About this file

This is a Justification for Other Than Full & Open Competition (JOFOC) filed by the Federal Energy Regulatory Commission (FERC) for a non-competitive procurement of S&P Capital IQ Pro services from S&P Global Market Intelligence, LLC.

FERC seeks access to S&P Capital IQ Pro, a web-based market intelligence platform, to support the Office of Enforcement and Regulatory Accounting (OERA) in conducting electric market surveillance and analysis. The platform provides comprehensive data on corporate structures and subsidiaries, power purchase agreements, pipeline and electric infrastructure mapping, REC pricing, operational status of power plants, geospatial location data, merger and acquisition filings, and bilateral market prices. FERC justifies the single-source procurement under FAR 6.302-1 (only one responsible source), asserting that no other vendor provides an integrated view combining a power plant's operational, economic, and financial profiles with consolidated corporate ownership and market news data. The document notes that Velocity Suite, a competing vendor, provides some operational data but lacks the economic and financial integration that S&P Capital IQ Pro offers. The estimated five-year procurement cost (one 12-month base period plus four 12-month option periods) is $2,827,108.00, broken down as: Base Period $486,728.00; Option Period 1 $523,233.00; Option Period 2 $562,475.00; Option Period 3 $604,661.00; and Option Period 4 $650,011.00. FERC has consistently used S&P Global Market Intelligence since 2008 and has built analytical programs around the platform's data structure. The procurement was approved by the Contracting Officer and Competition Advocate on February 12, 2026.

JUSTIFICATION FOR

OTHER THAN FULL & OPEN COMPETITION

PROJECT NAME: S&P Capital IQ Pro (formerly known as S&P Global Market Intelligence)

The following Justification for Other than Full & Open Competition (JOFOC) is prepared using the format at FAR 6.303-2, modified to reflect that the procedures in FAR subpart 13.5 in accordance with 41 U.S.C.1901.

1. ORGANIZATION:

Federal Energy Regulatory Commission (FERC) Office of the Executive Director (OED) Acquisition Services Division (ASD) 888 First Street, NE Washington, DC 20426

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED:

It is the intent of the Federal Energy Regulatory Commission (FERC) Office of the Executive Director (OED), Chief Information Officer (CIO), Office of Enforcement and Regulatory Accounting (OERA) to obtain access to S&P Global Market Intelligence, LLC for its S&P Capital IQ Pro (formerly known as S&P Global Market Intelligence) service, a web-based application to support FERC’s oversight of energy markets.

Electric Surveillance requires an understanding of market participant-specific information to analyze market activity for anomalies and incentives. While FERC’s current databases provide electric pricing data, FERC lacks data platform access to comprehensive and compiled electric industry data. S&P Capital IQ Pro is a web-based application that provides advanced market intelligence data access with sources and quality that no other vendor provides.

The basis for limiting the sources for this acquisition is as follows: S&P Global Market Intelligence, LLC’s S&P Capital IQ Pro platform, is the only source discovered that provides a comprehensive overview of market information, sellers, and contracts to support OERA’s oversight of energy markets. S&P Global Market Intelligence, LLC is a leading energy market information provider that focuses on business, financial, and regulatory information.

3. DESCRIPTION OF REQUIREMENT & VALUE:

Information on corporate structures and subsidiaries, power purchase agreements, pipeline and electric infrastructure mapping tools, and REC pricing is needed for OERA to perform more effective Electric Surveillance. That data enables FERC to more accurately analyze market participant incentives and provides FERC with a better picture of market participants' activities. Additionally, S&P’s Capital IQ Pro data platform provides a host of other gas, power, and corporate identification data sources, from multiple sources, allowing OERA and other FERC program office staff the ability to transform the data for analysis. The platform also provides insights through visualization tools for a more complete picture of market activity and data.

Without this unified, continuously updated data platform that consolidates corporate ownership, subsidiaries, power purchase agreements, market news, and transaction research, FERC staff would face a fragmented process—pulling data from multiple vendors, reconciling inconsistencies, and manually researching gaps. This would make timely and comprehensive analysis nearly impossible.

The platform not only saves significant time but also expands the breadth and accuracy of data FERC can analyze.

