About this file

This is a Justification for Urgency form for a simplified acquisition under the threshold of $15,000 to SAT (Simplified Acquisition Threshold). The procurement action N62758-6022-D800 seeks to procure two (2) electric actuators for damper valves, Model MS12Q manufactured by NUTORQUE, required by 9/1/26.

The justification establishes urgency based on fire damage sustained by USS NEW ORLEANS that caused significant damage to ventilation components. During attempted installation on 1/7/26, materials from the Navy Supply system were found to be incompatible with the ship's onboard systems, necessitating the specific NUTORQUE Model MS12Q actuator. The material is critical to restore remote operation of the Halon Fire Protection system serving the flammable liquid storeroom. Failure to restore this system by the Required Delivery Date will limit ship operations due to the inability to store flammable liquids in the designated storeroom. The procurement is classified as a limited or one-source acquisition because the electric actuator must meet the same form, fit, and function as specified in ship drawing requirements and serve as an operator for installed Titanium Valves (Bray Valve) per ship alteration SCD 81157. The Contracting Officer, Wilfredo J. Gervacio, certified on 02/18/2025 that only one source is reasonably available for this urgent procurement action under FAR 13.106-1(a) and FAR 13.106-1(b).

JUSTIFICATION FOR URGENCY (Simplified Acquisitions)

References: FAR 5.101(a)(2), FAR 13.106 and DON SAP Guide

PART I - Urgency (Precluding Synopsizing)

Threshold: $15,000 to SAT N62758-6022-D800

[document number] is urgent and advertising requirements are precluded for reasons indicated below.

1. Brief descriptive narrative of service or material required:

2. Required Delivery Date (RDD):

NOTE: If the service/material is not received by the Required Delivery Date (RDD), identify the specific damages that will result to the Navy in item #4.

3. Why is this procurement urgent? NOTE: Answer the following in the space below: WHAT happened? WHEN did it happen? WHEN did you notify Contracting; IS there long lead time material (if YES note the LEAD TIME below)?

4. Describe the resulting damages if the above required delivery date is not met. Explain why the service/material is needed and what will happen if it's not received by the RDD. (As necessary, describe the impact on overhaul/ availability schedules, impact to base support, personnel safety issues, potential environmental damages, etc.) The impact should be expressed as the daily cost (labor, material, etc.) to the government for each day of delay beyond the RDD.

5. Only our minimum current requirements can be purchased under conditions of urgency. What is the minimum quantity that must be obtained by the RDD? Why can't some of the total required quantity be procured under urgency while procuring the remaining items/services through the normal procurement process?

9/1/26

The service or material listed on

Electric actuator for damper valve, NUTORQUE Model MS12Q

Fire damage onboard USS NEW ORLEANS caused significant damage to ventilation components. During attempted installation on 1/7/26, it was noted that material from Supply system did not match onboard systems and therefor, NUTORQUE Model is required.

Material is required to restore remote operation to the Halon Fire Protection (HFP) system for the flammable liquid storeroom onboard USS New Orleans. Failure to restore the HFP system will limit operation due to inability to store flammable liquids in the designated storeroom.
