4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited: Fleming and Associates is the Original Equipment Manufacturer (OEM) and has proprietary rights to the AF36 026 software. Currently the T55 master first stage nozzle segment that is being used on the Fleming Airflow machine set up shows that the master is out of tolerance requiring update and calibration. The Air Flow Measurement System supports the T-700, T-401, T-55 and the T-53 engine programs. Engine production could not build or test these power plants if the Air Flow Measurement System is not operational. After a thorough market research was performed, it has been determined that no other vendor is capable of performing the required update and calibration of the Air Flow Machines T master 1st stage nozzle segment. Due to Flemings and Associates, direct knowledge and proprietary rights to the equipment software this item has been sole sourced. An attempt has been made via online search engines to find additional authorized repair provided for the Fleming air Flow Machines and other equipment via google and Bing but none were found.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the dollar threshold.
7. Market Research: The Government conducted market research via online Search platform via Google and Bing, and determined that the Fleming Air Flow Machine can be purchased commercially via http://www.flemingairflow.com/measurement-systems.html. The Government had a previous sole source contract for PM Services on Purchase Order W912NW-18-P-0046 with the same contractor Fleming and Associates Calibrations INC, Cage Code (0ADV1) a small business concern. The Air Flow machine requires routine preventive maintenance and calibration on a recurring and basis in order to meet mission essential goals. During this PM and calibration it was determined that Update and Repair to Airflow System was required for continued usage and Fleming and Associates is the only authorized vendor that can perform this repair. Also due to Fleming and Associates discovering the issue during their PM Service on their equipment this gives, Fleming and Associates direct knowledge and ability to meet the Governments need because they are the OEM.

Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
