About this file
This document is an Amendment of Solicitation/Modification of Contract for DLA Troop Support, focusing on a procurement opportunity for chemical products. Key details include:
The amendment clarifies solicitation requirements for an Indefinite Delivery/Indefinite Quantity (IDIQ) contract, with offers due by October 23, 2025, at 3:00 PM Eastern Standard Time. Notable modifications include increasing the accelerated delivery timeframe from 30 to 60 days after delivery order, incorporating the First Destination Transportation (FDT) Program, and providing detailed responses to 14 vendor questions covering topics such as liability limitations, supply chain uncertainty, quantity discounts, and past performance evaluations. The solicitation requires F.O.B. Origin pricing with a location within the Contiguous United States, and will evaluate offers on a Lowest Price Technically Acceptable (LPTA) basis, with technical acceptability determined by compliance with solicitation requirements and past performance.

Amendment 0001 is issue to clarify the following:
All offers must be submitted by the Offer Due Date/Local Time of 2025 Oct 23 at 03:00 PM as it says on page 1 on the solicitation. Page 4 of the solicitation is corrected to say October 23, 2025, 3:00 P.M. (Eastern Standard Time).
Procurement note C17 First Destination Transportation (FDT) Program – Shipments Originating from Outside the Contiguous United States (JUN 2020) is hereby incorporated into the solicitation.
1.Liability: Will DLA consider adding a limitation of liability / no consequential damages clause under FAR 52.212-4?
•DLA Response: FAR 52.212-4 is incorporated by reference into the Solicitation on page #12.
2.Bid responsiveness: If we request insertion of these guardrails in our quote, would our bid no longer be considered responsive/qualified?
•DLA Response: Any specific conditions from individual offerors must be incorporated into their proposal for evaluation by the Government. Such conditions may be incorporated into resultant contract award(s) to the extent that they are legally permissible, do not contradict the express terms of the solicitation, and to the extent that the offeror’s proposal is ultimately determined to present the best value for the Government.
3.Supply-chain certainty: Given low guaranteed minimums under an IDIQ, what mechanisms (e.g., rolling forecasts, Deliver Order(DO) smoothing, quarterly visibility) will DLA use to reduce supply-chain uncertainty and enable responsible inventory planning?
•DLA Response: DLA always maintains a strong relationship with its suppliers under contract and will work towards solutions that can maintain the industrial base of supply, given potential supply-chain uncertainty. DLA anticipates establishing joint inventory planning with any contractor(s) selected for award and will make strategic decisions for inventory location and posture.
4.Material unavailability: If fluorosurfactants become unavailable during performance and our minimum contract quantities are met, would the contract be treated as termination for convenience or default? How would this affect CPARS risk rating on our other Government contracts?
•DLA Response: DLA cannot speculate on its responses to hypothetical future contingencies. However, DLA does not anticipate generating negative CPARS performance ratings for circumstances that are clearly demonstrated to be beyond its contractors’ reasonable authority and control.
5.Demand change: The five-year demand appears to be ~one-third of the Source Sought (Aug 4, 2025). Please confirm and explain the basis and implications for annual ordering patterns.
•DLA Response: At this time, the full nature of a requirement beyond five (5) years is unknown. The acquisition strategy will permit flexibility to procure material beyond the five (5) year projections provided to DLA, consistent with the terms of the solicitation and resultant contracts and in accordance with then-existing demand.
6.Awards by CLIN: Will awards be strictly per-CLIN (per NSN), and can one offeror receive multiple CLINs?
•DLA Response: One offeror can receive multiple Contract Line-Item Numbers (CLINs), if it is determined to offer the best value to the Government for each of those CLINs. For the sake of efficiency, the Government may group multiple CLINs onto a single contract if the offeror’s proposal is determined to offer the best value for multiple CLINs.
7.Lowest Price Technically Available(LPTA) criteria: Beyond QPL status, what technical acceptability criteria will be applied, how will they be evaluated, and are any non-price factors pass/fail (e.g., delivery lead times, packaging/ marking, past performance thresholds)?
