal, the offeror must submit one original and two (2) copies of its materials in two separate volumes entitled: (1) Technical Proposal, and (2) Business Proposal (Price for Quotation).

B. Technical Proposal Instructions

To facilitate proposal evaluations, the offeror shall submit as a part of the proposal, a separate enclosure entitled "Technical Proposal.” Under no circumstances is any cost to be shown in the Technical Proposal; however, unpriced details of labor hours and other direct costs shall be included. In order to establish uniformity, proposals shall be organized in the following sections:

Specifically, the data and information in the Technical Proposal should be organized according to the following Evaluation Criteria: The technical proposal content shall include, but need not be limited to, the following:

PART 1 – Technical and Management Information

1. Understanding the Scope of Work and Functions of the Project (10 Points)

· Completeness of the proposal and demonstrate understanding of the mission of the NHDP and of the objectives and tasks of the scope of work.

2. Qualifications (30 Points)

The offeror shall identify the individual(s) proposed to perform the orthotic technician tasks and provide a resume/CV. The proposal shall fully address each of the following qualifications to meet the requirements specified under the Description and Scope of Work.

· Be a citizen of the United States and 18 years of age.

· Be in good health without physical defects or abnormalities which could interfere with arduous tasks and is able to perform arduous tasks without restriction.

· Provide acceptable results of criminal background check.

· Provide acceptable results of a current physical examination within the past year.

· Provide two satisfactory, written professional references within past 5 years.

· Shall have an exceptional command of understanding and speaking the English language.

· Contractor shall provide proof of assessment of employee’s flexibility and spirit of cooperation.

3. Capability and Experience of the Contractor and Personnel (60 Points) The proposal shall describe the proposed candidate’s experience, including specifically the following minimum requirements:

· One year of experience with construction, modification & repair custom molded sandals and modify and repair prefabricated sandals.

· 1 year of experience with fabrication of orthotics.

· At least 6 months working with person’s affected by Hansen’s disease.

· Experience in fabrication of foot models, and footwear modification.

PART 2 – Past Performance Information

Offerors shall provide a list of no more than 3 relevant contracts recently expired (during the past three years) or ongoing contracts that are similar in nature to this scope of work. Contracts listed may include those entered into with the Federal Government, state and local Governments and commercial customers. Include the following information for each contract:

(a) Name, address, FAX and current telephone number of each contracting organization/customer and name and fax and telephone number of the Project Officer and Contracting Officer, contract numbers, types and total contract dollar values;

(b) Period of performance

(c) Brief description of the expectations and scopes of the each of the contracts, including a discussion of the similarities/differences between this proposed effort and the specifications of those contracts.

(d) Offeror shall discuss their experiences with termination actions over the past three years and identify and explain any contract termination for default or for convenience and reason(s) why such actions were taken.

C. Business Proposal (Price for Quotation) Instructions

The offeror shall submit a Price Quote proposal, fully supported by cost and pricing data, in sufficient detail to allow for cost analysis that will be utilized to establish the reasonableness of the proposed costs.

a.

Standard Form 18, Request for Quotations

The Contractor must complete the following Blocks:

BLOCK 8

State the Name and Address of your organization.

BLOCK 11

Enter the organization’s Tax ID Number or Federal Identification Number.

Enter the organization’s DUNS (Digital Universal Numbering System) Number. This information can be obtained from your accounting office; however, if your organization does not have a DUNS number, please call Duns & Bradstreet to obtain a DUNS number.

BLOCK 13

State the name and address of the individual providing the price quote.

BLOCK 14

Signature of the person authorized to commit your organization to the contract.

BLOCK 16

Print or type the name and title of the person authorized to commit your organization to the contract.

2. Supporting Documentation The Contractor shall furnish a price breakdown in support of the statement of work and deliverables. The supporting documentation must include the following:

i. Copy of the organization’s indirect cost rate agreement or supporting information for any quoted rates.

ii. Break out personnel (direct labor), fringe benefits, labor overhead, consultant fees, travel, other direct costs, G&A expense, and fee.

Direct Labor Costs:

State the labor categories, estimated number of hours and unburden wage rate of each category.

Fringe Benefits:

Rate should be in accordance with the organization’s cost rate agreement.

