About this file
This is a Limited-Sources Justification (LSJ) document from the U.S. Immigration and Customs Enforcement (ICE) Office of Acquisition Management. ICE proposes to award a new Firm-Fixed Price (FFP) Delivery Order to Whelen Engineering Company for 31 portable retrofit kits (Whelen ATLAS1 Adaptable Travel Light & Siren Kit) to support a surge operation at the HSI Special Agent in Charge (SAC) St. Paul. The urgent procurement is justified by the time-sensitive need to make vehicles immediately operational and compliant with law enforcement requirements, with the kits providing operational flexibility and cost efficiency by being portable and reusable for future surge operations where permanently retrofitted vehicles may not be available.
The justification is authorized under FAR 8.4 using the Multiple-Award Schedule Program, with the specific authority being an urgent and compelling need that would result in unacceptable delays if standard procedures were followed. The procurement addresses a critical operational gap, as the vehicles were deployed prior to permanent retrofitting and currently lack necessary emergency lights and sirens. The document indicates the order will support law enforcement officer safety and public safety by quickly providing the required vehicle equipment for the current operational mission.

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), Office of Acquisition Management (OAQ), on behalf of the Domestic Operations Division, proposes to award an order or BPA pursuant to FAR 8.4 Ordering under Federal Supply Schedule and subpart 538.71 Federal Supply Schedule Ordering Procedures.
2. Nature and/or description of the action being approved.
(a) Type of action: New, Firm-Fixed Price (FFP) Delivery Order
(b) Amount the current J&A is justifying: $
(c) Brief Description: OAQ intends to procure, on a sole source basis, portable retrofit kits to allow vehicles to be immediately operational and compliant with law enforcement requirements to support the current surge operation at HSI Special Agent in Charge (SAC) St Paul.
Whelen Engineering Company, Inc.
51 Winthrop Road Chester, CT 06412-1036
3. A description of supplies/services required to meet the agency’s need, including the estimated total value (base and all options).
The requirement is to provide portable retrofit kits to allow vehicles to be immediately operational and compliant with law enforcement requirements to support the current surge operation at HSI SAC St Paul. Due to the time-sensitive nature of the mission, waiting for permanent retrofitting is not feasible and would negatively impact operational readiness, law enforcement officer safety, and public safety. These vehicles were deployed prior to being permanently retrofitted and currently lack the necessary emergency lights and sirens required for operational use. Additionally, the kits are portable and reusable, allowing them to be redeployed for future surge operations in other locations where permanently retrofitted vehicles may not be available. This provides both operational flexibility and cost efficiency.

4. The authority and supporting rationale and a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
Authority:
Choose only one of the following three authorities:
(A) An urgent and compelling need exists, and following the procedures would result in unacceptable delays;
(B) Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
(C) In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
Rationale:
The requirement is to provide portable retrofit kits to allow vehicles to be immediately operational and compliant with law enforcement requirements to support the current surge operation at HSI SAC St Paul. Due to the time-sensitive nature of the mission, waiting for permanent retrofitting is not feasible and would negatively impact operational readiness, law enforcement officer safety, and public safety.
