Statement of Work (SOW)

1. BACKGROUND

The elimination of agricultural quarantine material to include regulated garbage defined under 7 CFR 330.400 and 9 CFR 94.5 intercepted at the Area Port of San Francisco.

2. SCOPE

The vendor will ensure that all regulated garbage will be collected, treated and destroyed in accordance with an APHIS approved compliance agreement for the handling of regulated garbage. The compliance agreement must cover the regulated garbage handling activities for a Storage/Transfer Station, Hauler/Cartage Firm, and a Processor.

4. CBP REQUIREMENTS / TASKS

4.1 CBP will request pickup and transport of regulated material no less than 24 hours in advance.

4.2 Customs and Border Protection will package regulated material in 3 mil leak-proof plastic bags sealed with yellow quarantine labeled tape for deposit into containers supplied by the vendor.

4.3 Initial testing and re-testing every 6 months of the sterilizer or non-pressurized water cooker will be monitored by an employee of CBP/AHIS.

4.4 An employee of CBP/AHIS will monitor the recalibration of the sterilizer or non-pressurized cooking equipment after major repairs or malfunction.

4.5 An employee from CBP/AHIS will monitor the following records:

4.5.1 Records for regulated garbage which will include the origin, approved carrier name, date, time, number of units (bags, bins, containers) and quantity of garbage (weight) transported and disposed of, and the name of

4.5.2 Records for spills including the date, location, and amounts and concentrations of disinfectants used during a specified reporting period.

4.5.3 Calibration, malfunction and repairs records for the sterilizer or non-pressurized water cookers.

4.5.4 Training records.

5. VENDOR REQUIREMENTS / TASKS

5.1 The vendor shall supply one 4 cubic yard dumpster/Front Load Cooker Box (marked with REGULATED GARBAGE) to the collection facility.

5.2 The vendor is responsible for emptying the agricultural quarantine materials from the 4 cubic yard dumpster and transporting them to their processing facility for destruction via steam sterilization.

5.3 Regulated garbage pickup is normally scheduled by CBP every 7 to 10 days. If the vendor is unable to pick up or transport regulated garbage, the local CBP office must be notified immediately at 650-877-4004.

5.4 The vendor must place the regulated garbage into containers that are leak-proof and securely closed. The containers must be inaccessible to birds, rodents, and other vermin.

5.5 The garbage must be clearly indicated so that it can be identified as regulated garbage. The shipping or handling containers are permanently marked with conspicuous 2-inch to 4-inch-high lettering that reads “REGULATED GARBAGE”.

5.6 The handling containers must be put into an enclosed, rigid, leak-proof vehicle. A canvas top or tarp covering is unacceptable. Since the vehicle will move through rural areas, the doors must be secured by a seal, lock, or similar device.

5.7 The vendor manipulates, handles, or stores regulated garbage in a manner approved by the local CBP office and in a designated area before transporting the treated garbage for disposal in an approved landfill.

5.8 The container used for regulated garbage shall not be used for domestic garbage, nor shall containers used for domestic garbage be used for regulated garbage. The truck/container to be used for a purpose other than hauling foreign garbage must have markings obliterated and be disinfected with APHIS approved disinfectant under CBP supervision before the truck/container can be repurposed.

5.9 The vendor will ensure that all regulated garbage is kept completely separated from

The cartage firm must have previously arranged for immediate, priority sterilization at the destination, unless otherwise approved by the local APHIS, Agriculture Quarantine Inspector (AQI), or Veterinary Medical Officer (VMO). Regulated garbage will be processed by an approved steam sterilizer facility.

5.10 The vehicle transporting the garbage shall take a direct or expedient route approved by APHIS/CBP and included as addenda in the vendor’s compliance agreement. The closest available approved incinerator or cooker/sterilizer should be used unless otherwise approved by CBP/APHIS.

5.11 To facilitate monitoring, the vendor must provide the following:

5.11.1 Records which will include the origin, approved carrier name, date, time, number of units (bags, bins, containers) and quantity of garbage (weight) transported and disposed of, and the name of the vehicle’s driver. The records must be retained for a minimum of one (1) year from the end of the month in which the transport occurred.

