Reviewing Criteria
In awarding a contract, the District shall consider: purchase price, the reputation of the vendor and of the vendor’s goods and services, the quality of the vendor’s goods or services, the extent to which the goods or services meet the District’s needs, the vendor’s past relationship with the District, the impact on the ability of the District to comply with laws relating to historically underutilized businesses, the total long-term cost to the District to acquire the goods or services, and any other relevant factor that a private business entity would consider in selecting a vendor. In addition, quality and suitability of the product and not price alone shall be considered in the acceptance of proposals. Consideration may also be given to the bidder’s references and record for responsibility, knowledge of the product, and service.
Instructions to Bidders
Pricing Structure: Vendor responses should include a pricing structure to use as a guideline, however pricing can be negotiated for each specific event.
Reimbursable Cost: If the Vendor requires reimbursement for costs (e.g. air travel, lodging, per diem, handouts, and all other District authorized expenses) associated with the services provided, the Vendor must identify this requirement within their response listed as reimbursable cost. If such costs are included within the services fees, the Vendor is not required to include this information. For contracts requiring reimbursement, receipts are required and the District will only pay the actual costs incurred by the Vendor.
Maximum Annual Expenditure: The District reserves the right to limit expenditures of any one vendor if such expenditures reach a level in which a competitive bid would better serve the District.’
Vendor Agreement: The District purchase order should be considered the official contract between the District and the Vendor and no other document should be necessary. If the Vendor requires a contract that due to valid reasons an additional agreement is necessary, this agreement will be reviewed by the Business Department. The District reserves the right to reject such request and consider the purchase order the official agreement. If the District considers the additional agreement, no services are to be provided until the District has reviewed, accepted, modified and/or struck all provisions or clauses that are in violation of State of Texas law, District policies, and/or are not considered in the District’s best interest.
Vendor Sales: In the event, a vendor has products to sell during a presentation, a separate purchase order for supplies must be in place.
Payment: Payment will be made only after services have been rendered, and approval for payment by the appropriate departmental manager. Deposits will not be considered before services are rendered.
Award of Bid: It is the intent of the District to award this bid at the June 8, 2026, Board Meeting to multiple vendors to accommodate the needs of the entire District.
Terms of Agreement: This bid will expire June 30, 2031 with two additional one (1) year renewals and with the right of the District to issue supplemental bids if additional vendors are needed. District reserves the right to extend contract exceeding the five years upon negotiations.
Authorization: The New Braunfels Independent School District will not be responsible for any goods/services delivered without a purchase order signed by the Chief of Finance and Operations, therefore vendors should not accept orders for services or supplies without a valid purchase order.

The commission does not have any additional authority to enforce or interpret House Bill 1295.
