A. Offerors must include all applicable items listed on the Required Attachments
Checklist. RFO packages that are conditional or fail to submit the required documentation by the date and time shown in the Key Action Dates may cause CCHCS to deem the Offer as non-responsive.
B. The specific tasks associated with this RFO are included in the Exhibit A - Scope of Work (SOW). Offerors must be submitted for the performance of all services described herein. Any deviation from the work specifications will eliminate the Offeror from further consideration and award.
C. CCHCS will not accept alternate contract language from the Offeror. CCHCS objects to and will not evaluate or consider any additional terms or conditions submitted by an Offeror. By responding to RFO# 10769914, rebid 2, Offeror agrees to the state’s Terms and Conditions above. If the Offeror refuses to agree to the state’s Terms and Conditions after an award is made, then that refusal could be grounds to rescind the award and award the contract to another Offeror.
D. Costs incurred for the development of Offers, in anticipation of award, are entirely the responsibility of Offeror and shall not be charged to CCHCS or the State of California.
E. CCHCS may amend or modify the RFO prior to the Final Date for Offer Submission indicated in the Key Action Dates of this RFO. All modifications and/or amendments to the RFO will be made in writing and released to all parties who received the RFO.

Bidder / Offeror / Contractor must notify the State in writing if their solution or service includes, or makes available, any GenAI including GenAI from third parties or subcontractors.
The State has developed a GenAI Reporting and Factsheet (STD 1000) to be completed by the Bidder / Offeror / Contractor.
https://www.documents.dgs.ca.gov/dgs/fmc/pdf/std1000.pdf
Failure to submit the GenAI Reporting and Factsheet (STD 1000) will result in disqualification of the Bidder / Offeror / Contractor.
Failure to report GenAI to the State may void any resulting contract. The State reserves its right to seek any and all relief it may be entitled to as a result of such non-disclosure.
Upon receipt of a Bidder / Offeror / Contractor GenAI Reporting and Factsheet (STD 1000), the state reserves the right to incorporate GenAI Special Provisions into the final contract or reject bids/offers that present an unacceptable level of risk to the state.
4. Selection Process
All Offers will be reviewed for responsiveness to requirements of this RFO. If a response is missing required information, it may be deemed non-responsive. Further review is subject to the discretion of CCHCS.
Award of a contract resulting from this RFO will be based on a “Best Value” with cost as one of the criteria. CCHCS is not constrained to accept the lowest cost offer and will compare all offers to determine best value, which means the offer that best meets, and potentially exceeds, CCHCS requirements at the most reasonable overall cost.
Administrative Evaluation
The Assessment Team reviews the Offers to determine whether all Administrative Requirements were provided. Responsiveness to the requirements in this RFO will be either given a “pass” (e.g., complied with requirements, completed, and returned documents) or “fail” (e.g., did not comply with requirements, did not complete or return documents). Only those Offers that receive a passing score will proceed to the next step.
Technical Evaluation
• Review and verify the Mandatory Requirements in Attachment 11. Responsiveness to the Mandatory Requirements will be either given a “pass” (e.g., all requirements are selected as “Can Meet”) or “fail” (e.g., one or more requirements are selected as “Cannot Meet”).
• Review and verify the Desirable Requirements in Attachment 12. For each requirement that is selected as “Can Meet” one point will be awarded.
Desirable Qualifications
Each proposed Contractor that meets a desirable qualification will be scored up to the specific desirable allowable maximum points. If a Contractor does not meet the desirable qualification, the candidate will receive zero (0) points.
•Contractors must provide a copy of a Small Business Certificate from State of California Certification to receive points.
• Contractors must provide a copy of a Disabled Veteran Business Enterprise from State of California Certification to receive points.
Cost Assessment
Contractors must provide a Cost Worksheet – Exhibit C listing the total price.

5. Award of Contract
Award of contract, if made, will be in accordance with the RFO information on Evaluation to a responsible bidder whose bid complies with all the requirements of the RFO documents and an addenda thereto, except for such immaterial defects as may be waived by the state. Award, if made, will be made within forty-five (45) days after the scheduled date for Contract Award as specified in the RFO; however, a bidder may extend the offer beyond 45 days in the event of a delay of contract award.
The state reserves the right to determine the successful bidder(s) either on the basis of individual items or on the basis of all items included in its RFO, unless otherwise expressly provided in the state’s RFO. Unless the bidder specifies otherwise in its bid, the state may accept any item or group of items of any bid. The state reserves the right to modify or cancel in whole or in part it’s RFO.
Written notification of the state’s intent to award will be made to all bidders. If a bidder, having submitted a bid, can show that its bid, instead of the bid selected by the state, should be selected for contract award, the bidder will be allowed five (5) working days to submit a Notice of Intent to Protest, according to the instructions contained in the paragraph titled “Protests” of this RFO.
6. Protests
Any bidder’s issues regarding solicitation requirements must be resolved (or attempts to resolve them must have been made) before a protest may be submitted according to the procedure below. These issues will first be resolved by the contact for the solicitation or if they result in a protest, the protest will be submitted to DGS Procurement Division Deputy Director to hear and resolve issues and whose decision will be final.
If a bidder has submitted a bid which it believes to be responsive to the requirements of the RFO and to be the bid that should have been selected according to the evaluation procedures in the solicitation and the bidder believes the state has incorrectly selected another bidder for award, the bidder may submit a protest of the selection as described below. Protests regarding selection of the “successful supplier” will be heard and resolved by DGS’ Government Claims Board whose decision will be final.
All protests of award must be made in writing, signed by an individual authorized to bind the bidder contractually and financially, and contain a statement of the reason(s) for protest; citing the law, rule, regulation or procedure on which the protest is based. The protester must provide facts and evidence to support the claim. Protests must be mailed or delivered to:
Deputy Director Procurement Division 707 Third Street, Second Floor South West Sacramento, CA 95605 Facsimile No.: (916) 375-4611
All protests to the RFO or protests concerning the evaluation, recommendation, or other aspects of the selection process must be received by the DGS/PD Deputy Director as promptly as possible, but not later than the date indicated in the Notification of Intent to Award. Certified or registered mail must be used unless delivered in person; in which case the protester should obtain a receipt of delivery.

