About this file

This is a Notice to Bidders and Special Provisions document issued by the California Department of Transportation (Caltrans) for construction work on State Route 59 in Merced County. The project involves cold planing, hot mix asphalt (HMA) placement, curb ramp construction, culvert work, and electrical system modifications across two segments: from 0.1 mile north of Hoffman Avenue to 14th Street and from 0.1 mile south of 13th Street to 0.1 mile west of Bear Creek Overcrossing. The work is identified as Contract No. 10-1M4804, Federal-Aid Project ACST-P059(076), with bids opening on Wednesday, November 18, 2026 at 2:00 p.m. via the Bid Express website. The estimated project cost is $9,300,000, with contractors required to complete the work within 170 working days. The bid item list includes 85 line items encompassing traffic control systems, pavement work, drainage infrastructure, concrete work, sign installation, and electrical modifications. Contractors must possess either a Class A license or a combination of Class C licenses (C-12, C-10) constituting a majority of the work, and the project requires nine trainees or apprentices for the federal training program.

Bids must be submitted on a unit price basis with bidder's security of at least 10 percent of the total bid amount. Prevailing wage rates as determined by the California Department of Industrial Relations apply to all work, and contractors must comply with federal minimum wage requirements when they exceed state rates. The Department furnishes certain electrical components, including loop detector sensor units, controller assemblies, and battery backup system components, which contractors must pick up at Caltrans Electrical Maintenance in Stockton, California. Key contractual requirements include submission of a Level 2 Critical Path Method schedule, stormwater pollution prevention plan or water pollution control plan, dispute resolution advisor nomination, and contingency plans for cold-planing and paving activities. Contractors must establish a site-specific safety program with a designated safety representative meeting specific certifications and qualifications, coordinate with Union Pacific Railroad for flagging services (estimated at approximately 4 days), obtain encroachment permits from the City of Merced, and comply with Buy America requirements for applicable materials. The project involves coordination with coincident contracts in the area and adherence to specific lane closure restrictions for designated holidays and special days.

Meet with the Engineer and UPRR representative at a mandatory preconstruction meeting to be held a minimum of 21 days prior to the start of jobsite activities. Discuss the work to be performed including your means and methods. Discuss requirements for coordination and scheduling railroad flagging, including notifications of potential changes in scheduled work.

Within the notification of work in proximity of the railroad, include the type of work to be performed and equipment to use. You will be notified by the railroad representative of flagging requirements, including number of flaggers required within 30 days of your notification. You are responsible to notify the Engineer, UPRR representative and railroad flagging company of changes in your work to be performed that may change flagging needs. These notifications must be made a minimum of 10 days in advance of the changed work.

Comply with the railroad’s published policy found at https://www.up.com/real-estate/third-party-flagging for scheduling railroad flagging.

Securing flagging services will not relieve you of your responsibilities or liabilities pertaining to UPRR.

The railroad representative will make the final decision of flagging needs based on your description of your work activities, personnel and equipment in your notification and actual field operations. If your operations are delayed because an insufficient number of flagging personnel are scheduled due to description of work in the notification not aligning with actual field operations, you will be responsible for your delay costs.

You must comply with requirements for flagging services as identified within the Contractor’s Right of Entry Agreement issued by UPRR. You are responsible for any costs associated with failure to comply with these requirements. If UPRR or the flagging service bills you for expenses incurred for your failure to comply, you must pay such bills within 30 days of bill receipt. The Department does not reimburse those costs incurred for your failure to comply.

You are responsible for direct and timely payment of undisputed flagging services provided by the UPRR approved railroad flagging subcontractor. The Department reimburses you these costs upon your submittal of required documentation and proof of your payment.

The Engineer and UPRR representative will monitor your operations for compliance with required flagging services. 6-1.04 BUY AMERICA

6-1.04A General

Buy America requirements do not apply to the following:

1. Tools and construction equipment used in performing the work.

2. Temporary work that is not incorporated into the finished project.

An article, material, or supply to be permanently incorporated in the project should only be classified into one of the following categories:

1. Iron or steel products

2. Manufactured products

3. Construction materials

4. Excluded materials

Excluded materials means cement and cementitious materials; aggregates such as stone, sand, or gravel; or aggregate binding agents or additives.

6-1.04B Crumb Rubber (Pub Res Code § 42703(d))

Furnish crumb rubber with a certificate of compliance. Crumb rubber must be:

1. Produced in the United States

2. Derived from waste tires taken from vehicles owned and operated in the United States

6-1.04C Iron or Steel Products

1. Foreign pig iron and processed, pelletized, and reduced iron ore may be used in the domestic production of the steel and iron materials

2. If the total combined cost of the materials produced outside the United States does not exceed the greater of 0.1 percent of the total bid or $2,500, the material may be used if authorized

Furnish iron or steel products to be incorporated into the work with certificates of compliance and certified mill test reports. Mill test reports must indicate where the steel and iron were melted and manufactured.

All melting and manufacturing processes for these materials, including an application of a coating, must occur in the United States. Coating includes all processes that protect or enhance the value of the material to which the coating is applied.

6-1.04D Manufactured Products

Manufactured products mean articles, materials, or supplies that have been:

1. Processed into a specific form and shape; or

2. Combined with other articles, materials, or supplies to create a product with different properties than the individual articles, materials, or supplies

Manufacturer, in the case of manufactured products, means the entity that performs the final manufacturing process by bringing individual elements together that produces a manufactured product.

If an item is classified as an iron or steel product, a construction material, or an excluded material under the definitions set forth under this Buy America section, then it is not a manufactured product. However, an article, material, or supply classified as a manufactured product under this Buy America section may include components that are construction materials, iron or steel products, or excluded materials.

Iron or steel used in precast concrete manufactured products or enclosures for Intelligent Transportation Systems (ITS) must meet the requirements of section 6-1.04C regardless of the amount used.

Minor additions of articles, materials, supplies, or binding agents to these construction materials do not change the categorization of the construction material.

6-1.04F Buy America Waiver for the De Minimis Costs for Manufactured Products and Construction Materials

A De Minimis Costs waiver can waive the application of FHWA's Buy America requirements for manufactured products and construction materials under a single project when the total cost of non-compliant manufactured products and construction materials is no more than the lesser of $1,000,000 or 5 percent of the total applicable costs for the project.

The percentage threshold is calculated based on the following formula:

X = NC / TA

where:

X = percent threshold NC = total cost of non-compliant construction materials and manufactured products TA = total applicable project costs (steel, iron, construction materials and manufactured products;

does not include excluded materials)

This threshold is based on the actual cost of the steel, iron, construction materials, and manufactured products, not the anticipated cost of those materials. The contractor must account for compliant and non-compliant Department-Furnished Materials for the project in the De Minimis Costs Waiver Worksheet calculation if provided by the Department as supplemental project information.

See further instructions for the De Minimis Costs waiver request in the Notice of Materials to be Used form.
