About this file

This is a Request for Bid (RFB) #3874 issued by the Eastern Municipal Water District (EMWD) for inventory spray marking paint. The solicitation seeks proposals for supply and delivery of spray marking paints in specified colors and sizes, with the bid due by 4:00 PM on 10/8/2025. The contract will be awarded for a 5-year period, with pricing remaining firm-fixed for the first year and one potential price adjustment considered annually thereafter. EMWD will use an electronic bidding process through their e-Procurement website, and all bids must be submitted electronically. The project timeline includes a bid review on 10/15/2025, supplier recommendation on 10/20/2025, and approximate contract start date of 11/15/2025.

The pricing terms allow for a potential annual price adjustment of up to 3%, substantiated by documentation from manufacturers or government agencies, and limited to factors such as supply price increases, governmental regulatory changes, or consumer/producer price index changes. EMWD has specific performance expectations, including an 80% on-time delivery rate and a 98% quality rate. The district reserves the right to purchase more or less of the product at the quoted price and will not accept minimum purchase requirements. The bid emphasizes the importance of quality, customer service, and accurate billing, with potential performance reviews and corrective actions for vendors who do not meet EMWD's standards.

Government Code Section 6250 provides that “access to information concerning the conduct of the people’s business is a fundamental and necessary right of every person in this state.” As such, all proposals and required submittal information may be subject to disclosure to the general public under the California Public Records Act, unless specifically identified as trade secret, proprietary, and/or confidential. In the event of litigation concerning the disclosure of information Proposer considers exempt (e.g., Trade Secret, Confidential, or Proprietary) EMWD shall act as a stakeholder only, holding the information until otherwise ordered by a court or other legal process. If EMWD is named in an action arising out of a California Public Records Act request for any information Proposer deems confidential, proprietary, or trade secret, Proposer shall defend at its own expense and indemnify EMWD, its officers, employees, and agents from