The estimated dollar value of this procurement for five (5) years (one 12-month base plus four 12-month option periods) is $2,827,108.00.

Base Period: $486,728.00 Option Period 1: $523,233.00 Option Period 2: $562,475.00 Option Period 3: $604,661.00 Option Period 4: $650,011.00

4. STATUTORY AUTHORITY:

The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(2) in accordance with:

[ ] FAR 6.302-1, only one responsible source and no other supplies and services will satisfy Agency Requirements;

[ ] FAR 6.302-2, Unusual and compelling urgency;

[ ] Other, define below:

5. DEMONSTRATE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS:

Ownership, affiliation, and market concentration of energy market entities are critical to FERC's surveillance program. The S&P Capital IQ Pro service has been instrumental in enhancing OERA’s ability to track these relationships by providing more comprehensive and detailed information than other energy market data sources. In addition to ownership and affiliation data, Capital IQ Pro offers a complete view of U.S. electric power plants, including operating status, ownership control, performance metrics, geospatial location, trade press mentions, corporate filings related to mergers and acquisitions, and bilateral market prices.

As the only source discovered delivering such breadth of market information—covering sellers, contracts, and plant profiles—S&P Capital IQ Pro is essential to supporting OERA’s oversight of energy markets. S&P Global Market Intelligence, LLC, the provider of Capital IQ Pro, is a leading authority on business, financial, and regulatory information.

6. SOURCES SOUGHT EFFORTS:

Information available in S&P Capital IQ Pro now provides FERC with a comprehensive view of energy entity ownership. Further, FERC analysts have built programs around the structure and content of the S&P Capital IQ Pro data which feed into ownership and affiliate analyses. S&P Capital IQ Pro also provides easy access to fuel contracts and power purchase agreements that provide FERC staff greater insight into market participant behavior.

7. DETERMINATION OF FAIR & REASONABLE PRICING:

S&P Capital IQ Pro is a proprietary product provided by S&P Global Market Intelligence LLC. S&P Capital IQ Pro provides far more in terms of service than can be provided by an FTE at far less than the cost of an FTE. Existing contracts for data from other FERC third-party data vendors are at far greater cost than S&P Capital IQ Pro.

By signing this justification, the Contracting Officer makes a determination that the costs/prices to the Government are expected to be fair and reasonable to the Government, by verifying the vendor’s price prior to award by comparing the vendor’s proposed price with the Independent Government Estimate (IGE) and with recent FERC contracts for similar services.

8. DESCRIPTION OF MARKET RESEARCH CONDUCTED RESULTS:

No other vendor besides S&P Global Market Intelligence, LLC provides an integrated view of a power plant’s operational, economic, and financial profile.

Velocity Suite, a competing vendor with which FERC also has a subscription, provides some of the power plant operational data sources that S&P’s Capital IQ Pro data platform does, but it does not integrate the economic and financial information for power plants in a time series manner that S&P’s Capital IQ Pro can easily display. Additionally, no source collates market news and information by company and power plant from all major news sources, greatly enhancing the ability of Electric Surveillance staff to understand market dynamics. S&P Capital IQ Pro also tracks all planned and under construction power plants and their ownership and power purchase agreement structures.

9. ANY OTHER FACTORS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN

COMPETITION:

From 2008 until 2026, FERC analysts have used S&P Global Market Intelligence consistently and it has become a critical tool in entity ownership identification. Further, FERC analysts have built programs around the structure and content of the Market Intelligence data which feed into ownership and affiliate analyses.

Because FERC purchases services from many of the vendors in the space, FERC understands what is currently available in the market. The time required for new development of a product would inhibit surveillance needs and would realistically create costs well exceeding those on a commercially available product.

Consideration of those products commercially available rather than new development projects is prudent from both the perspective of schedule and budget.

10. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE

ACQUISITION.

Not Applicable.

11. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME

ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SERVICES

REQUIRED:

Prior to competing of this requirement, FERC will conduct market research in the vast array of assembled data and analytics capabilities platform area to expand awareness, in order to potentially identify future products that perform equals or other vendors that are able to provide the same function and service.
