The County of Reeves is not responsible for late deliveries of any kind or any reason.

Any changes in the specifications will be posted on the bonfire portal. It shall be the Vendor’s responsibility to check the portal prior to the opening date to verify whether any addendums have been posted.
Reeves County appreciates your time and effort in preparing a bid. The Purchasing Department must receive all proposals any time before opening date and time. Bids received after the deadline will not be considered for the contract, and shall be considered void and unacceptable.
Award of the proposals is tentatively scheduled for 9:00 a.m. (CST), in Commissioners’ Court, Monday, September 8, 2025, Third Floor Courtroom of the Reeves County Courthouse. You are invited to attend, but attendance is not required for award.
Successful proposer shall not order items or services until a Purchase Order is received from the County Purchasing Office. Payment will not be made on items delivered without a Purchase Order.
Payment shall be made through County funds after completion of goods or services are received.

Reeves County (the “County” or “Owner”) is requesting proposals for a Construction Manager at Risk (“CMAR” or “Contractor”), Two-Step Process (per Texas Government Code, Chapter 2269, Subchapter F) relating to its Waterpark (collectively the “Project”). The estimated budget for construction costs is approximately $48,000,000.
The Project is the construction of the Reeves County Waterpark. The architect is:

The Construction Manager-At-Risk proposal/selection process shall be governed by - and in accordance with - Chapter 2269 of the Texas Government Code, utilizing the two-step procurement process:
Conceptual drawing is for information only and attached to this RFP.
Scope of Services The Owner will contract directly with a CMAR for performing pre-construction services and general construction of the Project. The CMAR will then conduct the subcontractor selection/bidding and contract with all subcontractors required for the work pursuant to Texas Government Code §2269.255. The Owner reserves the right to contract separately with other suppliers, vendors, consultants and contractors as deemed in the best interest of the Owner’s Project. For construction work, this currently includes:
Independent testing and commissioning for acceptance of the Work, but not otherwise, including materials testing and inspection, HVAC testing and balancing, etc., as may be applicable for Owner’s acceptance of this Project.
The selected CMAR will provide a Guaranteed Maximum Price for the Project. The CMAR will be reimbursed for the cost of the Work plus a Fee.
The CMAR will participate in pre-construction services by providing input for scheduling, budgeting, development of documentation, inventory of existing materials, bidding of subcontractors, and construction of the Project and for “constructability” issues.
The CMAR shall publicly advertise and receive bids/Proposals from subcontractors for all portions of the work. Subcontractor bids or Proposals shall be reviewed and approved as set out in Texas Government Code §2269.255.
Payment and performance bonds will be required of the CMAR for 100% of the entire Project. The Owner will make all construction payments directly to the CMAR, for its distribution of payments to subcontractors and suppliers as appropriate.
Pre-Construction Services Fees, if any, are to be included but separated from the Construction Services Fee. Pre-Construction Services may include Scheduling, Budgeting and Cost Estimating as follows:
1. An estimate of construction cost based on preliminary construction documents and visual site visits.
2. A Project schedule identifying critical path and long lead items.
3. Continually monitor and maintain the construction portion of the Project budget. Provide substantially detailed estimates as an evaluative tool in the selection of design alternatives.
4. Provide cost saving analysis for system.
5. Evaluate quality, initial cost, maintenance and appropriateness.
6. Develop, monitor and maintain a Project schedule for bidding and construction.
7. Assess the availability of all building components in regard to the Project schedule.

8. Coordinate the bidding and issue of pre-purchase orders for long lead items, if required.
9. Make recommendations and provide references for manufacturers, suppliers and other subcontracts considered during design.
10. Review the Construction Documents during development and report to the Architect and Owner on constructability and coordination of the information presented. The CMAR is not responsible for the Architect’s quality control but is to identify areas in the documents requiring additional information or clarification.
11. If applicable, attend design meetings with the Architect, Architect’s consultants and Owner when requested.
12. Conduct a wage rate survey to be used during bidding to subcontractors. (Prevailing Wage Rates)
Construction Phase The CMAR shall be responsible for all general construction services for the project. Basic Services shall include all permitting, estimating, scheduling, administration and on-site management required for the successful construction of the Project.
Pursuant to Texas Government Code 2269.252.(b)(c)
The governmental entity's architect or engineer for a project, or an entity related to the governmental entity's architect or engineer, may not serve, alone or in combination with another person, as the construction manager-at-risk. This subsection does not prohibit the governmental entity's architect or engineer from providing customary construction phase services under the architect's or engineer's original professional service agreement in accordance with applicable licensing laws.
For purposes of Subsection (b), an entity is related to the governmental entity's architect or engineer if the entity is a sole proprietorship, corporation, partnership, limited liability company, or other entity that is a subsidiary, parent corporation, or partner or has any other relationship in which the governmental entity's architect or engineer has an ownership interest, or is subject to common ownership or control, or is party to an agreement by which it will receive any proceeds of the construction manager-at-risk's payments from the governmental entity.

