As can be observed in the table above, AML Oceanographic is the only known company able to provide the required services at this time.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the supplies/services covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

In accordance with DFARS 206.303-2(b)(i) and PGI 206.304(a)(S-70)), a sources sought notice was issued on 07 August 2024. Two responses were received in response to the sources sought notice from the following firms: BHPE LLC and AML Oceanographic.

The Requiring Activity reviewed the information provided by each firm that responds to the sources sought notice to ascertain whether any of the responders were capable of meeting the Government’s minimum needs. Based on this review, the Requiring Activity determined that only AML Oceanographic possess the technical capability to perform the required tasks.

Furthermore, market research has determined that AML Oceanographic can meet the government’s minimum needs.

In addition, and in accordance with DFARS 213.501(a)(i), a copy of the previous justification was included in the review package to assist the approval authority in determining whether the planned actions to remove any barriers to competition cited on the previous justification were completed. In the previous justification (Attachment 2) a Sources Sought Notice was posted through NECO on 18 April 2019 with a close date of 03 May 2019. No additional responses were received to exclude AML Oceanographic. It was determined that AML is the authorized vendor to perform all calibrations and repairs on the AML manufactured equipment.

As such, the planned actions to attempt to remove the barriers to competition cited on the previous justification have been completed. The circumstances requiring the acquisition being conducted pursuant to FAR 13.501(a) remain unchanged. Any subsequent follow-on requirements will be handled on a case-

A copy of the previous justification is also included in the e-file. For the reasons set forth in Paragraph 5, by NAVSUP FLC Norfolk Contracting Department has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLC Norfolk Contracting Department will assess whether competition for future requirements is feasible.
