About this file
This is a Standard Labor and Material Payment Bond template issued by the City of Fairfax, Virginia. The bond serves as a guarantee that contractors will pay all labor and material suppliers involved in the performance of public works contracts. The bond requires the contractor (Principal) and a surety company to guarantee payment to all claimants, including subcontractors and material suppliers, for work performed and materials furnished in connection with the contract. Claimants with direct contractual relationships to the Principal may pursue legal action against the bond if they are not paid within 90 days of completing their work or delivering materials. Claimants with relationships only to subcontractors must provide written notice to the Principal within 90 days to preserve their right to bring action on the bond.
The bond establishes specific terms and conditions governing claims, including a one-year statute of limitations for commencing legal action and requiring that suits be brought in Virginia courts of competent jurisdiction or the applicable United States District Court. The bond amount is reduced proportionally as payments are made in good faith. The document includes provisions for execution by the contractor and certification by the surety's attorney-in-fact through a notarized affidavit acknowledging the Power of Attorney under which the surety executes the bond. This standard bond form applies to all public works projects undertaken by the City of Fairfax and protects laborers, material suppliers, and subcontractors from non-payment by ensuring a secondary source of recovery through the bonding company.