Labor Overhead:

Rate should be in accordance with the organization’s cost rate agreement.

Consultant Fees:

State number of days and daily rate for each expertise required.

Travel:

Provide breakdown of transportation charges, lodging, and per diem.

Other Direct Costs:

Provide cost for materials, supplies, telephone, etc. KEEP IN MIND THAT HRSA DOES NOT INTEND TO PROVIDE FUNDS FOR THE PURCHASE OR LEASE OF ANY EQUIPMENT.

G&A:

Rate should be in accordance with the organization’s cost rate agreement.

Fee:

If applicable, state rate that is offered to your best value customer.

3. The offeror must stipulate that the proposal is predicated upon all the terms and conditions of this RFP. In addition, the proposal must contain a statement to the effect that it is firm for a period of at least 180 days from the date of receipt by the Government.

4. The offeror must identify all Government-owned property in his/her possession and all property acquired from Federal funds, to which the offeror has title, that is proposed to be used in the performance of the prospective contract.

5. The management and control of Government property must be in accordance with HHS Publication -OS- 74-115 entitled, "Control of Property in Possession of Contractors, a copy of which will be provided upon request.

6. Other pertinent business and administrative information may also be requested if the information is considered necessary for proposal evaluation.

7. Completed Offeror Representations and Certifications

A completed and executed copy of Offeror Representations and Certifications shall be included as part of your proposal.

8. 52.232-18 Availability of Funds. (Apr 1984)

Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

EVALUATION AND SELECTION CRITERIA

A.

Award Criteria The Technical Proposal will receive paramount consideration in the selection of the contractor for this acquisition. In the event that the technical evaluation reveals that two or more offers are approximately equal in technical ability, then the estimated cost of performance will become paramount; however, the Government reserves the right to make an award based on the best value for the Government, cost and technical factors considered.

B.

Selection of Offeror(s)

1.

The acceptability or unacceptability of the technical portion of the contract proposal will be based upon a technical evaluation. Each proposal will be evaluated in strict conformity with the evaluation criteria of the RFP, utilizing point scores and written critiques.

2.

The Government reserves the right to make an award without further discussion of the proposals received. Therefore, it is important that your proposal be submitted initially on the most favorable terms from both the technical and cost standpoints.

3.

The Government reserves the right to make a single award, multiple awards, or no award as a result of this RFP. In addition, the RFP may be amended if determined to be in the best interest of the Government.

C.

Evaluation Criteriatc "Evaluation Criteria " \l 5 The evaluation will be based on the demonstrated capabilities of the prospective contractor in relation to the needs of the project as set forth in the RFP. The merits of the proposal will be evaluated carefully. The following criteria are those that will be applied in the evaluation of your technical proposal. The proposal will be evaluated using the following criteria and weights:

· 1 year of experience with fabrication of orthotics.

· At least 6 months working with person’s affected by Hansen’s disease.

· Experience in fabrication of foot models, and footwear modification.

D. Past Performance Factor

Past performance of those offeror’s determined to be technically acceptable will be evaluated after completion of the technical evaluation. Past performance will be used as an independent evaluation factor.

The evaluation will be based on information obtained from references provided by the Offeror, as well as other relevant past performance information obtained from other sources known to the Government.

The Government will assess the relative risks associated with the Offeror. Performance risks are associated with an Offeror’s likelihood of success in performing the acquisition requirements as indicated by that Offeror’s record of past performance.

The assessment of performance risk is not intended to be the product of a mechanical or mathematical analysis of an Offeror’s performance on a list of contracts but rather the product of subjective judgment by the Government after it considers all available and relevant information. When assessing performance risks, the Government will focus on the past performance of the Offeror as it relates to all acquisition requirements, such as cost, schedule and performance, including standards of good workmanship; the Offeror’s adherence to contract schedules, including the administrative aspects of performance; the offeror’s reputation for reasonable and cooperative behavior and commitment to customer satisfaction; and generally, the Offeror’s business-like concern for the interest of the customer.

The lack of a performance record may result in an unknown performance risk assessment which will neither be used to the advantage nor the disadvantage of the Offeror.