5.11.2 Assurance that these records can be used to validate the inventory control system at the point of origin.

5.12 To store regulated garbage, the following conditions must be met:

5.12.1 Material to be stored must be adequately containerized and marked (per

Sections 5.4 and 5.5). Storage of regulated garbage must not exceed 48 hours without prior approval from PPQ VRS or CBP.

5.12.2 Storage of regulated garbage in plastic bags must be inside a closed building; if outside storage, garbage must be in sealed, 3 mil plastic bags in a container with tight-fitting lid.

5.12.3 The container, storage room, or other confined area where the regulated material is to be stored, must be leak-proof and capable of being locked.

The material must be inaccessible to birds, rodents and other vermin.

5.12.4 The dock area and the area around the storage facility compactors, and/or dumpster shall be kept clean and free of loose garbage at all times.

Compactor and dumpster leakage shall be contained in a manner acceptable to CBP/AHIS.

5.12.5 The cartage firm must conspicuously post regulated garbage handling procedures in the work area and other areas that all employees have access

to. The procedures must be in English and other appropriate languages.

5.13 Spills and Disinfection

5.13.1 The cartage firm must provide personnel, equipment, and disinfectant to control the regulated material in the event of a spill or other emergency.

There must be an adequate supply of APHIS-approved disinfectant on each vehicle in order to clean and disinfect spills. A log or record book containing information on the spills, and amounts and concentrations of disinfectants used will be provided in order to fulfill APHIS, CBP, and EPA reporting requirements.

5.13.2 Reporting requirements include:

5.13.2.1 The number of disinfection treatments performed (including by designation – routine surface disinfections and cleaning of spills).

5.13.2.2 If applicable, the number of pounds of sodium carbonate used (with or without sodium silicate).

5.13.2.3 If applicable, the concentration of bleach (stated as a percentage) and the number of gallons of concentration of bleach used.

5.13.2.4 The date and location of the spill(s).

5.13.2.5 The record or logbook should be kept for three (3) years.

5.13.2.6 Information on spills and the amounts and concentrations of disinfectants used to treat them during a specified reporting period must be provided to CBP/APHIS upon request.

5.13.3 If spillage occurs during the cartage process, CBP must be notified immediately. The vendor must contact the CBP agricultural compliance office at 650-877-4004.

5.13.4 APHIS approved disinfectant is not to be used in enclosed food handling areas. Only EPA approved sanitizers should be used in food handling areas.

Records of instances will be maintained.

5.14 Processing Equipment

5.14.1 Equipment for steam sterilization or non-pressurized water cooking is used.

For a water cooker, the water level must reach within three (3) inches of the garbage level.

5.14.2 The sterilizer or non-pressurized water cooker must be capable of heating regulated garbage to a minimum internal temperature of 212°F and maintaining the temperature for 30 minutes. To achieve this, the sterilizer or

5.14.3 A thermocouple probe will be used initially and every six months to recalibrate the temperature recording device and to adjust the sterilization cycle to assure that the garbage is heated to a minimum internal temperature of 212°F for at least 30 minutes. The test load shall be at the maximum capacity of the sterilizer and of typical composition for the location. Tests will be monitored by an employee of CBP/APHIS. The facility will supply the calibration equipment needed to perform the re-calibrations. The adjusted calibrations will be included in an addendum to the compliance agreement and will be posted at/on the sterilizer.

5.14.4 The time and temperature record of each batch of regulated garbage shall be dated and initialed by the sterilizer operator and signed by the supervisor.

The records must be retained for a minimum of one (1) year from the end of the month in which the processing occurred.

5.14.5 The bottom rear drain of the sterilizer unit will be cleared as needed to assure proper steam circulation and drainage.

5.14.6 If the sterilizer, cooker or associated equipment (such as the time and temperature recorder) malfunctions, immediately report the malfunction to the local CBP AIP office at (650) 877-4004. The equipment shall be properly maintained to ensure that each load of regulated garbage is processed at an internal temperature of 212°F for a minimum of 30 minutes.

