USAID/Armenia Pension and Labor Market Reform Program

#
Question
USAID Response
1.
With respect to Section M - the Evaluation Criteria, we note that there is no numerical weighting allocated to the three areas for technical evaluation unlike many RFPs released by the Mission in the past. We find this troubling because it does not indicate the order of magnitude that each of these areas will be a priority for scoring by the technical review committee. Without a clear numerical score, it seems that individual members of the TRC could assign different weights to each of the three areas. In addition, by not assigning clear numerical scores for each of the three areas, it is much more uncertain how much weight is applied to each of the three areas. We respectfully request that USAID provide numerical scores for each of the three Evaluation Criteria.
USAID will not change the evaluation method under this RFP. Proposals will be evaluated using adjectival evaluation method as indicated in Section M.2. The three technical evaluation criteria are listed by descending order of importance and the sub criteria under the technical evaluation criteria are of equal importance.

2.

It has come to our attention in discussions with potential local experts that two of the bidding teams have been very aggressive in trying to secure exclusive letters of agreement with local experts suggesting that they will be unemployed if they do not sign up with a particular bidding team. We believe that this is against the spirit of what is trying to be accomplished through this RFP and respectively request that USAID request that all bidders release local staff from any exclusive letters of commitment that may have been secured under pressure or, at the very least, actively discourage, exclusive letters of commitment with prospective local experts.
USAID discourages requiring exclusive commitments by local experts and specialists. The local capacity and resources should be available to any offeror for the successful implementation of the program and it is up to the offerors to negotiate acceptable terms for the proposed local experts and specialists. Exclusive commitments are acceptable for the 2 key positions identified in L.6.
3.
Section L.8, To supplement the narrative summary in 1. above, provide with your summary a copy of the most recent SF 294 "Subcontracting Report for Individual Contracts" for each contract against which offerors were required to report for the past three years.

Question: Are you asking for a single (March 2009) SF 294 for each contract that we reported on a minimum of 3 years? For example, you do not want SF294s for contracts reported on for 2 years? Where should this information be presented?

For any contract active during the past 3 years, submit the most recent SF294. Thus, only one SF294 for each contract, which could be recent or from 3 years ago. Provide this in the technical proposal, as an annex.

4.
Section M.2. Technical Evaluation, M.2.3. - USAID will evaluate all proposals in accordance with the following criterion for SDB participation:

(a) The extent to which SDB concerns are specifically identified

(b) The complexity and variety of the work SDB concerns are to perform

(c) Past performance of offerors in complying with subcontracting plan goals for SDB concerns and monetary targets for SDB participation

(d) The extent of participation of SDB concerns in terms of the value of the total acquisition

Question: You will evaluate the Offeror’s small disadvantaged business participation without consideration for woman owned, veteran/service disabled veteran owned, or HUBZone participation?

Should refer to small business, NOT small disadvantaged business. Delete the criteria 3. Small Disadvantaged Business (SDB) Participation Criteria under Technical Evaluation criteria and replace it with the following:

3. Small Business (SB) Participation

USAID will evaluate all proposals in accordance with the following criterion for SB participation:

(a) The extent to which SB concerns are specifically identified

(b) The complexity and variety of the work SB concerns are to perform

(c) Past performance of offerors in complying with subcontracting plan goals for SB concerns and monetary targets for SB participation

(d) The extent of participation of SDB concerns in terms of the value of the total acquisition Note: In case the offeror is a small business, they will be given a “neutral” rating for the SB criteria.

5.
Will USAID make available the Annual Reports for the Social Protection Systems Strengthening (SPSS) project implemented by The Services Group, Inc. (TSG)?
Please visit SPSS project website www.spps.am for more technical reports and relevant information.
6.
Section L.6, Instructions Regarding Key Personnel. Requires that both key personnel should have at least seven years of full-time international experience. Should we assume that while some of this experience could be in Armenia, experience in other countries is required as well?
Section L.6, Instructions Regarding Key Personnel’s requirement to have “at least seven years of full-time international experience” applies to a full-time professional/consultancy work in pension and labor market reform areas in two or more countries, not necessarily in Armenia
7.
Please confirm that, if submitted electronically, the proposal should be sent to the same e-mail address as the request for clarifications - i.e., ayeghiazarian@usaid.gov.
Yes, if submitted electronically the proposals should be addressed to Mr. Armen Yeghiazarian at ayeghiazarian@usaid.gov. Also, please copy to Ms. Narine Sarkisian at nsarkisian@usaid.gov .
8.
Section L.5(c)(ii) (page L-3) of the RFP states that Offerors must submit an Activity Work Plan for the three-year duration of the PALM project. Please confirm that if a narrative description of the work plan is provided in the proposal body, then Offerors may include an accompanying Gantt chart as an annex to the technical proposal that will not count against the page limit.
Yes, the information can be submitted as an annex and will not be counted against the 30 page limit for technical proposals.
9.
Section M.2 of the RFP (page M-2) states, under Technical Evaluation – Technical Approach, “Within this criterion, the 3 sub-criteria are considered equal.” This statement is followed by four paragraphs numbered i-iv. Please clarify what the term “3 sub-criteria” refers to.
It is an error. Please replace the “3” with “4.”
10.
Section L.6 (page L-5) of the RFP requires Offerors to submit references for Key Personnel. Please confirm that these references can be considered “biographical information” and can therefore be submitted as an annex to the technical proposal, which will not count against the page limit.
Yes, the references can be submitted as an annex to the technical proposal, which will not count against the 30 page limit.
11.
Please confirm that all requested information regarding past performance, including use of small businesses, may be placed in an annex that will not count against the page limit for the technical proposal.
Yes. Past performance information can be submitted as an annex and will not be counted against the 30 page limit for technical proposals.
12.
Section L.5(c) of the RFP (page L-4 – paragraph 3 under “Past Performance”) states that Offerors must submit past performance information for subcontractors. It further states: “Such subcontractor work must clearly indicate that extent to involvement of the subcontractor(s) in the proposed effort (such as 40% of the total labor hours) and why such subcontractor experience is relevant considering the subcontractor effort proposed.” Could USAID please clarify what proposed level of effort information for subcontractors should be included in the technical proposal?
The technical proposal should clearly define areas of prime and subcontractor responsibility. This could be presented as a matrix or in the narrative. The rationale for a particular subcontractor should be clearly articulated. The cost proposal should relate subcontractor costs to program components.
13.
Regarding Section L.7(b)(1) of the RFP (page L-6), could USAID please clarify what information in L.5(c)(1) the labor distribution chart should parallel, as this instruction does not address labor/staffing?
The labor distribution chart should parallel the management staffing plan and the reference should be corrected to Section L.5.c.(iii), Instructions for the preparation of the technical proposal.
14.
Please clarify under what part(s) of the cost/business proposal the following items should be included:

