SOLE SOURCE JUSTIFICATION: SIMPLIFIED PROCEDURES FOR CERTAIN
COMMERCIAL ITEMS EXCEEDING SAT, INCLUDING BRAND NAME
7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer determines that the anticipated price(s) will be fair and reasonable based on acquisition history from previous purchases of the same/similar requirement, published catalog pricing, and pricing provided to other Government entities.
8. Description of market research.
Market research was conducted by HSI C3 and the Contracting Officer between April 2023 and May 2023. This requirement was acquired last year, FY22, on purchase order 70CMSD22P00000127 as a sole source from Swarm Technologies, Inc.
A notice of intent to sole source was published on SAM on May 24, 2023. An interested party responded with ten (10) potential alternatives. HSI research of other products nominally identified as having similar capabilities were deemed to not meet the government’s requirement based on a variety of reasons including that such products were largely focused on network defense rather than mantinaining an aggregate of .
9. Any other facts supporting the justification.

10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.
An intent to sole source was posted on SAM.gov on May 24, 2023. One party expressed interest in the requirement, and its possible alternatives were reviewed by HSI C3. HSI research of other products nominally identified as having similar capabilities were deemed to not meet the government’s requirement.
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for supplies or services required.
HSI C3 will continue to monitor the market for new entrants and products into the field that can meet the requirements.
12. DHS intends to post the requirement pursuant to FAR 13.501(a)(1)(iii) and 6.305(a).
