Limited-Sources Justification (LSJ) For orders or BPAs exceeding the Simplified Acquisition Threshold

This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C. 152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity.
The Federal Emergency Management Agency (FEMA), Office of Chief Component Procurement Officer (OCCPO) prepared this justification to issue a modification to a call order pursuant to FAR 8.405-6(a), Limiting Sources.
2. Nature and/or description of the action being approved.
FEMA OCCPO intends to modify a contract awarded to Ranger Land Systems Inc., at 2707 Artie Street Bld 100, Suite 17, Huntsville, AL 35805. The modification is to procure 200 additional beds and associated wrap around services for the 250 Responder Sheltering Units (RSU) located at MSY Airport, 600 Rental Blvd, Kenner, LA 70062.
This action will support FEMA’s mission in Hurricane Ida recovery efforts in the State of Louisiana with turn-key RSUs to house FEMA and FEMA-approved responders. RSUs are sleeping units containing beds, showers, toilets, and sinks. This action will increase the beds from 250 to 450. Once activated the beds will be used to create additional lodging capacity inclusive of wrap-around services.
3. Description of Supplies/Services required to meet the Agency’s Needs (including estimated value).
This requirement is to provide an additional 200 RSU beds for FEMA and FEMA-approved responders at FEMA’s designated site in New Orleans, LA and associated wrap around services. The services also include additional external showers, restrooms, and sinks, Operational services such as ablution, waste water and waste and dumping services, and Support services such as wash and fold laundry, janitorial, equipment, staff, and catering services. The estimated value of the contract will increase from $67,895,104.33 by $11,792,982.31 to $79,688,086.64, which includes options.
4. Authority and supporting rationale.
8.405-6(a)(1)(i)(A) An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays.
FEMA has an urgent and compelling need to modify the RSU call order to increase the quantity of beds and associated wrap around services and call order ceiling to respond to Hurricane Ida. This action will permit FEMA to house additional FEMA and FEMA-approved responders. FEMA must be prepared to respond to the changing needs of Hurricane Ida and disasters of any size, at any given time, and in many cases with limited

FEMA awarded this Call order based on the needs at the time the award was established, but the situation is fluid and additional beds are now required. The increase in demand of hotels and other housing options in the area have caused a shortage of available housing for responders. It is essential that FEMA provides as many housing units to responders as it can in a quick timeframe to assist with disaster efforts. If the quantity and ceiling are not increased immediately, FEMA estimates a delay of obtaining those services, which would impact FEMA’s ability to assist states, tribes, territories, and local governments in responding to Hurricane Ida. Failure to modify this contract under this urgent and compelling justification could also lead to additional loss of life as responders, who are located closest to the highly impacted areas, can more efficiently assist in the restoration of services and a reduction in the risk to loss of life.
5. Determination by the ordering activity contracting officer that the anticipated order represents the best value consistent with FAR 8.404(d).
The contracting officer has determined that issuing the proposed modification to Ranger Land Systems, Inc. for additional quantities of beds represents the best value and will result in the lowest overall cost, considering price and administrative costs, to meet the Government’s needs. The General Services Administration (GSA) has already negotiated fair and reasonable pricing rates. Discounts to these GSA schedule rates will be requested.
6. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Market research was conducted on August 22, 2021. Based on that research, these services are mandated for procurement under DHS’ Directive for Strategic Source Vehicles. These services cannot be procured from other sources without an appropriate waiver or exception.
7. Any other facts supporting the limited-sources justification.
None.
8. A statement of actions, if any, the agency may take to remove or overcome any barriers that led to restricted consideration (i.e., limited-sources) before any subsequent acquisition for the supplies or services is made. Include a statement of actions taken or that will be taken to increase competition for future acquisitions of the same item/service (e.g., the government intends to revise overly restrictive technical specifications, acquire data rights, or pursue some other means to increase future competition).
All future orders will be competed between the two BPA holders under the DHS Strategic Source Vehicle for these type of services to create competition at the call order level in accordance with FAR Part 8 procedures for placing orders against multiple award blanket purchase agreements.

9. FEMA intends to post this requirement on SAM.gov pursuant to FAR 8.405-6(a)(2)(i).
10. Technical/Requirements Personnel Certification.
Pursuant to FAR 8.405-6(c)(2)(x), I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Limited-Sources Justification, are accurate and complete.