Proposals shall address the following criteria and shall be weighted as indicated. Other information, if provided, shall be included as appendices at the back of the submitted qualification statement.

Indicate experience with publicly funded projects of same approximate size and type as the anticipated project.
Indicate safety record on previous projects.
Indicate whether Offeror has had construction contracts terminated prior to completion or whether a bonding company surety has had to pay funds under a bond of the Offeror.
Identify any previous working relationship with the Owner or Architect.
Indicate the exact legal name of Offeror, its type of legal organization, its State of organization, its mailing address, the office/business location of the Offeror from which the Project will be managed; and, address Offeror’s availability to the Project and the Owner and the response time.

Offeror have, within the last 5 years, been an officer, director, shareholder, partner, proprietor, or employee of another entity that has engaged in construction operations.

Step Two:
Do not provide the information required in Step Two in your proposal submitted in Step One. This information shall only be provided in Step Two of the selection process by firms that are short listed and interviewed. Short listed firms will be notified immediately after short list is compiled.
Provide any additional information you feel is pertinent to the project and selection process.
Pre-Construction Services Fees, if any, are to be included but separated from the Construction Services Fee.
Cost: (30 points, maximum)
Indicate the Offeror’s proposed fee for Construction Manager-at-Risk services and its estimated price for fulfilling the general conditions of the construction contract. The fee may be expressed as a percentage of the sub-contractor cost and the general conditions cost may be expressed as a stipulated sum on a monthly basis or as a lump sum. This is for informational purposes only and will be adjusted once actual costs are determined. An outline of general conditions cost to be used for estimating purposes will be provided to shortlisted firms. Identify any pre-construction phase fee.
Indicate any contingency cost you would include in your budget/guaranteed maximum price;
Indicate the pro-rata share of subsequently identified savings to be returned to the Owner.
Interview (10 points if applicable) Interviews of short-listed firms may be conducted at a date to be determined.
After evaluation of the proposals – within 7 days – the County will rank each set of proposals submitted in relation to the following criteria: Offeror’s experience, past performance, safety record, proposed personnel, methodology, availability, proximity to the Project, other such appropriate factors that demonstrate the Offeror’s capability to perform the services proposed, Offeror’s fee and estimated general conditions cost. The County will select the Offeror that submits the qualifications and costs that offer the best value based on this selection criteria. The County will first attempt to negotiate a contract with the selected Offeror, which, among other things, provides for a fixed contract amount or a guaranteed maximum cost. If the County is unable to negotiate a satisfactory contract with the selected Offeror, it will, formally and in writing, end negotiations with that Offeror and proceed to negotiate with the next Offeror in the order of the selection ranking until a contract is reached or negotiations with all ranked Offeror’s end.
The Construction Manager-At-Risk shall deliver performance and payment bonds – in amounts whose penal sums shall be equal to the Project Budget – executed with a surety company authorized to do business in the State of Texas not later than the 10th calendar day after the date the Construction Manager- At-Risk executes the contract or provides the guaranteed maximum price.
The Owner considers all information, documentation and other materials requested to be submitted in response to this solicitation to be of a non-confidential and/or non-proprietary nature and therefore shall be subject to public disclosure under the Texas Public Information Act after a contract is awarded.