The overall total score for the past performance rating for each offeror will be determined by calculating the average of the surveys received. The overall total score will be rounded to the nearest whole number to assign an appropriate adjectival rating (0 = Unsatisfactory, 1 = Poor, 2 = Fair, 3 = Good, 4 = Excellent, 5 = Outstanding).

CONTRACT DOCUMENTS, EXHIBITS AND ATTACHMENTS

1. PURPOSE

The National Hansen’s Disease Programs, Baton Rouge, LA is a specialized Federal medical facility for the treatment of persons with Hansen’s Disease. The NHDP, operated by the Federal Government since 1921, has statutory responsibility to provide care for patients with Hansen’s Disease.

The purpose of this procurement is to provide Orthotic Technician services. The anticipated period of performance is one year from date of award, with a option for an additional year.

2. WORK STATEMENT

Independently and not as an agent of the Government, the contractor shall furnish all personnel, material, facilities, services and equipment (except for those items specifically stated will be provided by the Government) as needed to perform the Statement of Work set forth in Section J, Attachment A attached hereto and made a part of this document.

This contract is a non-personal health care services contract as defined in FAR 37.101, under which the contractor is an independent contractor. The Government may evaluate the quality of professional and administrative services provided, but retains no control over the medical, professional aspects of services rendered.

3. INCORPORATION OF CONTRACTOR’S PROPOSAL

It is understood and agreed that the Contractor shall, in meeting the requirements of this contract, perform the work in accordance with the Contractor's proposal to the National Hansen’s Disease Programs, dated (to be completed upon contract award) , provided however, that to the extent that any provisions of the articles of this contract are in conflict or inconsistent with any provisions of said proposal, the provisions of the articles of this contract shall be controlling and shall supersede the provisions of said proposal.

4. INSPECTION AND ACCEPTANCE

The Project Officer, as a duly authorized representative of the Contracting Officer, shall assume the responsibilities for monitoring the Contractor’s performance, evaluating the quality of services provided by the Contractor and performing final inspection and acceptance of all deliverables.

5. PERIOD OF PERFORMANCE

5.1 The period of contract performance is as follows:

5.2 The Option Periods of this contract will be exercised in accordance with F AR 52.217-9 “Option to Extend the Term of the Contract”.

5.3 Services are not required on Federal holidays.

6. DELIVERABLES

The following deliverables and quantities are required. All submissions are to be hard copy and electronic copy.

7. PLACE OF PERFORMANCE

Performance shall be conducted at the NHDP facilities, 1770 Physicians Park Drive, Baton Rouge LA 70816.

8. Designation of Contracting Officer’s Technical Representative (COTR)

The person identified below is hereby designated as the COTR for this contract. No other individual may perform this function unless instructions are received in writing. The responsibility of the COTR is to ensure that the Government’s technical objectives are met. To this end, the COTR will provide necessary information, direction, coordination, and et cetera within the contractual work description. Issuance of changes which affect the articles, terms, or conditions of this contract will be accomplished through the Contracting Officer who is the only party authorized to bind the Government to contact:

9. Technical Monitoring

9.1 Performance of the work under this contract shall be subject to the technical monitoring of the COTR. The term “Technical Monitoring” is defined to include the following:

9.1.1 Technical directions to the Contractor shall guide the contract effort, shift work emphasis between work areas or assignments, require pursuit of certain lines of inquiry, fill in details or otherwise serve to accomplish contractual statement of work.

9.1.2 Providing information to the Contractor for assistance in the interpretation of drawings, specifications or technical portions of the work description.

9.1.3 Review where required by the contract, approval of technical reports, processes, product deliverables, drawings, specifications and technical information to be delivered by the Contractor to the Government under the contract.

9.2. Technical direction must be within the general statement of the work as stated in Attachment A of the contract. The COTR does not have the authority to and may not issue any technical direction that: (i) constitutes an assignment of additional work outside the general scope of the contract; (ii) constitutes a change as defined in the contract clause entitled “Changes”; (iii) in any manner causes an increase in the total contract cost or the time required for contract performance; or (iv) changes any of the expressed terms, conditions, or specifications of the contract.

9.3 All technical directions shall be issued in writing by the COTR or shall be confirmed by him/her in writing within five (5) working days after issuance.

