About this file

This is a sample bid bond form for the City of Owensboro, Kentucky, related to a demolition project at 1829 Triplett Street, Owensboro, KY 42303. The bid bond serves as a guarantee that a bidder will execute the required contract and provide necessary performance and payment bonds if awarded the project. The form is a template that requires bidders to complete essential information including the bidder's name and address, the surety's name and principal place of business address, the bid due date, project description, bond number, bond date, and the penal sum amount. Default by the bidder occurs if the executed agreement and any required performance and payment bonds are not delivered within the time specified in the bidding documents or any written extensions agreed to by the City.

The bid bond obligates the bidder and surety jointly and severally to pay the penal sum to the City upon the bidder's default, with such payment representing the full extent of liability and the City's sole remedy. The obligation becomes null and void if the City accepts the bid and the bidder timely delivers the executed agreement and required bonds, if all bids are rejected, or if the City fails to issue a Notice of Award within the timeframe specified in the bidding documents or agreed extensions. Payment under the bond is due within thirty days of the City's written notice of default. Suits or actions under the bond may not be commenced prior to thirty days after notice of default is received and in no case later than one year after the bid due date. All notices must be in writing and may be sent by personal delivery, commercial courier, or United States Registered or Certified Mail to the addresses shown on the bond form.
