About this file
This is a sample bid bond form provided by the City of Owensboro, Kentucky, for use in competitive bidding processes. The document establishes the standard terms and conditions under which bidders and their sureties agree to guarantee performance and contract execution. The bid bond serves as security to ensure that the successful bidder will execute the required contract agreements and provide any mandated performance and payment bonds within the specified timeframe. The form allows for customization of project details, bid due dates, bond amounts, and surety information to accommodate various municipal procurement actions.
The bond establishes joint and several liability between the bidder and surety, with the penal sum representing the extent of liability and the owner's sole remedy in case of default. Default occurs when the bidder fails to deliver the executed agreement and required performance and payment bonds within the timeframe specified in the bidding documents. The bond becomes null and void if the owner accepts the bid and the bidder performs required deliverables, if all bids are rejected, or if the owner fails to issue a notice of award within the specified timeframe plus any extensions not exceeding 120 days without surety consent. Payment under the bond is due within 30 calendar days of written notice of default, with no legal action commenceable prior to 30 days after notice or later than one year after the bid due date. Any litigation must be filed in a court of competent jurisdiction within the state where the project is located.