9.4 The Contractor shall proceed promptly with the performance of technical directions duly issued by the COTR in the manner prescribed within his authority under this provision.

9.5 If, in the opinion of the Contractor, any instruction or direction issued by the COTR is within one of the categories as defined in (i) through (iv) above, the Contractor shall not proceed, but shall notify the Contracting Officer in writing within five (5) days after the receipt of any such instruction or direction and shall request the Contracting Officer to modify the contract accordingly. Upon receiving such notification from the Contractor, the Contracting Officer shall issue an appropriate contract modification or advise the Contractor in writing that, in his/her opinion, the technical direction is within the scope of this article and does not constitute a change under the Changes Clause of the contract. The Contractor shall thereupon proceed immediately with the direction given. A failure of the parties to agree upon the nature of the instruction or direction or upon the contract action to be taken with respect thereto shall be subject to the provisions of the contract clause entitled “Disputes”.

10. KEY PERSONNEL

Pursuant to the Key Personnel clause (HHSAR 352.270-5) referenced in SECTION I of this contract, the following individual(s) is (are) considered to be essential to the work being performed under this contract:

The clause cite above contains a requirement for review and approval by the Contracting Officer of written request for change of Key Personnel reasonably in advance of diverting any of these individuals. Receipt of written request at least thirty (30) days prior to a proposed change is considered reasonable.

11.2 For inquiries regarding receiving, inspection and acceptance, rejections, or technical issues, call the Project Officer.

11.3 Contractor agrees to include the following information on its invoice:

a. Contractor’s name, invoice number and date;

b. Task order/contract number;

c. Description, price and quantity of services/products delivered;

d. Date of service;

e. Tax identification number;

f. Contractor’s complete remittance address; and

g. Signature of an authorized official certifying that the invoice is correct and proper for payment.

12. EVALUATION OF CONTRACTOR’S PERFORMANCE

Interim and final evaluations of Contractor’s performance shall be conducted on this contract in accordance with the Office of Federal Procurement Policy (OFPP) Policy Letter 92-5 issued January 11, 1993, FAR Subpart 42.15 and HHSAR 342.7002(c)(2)(iv) at least annually. Upon contract completion, a final evaluation of the Contractor’s performance shall be completed by the Contract Officer Technical Representative (see Section J, Attachment C).

13. GOVERNMENT FURNISHED PROPERTY:

13.1. The government will furnish the facilities, equipment, and supplies necessary for performance of the contract.

13.2. The contractor shall take all reasonable precautions in accordance with sound practices to safeguard and protect government property. The Contractor shall be responsible for proper care and protections of Government property. The Contractor shall be held liable for loss or damage due to neglect of abuse of Government property by contract employees.

13.3 Any property furnished by the Government to fulfill the contract requirements which is lost or damaged, resulting from willful misconduct or lack of good faith by the Contractor’s employees shall be replaced or repaired by the Government and the cost of such repairs or replacement shall be deducted from the contractor’s invoice.

14. COOPERATION WITH OTHER CONTRACTORS

During the life of this contract, other personnel/contractors may be performing work concurrently at the site. To minimize interference and delay to the work progress of all concerned, all contractors shall cooperate with each other and coordinate their operations to the fullest extent. As far as practicable, all contractors performing work for the government shall have equal rights to use of facilities. In a dispute the matter shall be referred to the Project Officer and then the Contracting Officer for settlement and adjustment.

15. CONFIDENTIALITY OF PATIENT RECORDS

The Contractor shall retain confidentiality of patient names, patient conditions and other treatment of patients treated at this facility. Disclosure of information without prior consent of the patient may be made by you to: another provider of health care treating the same patient, Government officials with a need to know. If the Contractor is unsure regarding disclosure, the Project Officer will provide advice. The Contractor shall be responsible to apprise all employees of their responsibility to maintain confidentiality as well as other patient rights.

16. SITE CONDITION

All prospective contractors shall be responsible for having ascertaining pertinent local conditions readily determined by inspection and inquiry such as location, accessibility, parking and the general character of the site and or labs and any other work being performed therein at the time of the submission of offer.

17. FIREARMS

Firearms shall not be brought onto, carried, or stored at the facility at any time.

