13.4. The Owner may waive any informalities or reject any or all bids.
14. WITHDRAWAL OF BID DUE TO ERROR:
14.1. A Bidder for a public construction contract may withdraw his bid from consideration if the bid price was substantially lower than the other bids due solely to a mistake therein, provided the bid was submitted in good faith, and the mistake was a clerical mistake as opposed to a judgment mistake, and was actually due to an unintentional arithmetic error or an unintentional omission of a quantity or work, labor or material made directly in the compilation of a bid, which unintentional arithmetic error or unintentional omission can be clearly shown by objective evidence drawn from inspection of original work papers, documents and materials used in the preparation of the bid sought to be withdrawn. In accordance with Section 2.2-4330A (i) of the Code of Virginia, the Bidder shall give notice in writing of his claim of right to withdraw his bid within two (2) business days after the conclusion of the bid opening procedure and shall submit original work papers with such notice. Such mistake shall be proved only from the original work papers, documents and materials delivered as required herein.
14.2. No bid may be withdrawn under this section when the result would be the awarding of the contract on another bid of the same bidder or of another Bidder in which the ownership of the withdrawing Bidder is more than five percent (5%).
14.3. If a bid is withdrawn under the authority of this section, the lowest remaining bid shall be deemed to be the low bid.
14.4. No Bidder who is permitted to withdraw a bid shall, for compensation, supply any material or labor to or perform any subcontract or other work agreement for the person or firm to whom the contract is awarded or otherwise benefit, directly or indirectly, from the performance of the project for which the withdrawn bid was submitted.
14.5. If the Purchasing Agent denies the withdrawal of a bid under the provisions of this section, she shall notify the bidder in writing stating the reasons for her decision and award the contract to such bidder at the bid price, provided such bidder is responsible and responsive bidder.
15. REJECTION OF BIDS:
The Owner reserves the right to cancel the invitation for bids or to reject any and all bids when such rejection is in the interest of the Owner, and to reject the bid of a bidder who is not in a position to perform the contract. [See Section 2.2-4319, Code of Virginia (1950). The Owner reserves the right to reject any bid if evidence submitted by, or investigation of, any Bidder fails to satisfy the Owner that the Bidder is properly qualified to carry out the obligations of the contract to complete the work contemplated.
16. EVALUATION AND AWARD:
Bid Prices: The Owner shall pay and the Contractor shall receive the unit prices stipulated in the Contractor's Proposal hereto attached as full compensation for everything furnished and completed by the Contractor, based on the quantities completed in an acceptable manner, which sum shall be paid in the manner and terms specified in the Contract Documents.
Award: The County will make the award to the lowest responsive and responsible Bidder on the basis of the lowest Bid Total price.
Award of the Base Bid will be made to the lowest responsive, responsible bidder.
The County reserves the right to conduct any test it may deem advisable and to make all evaluations.
The County also reserves the right to reject any or all bids, in whole or in part, to waive informalities and to delete items prior to making the award, whenever it is deemed in the sole opinion of the County to be in its best interest. Bidders are advised that contract award requires the approval of the County Board of Supervisors, the Federal Aviation Administration, and the Virginia Department of Aviation.
16.1 NEGOTIATION WITH THE LOWEST BIDDER:
Unless all bids are cancelled or rejected, the County reserves the right granted by § 2.2-4318 of the Code of Virginia to negotiate with the lowest responsive, responsible bidder to obtain a contract price within the funds available to the agency whenever such low bid exceeds the County’s available funds. For the purpose of determining when such negotiations may take place, the term “available funds” shall mean those funds which were budgeted by the County for this contract prior to the issuance of the written Invitation for Bids. Negotiations with the low bidder may include both modifications of the bid price and the Scope of Work/Specifications to be performed. The agency shall initiate such negotiations by written notice to the lowest responsive, responsible bidder that its bid exceeds the available funds and that the agency wishes to negotiate a lower contract price. The times, places, and manner of negotiating shall be agreed to by the County and the lowest responsive, responsible bidder.
17. CONTRACTOR REGISTRATION:
If a contract for construction, removal, repair or improvement of a building or other real property is for one hundred and twenty thousand dollars ($120,000) or more, or if the total value of all such contracts undertaken by bidder within any twelve-month period is seven hundred fifty thousand dollars ($750,000) or more, the bidder is required under Title 54.1-1100, Code of Virginia (1950), as amended, to be licensed by the State Board of Contractors as a “CLASS A CONTRACTOR.” The Bidder shall place on the outside of the envelope containing the bid, and shall place in the Bid Form above his signature, whichever of the following notations, if appropriate, inserting his contractor license number
Licensed Class A Virginia Contractor No.___________________, Specialty: ______________
If the Bidder shall fail to provide this information on his bid or on the envelope containing the bid and shall fail to promptly provide said contractor license number to the County in writing when requested to do so before or after the opening of bids, he shall be deemed to be in violation of Section 54.1- 1115 of the Code of Virginia (1950), as amended, and his bid will not be considered.
If a Bidder shall fail to obtain the required license prior to submission of his bid, the bid shall not be considered.
18. QUALIFICATIONS OF BIDDER:
The county reserves the right to reject any bid if evidence submitted by, or investigation of, any bidder fails to satisfy the County that the Bidder is properly qualified to carry out the obligations of the contract to complete the work anticipated.
19. SCC REGISTRATION REQUIREMENTS:

The FLSA sets minimum wage, overtime pay, recordkeeping, and child labor standards for full and part-time workers.
The Contractor has full responsibility to monitor compliance to the referenced statute or regulation.
The Contractor must address any claims or disputes that arise from this requirement directly with the U.S. Department of Labor – Wage and Hour Division.
Federal Trade Restriction Certification:
By submission of an offer, the Offeror certifies that with respect to this solicitation and any resultant contract, the Offeror –
1) is not owned or controlled by one or more citizens of a foreign country included in the list of countries that discriminate against U.S. firms as published by the Office of the United States Trade Representative (USTR);
2) has not knowingly entered into any contract or subcontract for this project with a person that is a citizen or national of a foreign country included on the list of countries that discriminate against U.S. firms as published by the USTR; and
3) has not entered into any subcontract for any product to be used on the Federal project that is produced in a foreign country included on the list of countries that discriminate against U.S.

The Contractor must require subcontractors provide immediate written notice to the Contractor if at any time it learns that its certification was erroneous by reason of changed circumstances.
Unless the restrictions of this clause are waived by the Secretary of Transportation in accordance with 49 CFR § 30.17, no contract shall be awarded to an Offeror or subcontractor:
