FAR 52.212-2 -- Evaluation -- Commercial Items (Oct 2014)

(a) The Government, using comparative analysis between past performance and price of technically acceptable offerors, may award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation (to include all stated terms, conditions, mission essential plan, representations, certifications and all other information required by the instructions), deemed responsible IAW FAR 9.1 as supplemented, and is judged, as the most advantageous to the Government, price and other factors considered. This allows the Government to accept other than the lowest priced offer or other than the most highly rated past performance offer to achieve a best value award. Non-price factors are significantly more important than the price factor. If an offeror has the lowest Total Evaluated Price and has the most highly rated Past Performance, no further comparative analysis will be accomplished as it is determined to be the most advantageous to the Government offer.

(b) The following factors shall be used to evaluate offers:

(i) Technical: Did the prime offeror have at least one person attend the site visit?

The attendance sign-in sheet from the site visit will be used as verification. If yes, offer will be evaluated for past performance. If no, the offer will not be further evaluated.

(ii) Price: The offeror’s Total Evaluated Price (TEP), for award purposes, will be based upon the total price proposed for each Contract Line Item Number (CLIN) including all options as calculated from Appendix A. Price will be evaluated IAW FAR 13.106-3.

(iii) Past Performance: Comparative analysis will be used to evaluate Offeror’s past performance to determine if the Government has a reasonable expectation that the offeror will successfully perform the required effort. Offerors will be more highly rated if: 1) Demonstrated that they have successfully maintained the same or similar brand equipment; and/or 2) Obtained brand/manufacturer certifications/training associated with the equipment to be maintained in Attachment 1 PWS. The offeror’s past performance record will be based on the information provided by the offeror and data independently obtained from other government and commercial sources.

2. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

3. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