18. PERSONALLY OWNED VEHICLES

Parking is available on a first come first served basis.

19. NON DISCRIMINATION

The Contractor agrees to make no distinctions among patients under this contract on the basis of race, creed, nor national origin. For the purpose of this contract, distinctions on the ground of race, color, creed, or national origin include, but are not limited to the following: Denying a patient any service or benefit or availability of a treatment, providing any service to a patient which is different or is provided in a different manner or at a different time from that provided to other patients under this contract; subjecting a patient to segregation or separate treatment in any manner related to his receipt of any service; restricting a patient in any way in the enjoyment of any advantage or privilege enjoyed by others. The assignment of time for the provision of services on the basis of race, color, creed, or national origin of the patients is prohibited.

20. OFFICIAL BUSINESS

Government property, to include telephones, shall be used for official business only in the performance of this contract. The Contractor or the Contractor’s employees shall not use government property in any manner for personal advantage, business gain, or other personal endeavor.

21. REASONABLE PRECAUTIONS

The Contractor shall take all reasonable precautions, as directed by the Government or in the absence of such direction, in accordance with sound industrial practices, to safeguard and protect personnel and Government Property.

22. EXCLUSION OF EMPLOYEES

22.1 The Contracting Officer may request the contractor to exclude from work such employees as the Contracting Officer deems incompetent, careless and or unsuitable or whose continued employment is inconsistent with the best interest of the Government. The Contracting Officer reserves the right to exclude from work any employee previously barred from the NHDP.

22.2 The Government may request the Contractor to immediately remove any employees from the work site should it be determined that the individuals being assigned to duty are not qualified or are found to be unfit for performing duties. The contractor shall comply with these requests.

22.3 For clarification a determination of unfit may be made from, but is not limited to incidents involving the most identifiable types of misconduct or delinquency as set forth below:

22.3.1 Violation of rules and regulations of NHDP.

22.3.2 Disorderly conduct, use of abusive or offensive language, quarreling, intimidation by words or actions or fighting. Participating in disruptive activities, which interfere with the normal and efficient operations of the Government, is also considered disorderly conduct.

22.3.3 Theft, vandalism, immoral conduct, or any criminal action.

22.3.4 Possessing, selling, consuming or being under the influence of intoxicants, illegal drugs, or substances that produce similar affects.

22.3.5 Unauthorized use of Government property.

22.3.6 Possession of weapons while on duty.

22.4. In the event of a dispute, the Contracting Officer will make the final determination.

SCOPE OF WORK

C.0 BACKGROUND

The National Hansen’s Disease Programs (NHDP) in Baton Rouge, LA and Carville, LA is a specialized Federal medical facility for persons with Hansen’s disease. The average age of the current population of the residential inpatients is 82. This Center has been owned and operated since 1921 by the Federal Government which has statutory responsibility to provide care for patients with Hansen’s disease.

The Hospital provides care for:

· Ten to fifteen long-term care patients reside at the Saint Clare Manor nursing home, in Baton Rouge LA. where they receive considerable care in their daily living arrangements. The Center no longer admits long-term care patients.

· An estimated 7 long-term care patients, live independently in an apartment setting or cottage with private bath at NHDP, Carville LA.

· It is estimated that up to 10 short-term patients are hospitalized at this Center for treatment, at any given time, from various parts of the United States. Referrals are for confirmation of diagnosis, initial HD treatments or treatment for complications with the disease which includes corrective surgery of hand and foot deformities common with this diagnosis. These patients stay a few days or up to months for rehabilitation of their condition. These patients are not eligible to become long term care patients.

· Outpatients who reside within 250 mile commuting area of the NHDP and Public Health Service Officers and their dependents are also treated at NHDP. (Est.: 20 per month)

The Government provides various specialists to manage Hansen’s disease and disease associated complications. The orthopedist provides required rehabilitative surgery on the hands and feet at a local hospital. The Government provides a Board Certified Pathologist and a Board Certified Radiologist to read biopsies and x-rays respectively. The Government provides the following services at the Center: laboratory, x-ray, dental services, social services, rehabilitative care and dietetic care.

