DEPARTMENT OF THE TREASURY

SF 1014 - JUSTIFICATION FOR AN EXCEPTION

TO FAIR OPPORTUNITY

Treasury Standard Form – 1014 (Rev 5/18)

Prescribed by Treasury: DTAP 1016.505 Tracking No.

issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order

FAR 16.505(b)(2)(i)(D) – It is necessary to place an order to satisfy a minimum guarantee.

FAR 16.505(b)(2)(i)(E) – For orders exceeding the simplified acquisition threshold, a statute expressly authorizes or requires that the purchase be made from a specified source.

FAR 16.505(a)(4) – The requirement is for an item peculiar to one manufacturer.

4.b Supporting rationale:

As a result of COVID-19, on-site training was not completed for the “Leading Strategic Corporate Change and Transition” training. To complete and continue the training the contractor will convert a portion of the on-site classroom training to virtual training with an instructor.

• Students will spend a total of 15 hours (on-line modules and 7 hours in facilitated group work); and

• A simulation that must be done on-site for either 2-days or 4-half days.

The current contractor is the only source that can provide this training because the class has been fine-tuned and specialized for the XR program for the past five years. The vendor has worked continuously with the XR program managers to adapt and improve the course over the years. As of 2020, the course has evolved to specifically fit the intent of the XR program. This vendor has delivered this training for top government leaders for several years and continues to do so based on the quality of the training, as reflected in their assessments and student reviews. To provide continuity of the XR program it is in the governments best interest to continue with the current vendor and with this training. In doing so, we will be assured that our rising leaders will have the skills they need to effectively lead our organization through challenging change and transition as it continues to occur.

5. A determination that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer will determine the prices to be fair and reasonable based on applicable price analysis techniques.

6.a Any other facts supporting this justification:

Not Applicable

6.b Attachments: Yes No

7. A statement of the actions, if any, the Requiring Activity and Contracting Activity may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies and services is made:

The requiring activity and contracting activity will continue to search the marketplace for potential sources to remove or overcome any barriers to competition in future acquisitions.