CONFLICT OF INTEREST QUESTIONNAIRE

A complete copy of Chapter 176 of the Local Government Code may be found at http://www.statutes.legis.state.tx.us/ Docs/LG/htm/LG.176.htm. For easy reference, below are some of the sections cited on this form.
Local Government Code § 176.001(1-a): "Business relationship" means a connection between two or more parties based on commercial activity of one of the parties. The term does not include a connection based on:
(A) a transaction that is subject to rate or fee regulation by a federal, state, or local governmental entity or an agency of a federal, state, or local governmental entity;
(B) a transaction conducted at a price and subject to terms available to the public; or
(C) a purchase or lease of goods or services from a person that is chartered by a state or federal agency and that is subject to regular examination by, and reporting to, that agency.
Local Government Code § 176.003(a)(2)(A) and (B):
(a) A local government officer shall file a conflicts disclosure statement with respect to a vendor if:
(2) the vendor:
(A) has an employment or other business relationship with the local government officer or a family member of the officer that results in the officer or family member receiving taxable income, other than investment income, that exceeds $2,500 during the 12-month period preceding the date that the officer becomes aware that
(i) a contract between the local governmental entity and vendor has been executed;
or
(ii) the local governmental entity is considering entering into a contract with the vendor;

(3) has a family relationship with a local government officer of that local governmental entity.
(a-1) The completed conflict of interest questionnaire must be filed with the appropriate records administrator not later than the seventh business day after the later of:
(1) the date that the vendor:
(A) begins discussions or negotiations to enter into a contract with the local governmental entity; or
(B) submits to the local governmental entity an application, response to a request for proposals or bids, correspondence, or another writing related to a potential contract with the local governmental entity; or
(2) the date the vendor becomes aware:

PURCHASING CODE OF ETHICS
Public employment is a public trust. It is the policy of Reeves County to promote and balance the objective of protecting government integrity and the objective to facilitate the recruitment and retention of personnel needed by Reeves County. Such policy is implemented by prescribing essential standards of ethical conduct without creating unnecessary obstacles to entering public service.
Public employees must discharge their duties impartially to assure fair competitive access to County procurement by responsible contractors. In addition, public employees should conduct themselves in such a manner that fosters public confidence in the Reeves County procurement department. To achieve the purpose of the policy, it is essential that those doing business with the Reeves County purchasing office also observe the ethical standards prescribed here.
General Ethical Standards
1. It shall be a breach of ethics to attempt to realize personal gain through public employment with Reeves County by any conduct inconsistent with the proper discharge of the employee’s duties.
2. It shall be a breach of ethics to attempt to influence any public employee of Reeves County to breach the standards of ethical conduct set forth in this code.
3. It shall be a breach of ethics for any employee of Reeves County to participate directly or indirectly in a procurement when the employee knows that:
a. The employee or any member of the employee’s immediate family has financial interest pertaining to the procurement;
b. A business or organization in which the employee or any member of the employee’s immediate family, has financial interest pertaining to the procurement; or
c. Any other person, business or organization with whom the employee or any member of the employee’s immediate family is negotiating or has an arrangement concerning prospective employment is involved in the procurement.
4. Gratuities It shall be a breach of ethics to offer, give or agree to give any employee or former employee of Reeves County or to solicit, demand, accept or disagree to accept from another person, a gratuity or an offer of employment in connection with any decision, approval, disapproval, recommendation, and preparation of any part of a program requirement or purchase request. Influencing the content of any others in an advisory capacity in any proceeding or application, request for ruling, determination, claim or controversy, or other particular matter pertaining to any program requirement or a contract or subcontract, or to any solicitation or proposal pending before this government, shall also constitute a breach of ethics.
5. Kickbacks It shall be a breach of ethics for any payment, gratuity or offer of employment to be made by or on behalf of a subcontractor under a contract to the prime contractor or higher tier subcontractor for any contract for Reeves County, or any person associated therewith, as an inducement for the award of a subcontract or order.
6. Contract Clause The prohibition against gratuities and kickbacks prescribed above shall be conspicuously set forth in every contract and solicitation therefore.
7. It shall be a breach of ethics for any employee or former employee of Reeves County to knowingly use confidential information for actual or anticipated personal gain, or for the actual or anticipated gain of any person.

(B) a sport shooting range as defined by Section 250.001, Local Government Code.
(7) "Firearm trade association" means any person, corporation, unincorporated association, federation, business league, or business organization that:
(A) is not organized or operated for profit and for which none of its net earnings inures to the benefit of any private shareholder or individual;
(B) has two or more firearm entities as members; and
(C) is exempt from federal income taxation under Section 501(a), Internal Revenue
Code of 1986, as an organization described by Section 501(c) of that code.
(8) "Governmental entity" has the meaning assigned by Section 2251.001.