The medical clinic is opened daily (except holidays) at 8:00AM for the patients to see a Physician and receive medical care and prescriptions which are filled at the NHDP Pharmacy. Occupational and Physical Therapists are available daily. This Center is not Labor Attested.

C.1 ORTHOTICS TECHNICIAN REQUIREMENTS AND SHIFTS

The contractor’s performance shall be at the National Hansen's Disease Programs located at 1770 Physicians Park Drive, Baton Rouge, LA. Orthotics technician services as described herein are required 21 hours per week from 08:00 to 3:30 (except Saturdays, Sundays and Federal Holidays). The contractor shall provide a qualified substitute for the Technician in the event of an absence of greater than 2 weeks. In order to provide patient confidence, the Primary Technician shall attend the clinic 75% of the days.

C.2 GOVERNMENT FURNISHED PROPERTY

The Government will furnish all facilities, equipment, and supplies for treatment of patients at the National Hansen’s Disease Programs. The Contractor shall furnish uniforms and personal items in the performance of this contract.

C.3 PERFORMANCE AND POLICIES

The Technician shall comply with established policies and procedures of Health and Human Services (HHS), National Hansen’s Disease Programs and Joint Commission for Accreditation of Health Organizations. Questions shall be directed to the Chief, Rehabilitation and Education Branch.

C.4 UNIFORMS - NAME TAGS

The contractor shall ensure that employees wear appropriate uniforms and a pictorial name tag, identifying them and their level of skill. These shall be worn at all times above the waist while at NHDP.

C.5 QUALIFICATIONS OF ORTHOTICS TECHNICIAN:

The Technician shall be qualified to practice in the State of Louisiana. The Contractor shall provide a Technician who conforms to the following minimum requirements:

1. Be a citizen of the United States and 18 years of age.

2. Be in good health without physical defects or abnormalities which could interfere with arduous tasks and is able to perform arduous tasks without restriction.

3. Possess good judgment and have the ability to assess emergencies and make decisions. The Technician shall also demonstrate alertness, tact, self-reliance, even temperament, neatness, ability to maintain good performance flexibility and spirit of cooperation.

4. Provide acceptable results of a current physical examination within the past year. The certificate shall state that the employee is physically able to perform the assigned work under its contract and is free of infectious or contagious diseases which may be threatening to high risk senior patients. This certificate shall include results of drug tests. The certificate shall be provided to the Project Officer two weeks prior to commencement of work. The medical exam shall include: medical history, including condition of health and proof of Rubella titer, proof that immunizations including hepatitis are up to date.

5. Provide acceptable results of criminal background check.

6. Provide information, including previous experience, and satisfactory performance evaluation from last place of employment.

7. Two satisfactory, written professional references within past 5 years.

8. One year of experience with fabrication of insoles, sandals and basic shoe modifications.

9. At least 6 months experience working with persons affected by Hansen’s disease.

10. The Technician shall have an exceptional command of understanding and speaking the English language.

11. Appropriate continuing education, in service training and meetings.

C.6 DUTIES OF ORTHOTICS TECHNICIAN

Duties include the following:

· Construct, modify and repair custom molded sandals and modify and repair prefabricated sandals.

· Modify commercially-available shoes and repair both commercially-available and custom shoes.

· Assist therapists with construction of foot models from various molding medium and adjust foot models as needed.

· Construct and modify total contact orthoses

· Adjust belts and prosthetic harnesses.

· Consult with therapist on patient cases.

· Maintain records of work orders.

· Assist in maintenance of inventory by tracking materials and supplies used in the shoe shop

· Safely store materials utilized in the shoe shop.

· Assist in education and training of visiting health care providers in sandal construction, shoe modification, construction of foot models and adjustments and construction of total contact orthoses.

· Provide assistance to Occupational and Physical Therapy departments in maintaining and fabricating a stock of monofilaments, cut out felt and other frequently used clinical items and assist in transfer of patients to/from department.

C-7 CONTRACTOR TRAINING

The contractor shall be responsible for any in service training or continuing education provided to employees. The contractor shall be responsible for informing employees of all applicable policies and contents of this contract concerning them. The Contractor shall be responsible for employees’ adherence to these policies and requirements. The contractor shall be responsible to apprise all employees of their responsibility to maintain confidentiality as well as other patient rights.