Exhibit A
Scope of Work
1. Introduction and Background
California Department of Corrections and Rehabilitation/California Correctional Health Care Services (CDCR/CCHCS) Statewide Mental Health Program – Request to procure a Point of Care (POC) testing device to be utilized for necessary laboratory monitoring for patients prescribed clozapine at institutions.
This Statement of work (SOW) is for a POC testing device. The clozapine POC Absolute Neutrophil Count (ANC) testing device will allow CDCR/CCHCS to expand the footprint of institutions that offer clozapine to our severely mentally ill patients.
The benefits of this include but are not limited to increased availability of one of the most effective treatments in mental health, increased consistency of monitoring and safety for patients prescribed the medication, and increased transfer options for patients on the medication. Our aim is to reduce barriers to the use of clozapine within CDCR/CCHCS. POC testing would reduce one identified barrier to clozapine treatment.
Clozapine is a highly effective, but underutilized medication that has Food and Drug Administration (FDA) approval for targeting treatment resistant schizophrenia and suicidal behavior in patients who have schizophrenia or schizoaffective disorder. It has been shown to be effective in reducing overall suicidal and self- harm behavior.
Its use requires close monitoring of absolute neutrophil counts, as there is an estimated incidence of 0.9% for the development of severe neutropenia (1).
Providers and pharmacies are required to register with the Clozapine Risk Evaluation and Mitigation Strategy (REMS) and each patient on clozapine must be registered with their values input prior to medication being dispensed for that monitoring interval. Monitoring of ANC requires weekly testing for at least the first six (6) months, followed by testing every two (2) weeks, then monthly testing. For a patient with an uncomplicated treatment trajectory, this would equate to approximately 39 tests per year during the first year, followed by monthly tests thereafter. Currently, routine blood draws are completed in order to perform the required monitoring. One literature review conducted cited that “The complete refusal of blood tests was considered a major barrier, with patients delaying the initiation of clozapine” (2) and another article identified that “patient non-adherence with blood work” (2) was a barrier to treatment. They additionally identified articles that evaluated POC testing in overcoming barriers to the use of clozapine, and found that “both patients and practitioners showed preference for the capillary blood sampling” (2).
2. Scope of Services
The vendor providing the POC testing device shall provide, at a minimum, the physical devices, and access to any applications or software and updates needed.
Any necessary equipment or supplies needed for the utilization of the device, to include but not limited to testing strips compatible with the device, software or platform application access shall be provided by the vendor for the duration of the departments use of the device. By submitting an offer or proposal, Contractor represents that it is not a target of Economic Sanctions. Should the State determine Contractor is a target of Economic Sanctions or is conducting prohibited transactions with sanctioned individuals or entities, that shall be grounds for rejection of the Contractor’s offer/proposal any time prior to contract execution, or, if determined after contract execution, shall be grounds for termination by the State.

Accordingly, California Correctional Health Care Services (CCHCS) is prohibited from agreeing to supplier agreements that conflict with State IT contract forms.
To move forward with acquisition of an IT software service or product, CCHCS shall ensure the acquisition will be governed by the same State IT contract terms between CCHCS and the applicable vendor and any applicable reseller. The solicitation contains several State IT contract forms that are required by SAM Section 5230.1.
In order to consider a vendor’s or reseller’s proposal complete, the vendor and the reseller are required to sign the Software/Service Provider Acknowledgment below and return a copy of this letter as part of the response to the CCHCS procurement request. As a condition to determining the bid responsive, the vendor and reseller shall agree to the State Terms and Conditions as outlined in the solicitation as these terms will govern the awarded contract. CCHCS reserves the sole right to determine whether a bid fails to meet this requirement and bids submitted without this signed acknowledgement will not be considered or scored.
Further, as part of this solicitation or a Leveraged Procurement Agreement, this letter informs any bidder that the following will be the order of precedence noted in the final agreement, and will supersede any other documents attached to, or referenced within, the vendor or reseller solicitation response:
