1. Agency and Contracting Activity.

The Department of Homeland Security, U.S. Immigration and Customs Enforcement, Office of Acquisition Management, proposes to enter into a contract on behalf of Homeland Security Investigations (HSI) SAC Los Angeles on a basis of other than full and open competition.

2. Nature and/or description of the item/service being procured and anticipated cost.

(a) Type of action: Firm Fixed Price, Sole Source Award

(b) Amount the current J&A is justifying (must be $250,000 or less): $120,500.00

(c) Brief Description: OAQ intends to procure, on a sole source basis, construction of a firearms program shoothouse. The vendor listed below is the only company that can provide the required services.

Rationale:

This requirement is a follow-on requirement to a previous developed shoothouse for another federal law enforcement and partner agency. Market research indicates that Strong Builders was the only vendor that could construct the shoothouse in a time frame

that was ameneable to the HSI SAC Los Angeles Special Response Team (SRT) training schedule, whereby minimal interruptions to training would occur by which the facility in which the shoothouse is constructed would be unusable for a certain time period. If the training schedule accommodation is not met, then performance of SRT team core competencies such as tactical movements & breaching, will be negatively impacted.

4. The anticipated price will be determined fair and reasonable based on one or more of the price analysis techniques described below in accordance with FAR Part 13.106- 3(a)(2). (Check one and provide short description of action taken.)

The pricing was determined fair and reasonable based upon estimates received from other construction builders. Additional research included a review of a previous contract from a partner federal law enforcement agency.
