About this file
This is a Standards of Conduct Declaration form (Form AG-010) required by the State of Hawaii for a contractor bidding on Invitation for Bid (IFB) J27150 for Hoapili Hale Power Quality System Improvements. The declaration serves as a compliance document under Hawaii Revised Statutes Chapter 84 (Code of Ethics) and must be completed and signed by the contractor prior to contract award. The project involves installation of surge protection devices throughout the building, installation of a power conditioner for the 3rd elevator bank, and re-circuiting of existing gates to emergency power at Hoapili Hale.
The form requires the contractor to declare under penalty of perjury that: (1) the contractor is not a legislator or employee, nor does a legislator or employee have a controlling interest in the contractor's business; (2) the contractor has not been personally represented or assisted by a former agency employee from the awarding agency within the preceding two years who participated in the contract matter; (3) the contractor has not been assisted by a legislator or employee for compensation to obtain or perform the contract if that person was involved in its development or award; and (4) the contractor has not been represented on contract-related matters by a former agency employee or legislator within the past twelve months. The State of Hawaii reserves the right to void the contract if any provision of the Code of Ethics is violated, and may recover any fees, compensation, gifts, or profits received as a result of such violations. If the contractor is also a legislator or employee and the contract value exceeds $10,000, the contract must be awarded through competitive sealed bidding or proposal procedures, or the agency must post a notice of intent to award and file it with the State Ethics Commission.