Attachment 2: Contractor Biographical Data Sheets;

Attachment 3: SF-LLL – Disclosure of Lobbying Activities;

Attachment 4: Certificate of Current Cost or Pricing Data.

The mentioned information should be presented in the following parts of the cost proposal.

Contractor Biographical Data Sheets – Part 2

SF-LLL – Disclosure of Lobbying Activities – Part 3

Certificate of Current Cost or Pricing Data – Not required

15.
As a cost-savings measure, would USAID consider authorizing a 6-day work week for individuals performing short-term assignments?
No blanket approval will be provided for 6 day work week. However, USAID will consider requests for 6-day work week for expat STTA on case by case basis with a justification for cost savings.
16.
RFP Section C, C-11 states “Support GOAM to improve the revenue performance of the unified income tax system with operational improvements of SRC’s and other relevant entities’ business and administrative processes.” Please clarify.

This activity is illustrative and means that some technical assistance (TA) can be provided to the State Revenues Committee to improve its unified income tax collection and business processes.

17.
Article H. 2 LANGUAGE REQUIREMENTS states, “Contractor personnel and/or consultants shall have English and foreign language proficiency (FSI scores 5/S and 5/R) in at least one of the following languages to perform technical services. USAID reserves the right to test proposed individuals to ensure that they have the required language capability as required. English, Armenian, Russian. Additionally, the Contractor’s Chief of Party (COP) is required to have, at a minimum a working knowledge of English.” Could USAID clarify if the Chief of Party also requires minimum language capabilities (speaking and written) in either Armenian or Russian?
The minimum language requirement (FSI scores 5/S and 5/R) should be in at least one of the mentioned languages. In case it is not English, COP is required to have a minimum a working knowledge of English and must be able to communicate in English with USAID staff.
18.
Articles I.2 and I.3. include clauses 52.216-24 and 52.216-25, which are applicable to letter contracts in accordance with FAR 16. 603-4.b. Our understanding is that a letter contract is a written preliminary contractual instrument that authorizes the contractor to begin immediately manufacturing supplies or performing services, which is not contemplated under this RFP. If our understanding is correct, may we suggest elimination of the referenced FAR clauses from the RFP?
The clauses are relevant in case a preauthorization letter will be issued to initiate the activities under the contract.

Please change the date from “June 18, 2009” to “June 24, 2009” under item (b) clause I.3 52.216-25 Contract Definitization (Oct 1997).

19.
References to “major” subcontractors are made in several sections of the RFP. Could USAID provide definition of a major subcontractor?
Major subcontractors are those that perform 20% or more of the total contract.

20.

Please confirm if our understanding, that equipment and supplies necessary for the performance of the program may be budgeted in addition to the $150,000 plug figure for IT Equipment, Software and Commodity support to counterpart institutions, is correct.
Yes, equipment and supplies necessary for the project implementation should be budgeted in addition to the plug figure of $150,000.
21.
The instructions on page L-9, section L.8, request submission of the contractor's most recent SF 294 reports for the past three years. Our SF 294 reports for this period number more than 700 pages and constitute more than 30 files of at least 2 MB each. May we instead submit copies of our 10 most recent and relevant SF 294 reports in an additional annex?
Follow the guidance in the answer to question 3.
22.
Can USAID confirm that graphics and tables, including the required M&E plan (Page L-3), and draft detailed Year 1 work plan (Page L-3), do not count against the 30-page limit?
If submitted as an annex the listed documents will not be counted against the 30 page limit for technical proposals.

23.

Can USAID please provide a copy of the FSN Compensation Scale for Armenia?
The most current Local Compensation Plan dated August 2006 is provided as Attachment 6 to the RFP.
24.
On Page L-3 the instructions request the description of the contractor's past performance it has held within the last 3 years. Can USAID confirm that it does not also require the contractor to submit corporate capabilities to demonstrate the similarity of the contracts to the requirements of the RFP?
The past performance information for the last 3 years should be relevant to the proposed project and similar in nature and complexity.
25.
Thank you for providing the various reports in Attachment 8. Can USAID please confirm that all relevant reports produced under SPSS are available on DEC?
Please visit SPSS project website www.spss.am for more technical reports and relevant information.
26.
What existing equipment, including office furnishings and vehicles, from the predecessor SPSS program (or other projects) will be available to the winning bidder?
The list of existing non-expendable USG equipment, including office furnishing and vehicles available from USAID/SPSS project to PALM is attached as Annex 1.