5.14.7 The sterilizer or non-pressurized cooking equipment must be recalibrated after major repairs or malfunction.

5.15 Training

5.15.1 Vendor shall present a training program to CBP which must be included as an addendum in their APHIS-approved regulated garbage compliance agreement.

5.15.2 Training program must be approved by APHIS, the local CBP Port Director, or his/her designee, and may include both formal classroom training and on-the-job training.

5.15.3 Training program should be of sufficient duration to adequately provide the minimum required information.

5.15.4 Vendor shall present training to employees before they are permitted to handle or supervise the handling of regulated garbage.

5.15.5 All previously trained employees shall be provided review training annually

(this training may be given in more than one session).

5.15.6 Training program shall include but is not limited to:

5.15.6.1 Definition of regulated garbage.

5.15.6.2 Explanation and purpose of the regulations.

5.15.6.3 Inclusion of film, slides, or other training aids on foreign animal, plant diseases and pests.

5.15.6.4 A specific training outline – by demonstration, illustration photographs, etc. of proper regulated garbage-handling procedures for the facility, a written step-by-step protocol for reporting and handling emergency spills, maintaining control of regulated materials, and the cleaning and disinfecting of affected areas and equipment.

5.15.7 Training shall be presented in English as well as any other appropriate languages.

5.15.8 Training records must be retained for a minimum of one (1) calendar year from the end of the month in which the training occurred. Biannual audits will be conducted.

6. DELIVERY OF SERVICES

6.1 Frequency of regulated garbage pickups is estimated at approximately two per month.

6.2 Additional pickups may be necessary dependent upon operational tempo and the amount of regulated material collected.

6.3 Estimated regulated garbage destruction services required pursuant to each year of the

7. GOVERNMENT-FURNISHED EQUIPMENT AND INFORMATION

7.1 The government does not anticipate providing any GFE or GFI.

8. VENDOR FURNISHED EQUIPMENT

8.1. Vendor is responsible for providing all equipment and supplies necessary to perform the requirements outlined in this SOW.

9. PLACE OF PERFORMANCE

9.1 Collection Facility:

10. TAX / INVOICING INFORMATION

10.1. Federal Tax-Exempt ID: 72-0408780.

10.2. Invoicing shall be accomplished in the Invoice Processing Platform (IPP) and in accordance with the resultant order.

11. CONTRCT TYPE / VALUATION

11.1. The government is contemplating a Firm Fixed Price (Fixed Unit Price) single-award

IDIQ utilizing one (1) 12-month base year + four (4) 12-month option years.

11.2. Minimum Amount, Initial Order: $1,000.00.

11.3. Minimum Amount, Subsequent Orders: $100.00.

11.4. Maximum Amount, Any Single Order: $60,000.00.

11.5. IDIQ Contract Ceiling (Not-to-Exceed Amount): $245,000.00.

12. ORDERING PERIODS / PERIODS OF PERFORMANCE (ESTIMATED)

12.1. Base Year of IDIQ: May 1, 2021 – April 30, 2022.

12.2. Option Year 1 of IDIQ: May 1, 2022 – April 30, 2023.

12.3. Option Year 2 of IDIQ: May 1, 2023 – April 30, 2024.

12.4. Option Year 3 of IDIQ: May 1, 2024 – April 30, 2025.

12.5. Option Year 4 of IDIQ: May 1, 2025 – April 30, 2026.

13. SPECIAL CONSIDERATIONS

13.1. Travel on the part of the vendor is necessary to support the requirements identified in this SOW.

14. SECURITY

14.1. Contractor personnel shall comply with all rules and regulations governing conduct of personnel while operating on U.S. Government property.

14.2. Contractor personnel shall not enter any area which access is restricted, unless specifically authorized in writing by the Unit Supervisor.

15. CHANGES TO THE SOW

15.1. No changes to this SOW or cost adjustments shall be incurred without written prior approval of the Contracting Officer (CO).

15.2. Any changes or cost adjustments shall not take effect until the CO executes a written modification.

15.3. The CO is the only individual with authority to amend a contract.