•DLA Response: Please see the provision at FAR 52.212-2 on p. 39 of the solicitation for the applicable evaluation criteria. Technical acceptability will be applied to Compliance with the Solicitation Requirements (Technical) and Past Performance. Delivery lead times and packaging/marking, are solicitation requirements and, therefore, would be applicable to Compliance with the Solicitation Requirements. Past performance will be evaluated as specified in the solicitation. Proposals that do not meet solicitation requirements will be determined to be technically unacceptable for award. Proposals being evaluated against these requirements will receive a rating of acceptable/unacceptable.
8.Quantity discounts: If we offer discounts for firm orders materially larger than the AEQ, should they be included in our bid, and will they be considered in the LPTA price assessment?
•DLA Response: Price will be evaluated in accordance with the provision at FAR 52.212-2, as set forth on p. 40 of the Solicitation. This is a competitive acquisition, and offerors are encouraged to submit their best possible pricing for the price evaluation. Bulk order discounts may be offered and accepted, provided that an offeror’s proposal would otherwise constitute the best value to the Government under the evaluation criteria of the Solicitation. However, they will not factor into the Government’s price evaluation for purposes of the award decision.
9.DO visibility: Will DLA provide periodic demand forecasts or quarterly Delivery Order (DO) visibility to mitigate risk from variable ordering?
•DLA Response: DLA will provide periodic demand forecasts and quarterly Delivery Order visibility to any resultant contractor(s).
10.Accelerated deliveries (Item 13): Will DLA consider revising the accelerated delivery from 30 days After Date of Order(ADO) to 60 days ADO, or alternatively issuing firm quantity task/blanket orders, given we cannot hold raw materials for a single-customer demand?
•DLA Response: The minimum accelerated delivery requirement identified on p. 8 of the solicitation is hereby increased from 30 days after the date of the delivery order to 60 days after the date of the delivery order.
11.FOB Origin (Item 11): With FOB Origin required, will origin location and estimated shipping costs be considered in price evaluation?
•DLA Response: Offers are solicited on the basis of F.O.B. Origin only. See item 11 on p. 7 of the solicitation.
Therefore, estimated shipping costs will not be considered in price evaluation. As set forth in the solicitation, “Delivery instructions will be included on each delivery order for scheduling transportation in accordance with C16 First Destination Transportation (FDT) Program, Government Arranged Transportation for Manual Awards (AUG 2017).”
Offers made on an FOB Destination basis will be technically unacceptable as offering on FOB Origin basis is a solicitation requirement and, therefore, would be applicable to Compliance with the Solicitation Requirements.

12.U.S. origin requirement: Must the FOB Origin location be within the United States?
•DLA Response: Yes, all offerors must have an FOB Origin location within the Contiguous United States. OCONUS suppliers are required to quote delivery to a CONUS location for pickup if the acquisition is part of the FDT program. C17 First Destination Transportation (FDT) Program – Shipments Originating from Outside the Contiguous United States (JUN 2020) (1) The FDT Program applies to this acquisition. Delivery terms are f.o.b. origin. The Government will conduct inspection and acceptance at destination. (2) If an offeror’s shipments will originate from outside the contiguous United States, the offeror shall include in its f.o.b. origin price transportation to a contiguous United States location that the offeror selects based on cost-effectiveness or other variables at the offeror’s discretion.
The location the offeror selects becomes the point of origin for purposes of the f.o.b. origin terms and conditions of the solicitation or award. The offeror shall identify this contiguous United States location as the pick-up point in the Vendor Shipment Module.
13.Shipping responsibility: Per SOW §4.3, will supplier-arranged shipping be required, with transportation costs included on invoices to the Government?
•DLA Response: Supplier-arranged transportation will not be required. Please refer to pp. 8 and 20 of the solicitation. Delivery instructions will be included on each delivery order for scheduling transportation in accordance with C16 First Destination Transportation (FDT) Program, Government Arranged Transportation for Manual Awards (AUG 2017).
14.Past Performance: If a bidder has no past performance history, will the Past Performance factor be rated Acceptable? Please confirm how this will be applied.
•DLA Response: Please refer to p. 39 of the solicitation. “Based on the performance record obtained, an acceptable rating will be given based on a reasonable expectation that the offeror will successfully perform the required effort based on the offeror’s quality and delivery track record indicating no major issues, or the offeror’s performance record is unknown.” In the case of an offeror with no past performance history, the offeror’s performance record will be unknown and will receive an acceptable rating.
