J&A No. J21-010

SOURCE SELECTION INFORMATION IAW FAR 2.101 AND FAR 3.104

5. Rationale Justifying Use of Cited Statutory Authority. The rationale for the use of FAR 6.302-1(a)(2) is that award to any other source would result in unacceptable delays (i.e. lapse in service) in fulfilling the agency’s requirement.

Multiple factors caused delays in the solicitation and timely award of the follow-on contract.

During preparation of the follow-on contract solicitation, the contracting activity discovered that USTRANSCOM had revised their requirements package templates. Following discussions with the JPPSO-SE office, updated documents were received by the contracting activity in March 2021. Following these changes and after receipt of the requirement, the contracting activity discovered the use of incorrect units of issue and quantities in the Independent Government Estimate (IGE). After recalculating using the correct units of issue and quantities in accordance with the newly updated USTRANSCOM templates, the IGE increased significantly, changing the required timeline for solicitation and award of the contract.

Due to a pressurized timeline, a bridge action is necessary. The bridge action will allow the contracting office and the customer to conform to the updated USTRANSCOM templates, incorporate these requirements in the follow-on solicitation, advertise the procurement, evaluate proposals, award to the best value Offeror, and complete contract transition to ensure proper fulfillment of future household goods requirements.

The incumbent, American Safety Movers, Inc., has been performing household goods shipment services at Naval Air Station Jacksonville and the surrounding areas under competitively awarded contract N6883617D0001. That contract expires on 31 May 2021. The bridge contract is required to continue providing household goods shipment services while a new competitive contract is solicited and awarded. For the following reasons, American Safety Movers, Inc. is the only service provider that can meet the Navy’s requirement: (1) American Safety Movers, Inc. has all personnel and resources in place to support this bridge action while a new contract is awarded; (2) There is not enough time to solicit proposals for at least 30 days to allow Offerors to propose on requirements; (3) Time is needed to evaluate proposals and, if needed, hold discussions with Offerors, and make a best value determination; (4) Once the awardee is selected there is a minimum 5-day period required by FAR 19.302(d)(1)(i) to allow for protests of the small business representation; and (5) The awardee will require lead/transition time to process administrative and employee requirements and organize equipment and materials. There is not sufficient time to perform these actions to meet a 1 June 2021 start date.

Award to another contractor would be disruptive, result in substantial duplication of cost and unacceptable delays in fulfilling the agency’s mission critical requirements as well as increase operational risk. The operational risk includes inability to process 170 projected household goods moves over a 120-180 day period. Without the bridge contract in place, there will be no means in place for the preparation of personal property of Department of Defense (DoD) military personnel for shipment, drayage and/or storage related to Permanent Change of Station (PCS)/Temporary Duty (TDY)/Temporary Additional Duty (TAD), retirement, separation and housing orders to and from Jacksonville, FL and surrounding areas. As the DoD has no in-house resources to accomplish these services, a break-in-service will occur. The inability to move personnel will be detrimental to the Department of the Navy. Moving military members between

military bases and fulfilling manning requirements is essential to the mission and Command capabilities.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

During market research for the follow-on contract to N6883617D0001, twelve (12) businesses were identified using (but not limited to) the Small Business Administration (SBA) Dynamic Small Business Search (DSBS), System for Award Management (SAM), and a query of Government records (previous contracts, recent market research, etc.). A sources sought notice was uploaded to BetaSam.gov on 11 March 2021 to announce the anticipated requirement, and to seek interested and capable business sources. Additionally, the notice was e-mailed to potential contractors found using the searches above. As a result of that notice, responses were received from six (6) small business concerns. Based on the market research there is a reasonable expectation that the Government will receive competitive quotes from at least two responsible small business concerns per FAR 19.502(b). It is expected that a competitive solicitation will be published no later than 14 July 2021. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than American Safety Movers, Inc. to provide the required services under the bridge contract action.

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition. The follow-on requirement will be solicited as a small business set-aside (Full and Open Competition after exclusions of sources) using best value tradeoff procedures. The Government intends to make a competitive award decision no later than September 2021, to the responsible Offeror, whose conformance to the solicitation is most advantageous to the Government, with price and other factors considered.
