Source Selection Information – See FAR 2.101 and 3.104

Document Number: N23-069

SOLE SOURCE JUSTIFICATION

1. Identification of Agency and Contracting Activity.

The requiring activity is Explosive Ordnance Disposal Group Two (EODGRU TWO), Virginia Beach, Virginia; the contracting activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Contracting

Department.

2. Description of the Action Being Approved.

This requirement is for Vertical Wind Tunnel support services for EODGRU TWO. The instant acquisition is a follow-on procurement to an existing contract, N0018918D0033. Contract

N0018918D0033 was awarded on 21 May 2018 as a firm fixed price, Service Disabled Veteran Owned

Small Business (SDVOSB) direct award, in accordance with FAR 19.1406, to Indoor Skydiving

Virginia, LLC and expires on 30 May 2023. This is a sole source action to be awarded as a new contract to Indoor Skydiving Virginia, LLC (iFly Virginia Beach); 2412 Pacific Avenue, Virginia Beach, VA

23451-3270, under the direct SDVOSB authority at FAR 19.1406.

3. Description of Supplies/Services.

The instant requirement is for Vertical Wind Tunnel support services for training of personnel assigned to EODGRU TWO and subordinate commands. The vertical wind tunnel is a valuable tool that enables parachutists to practice and improve body flight technique. It enables parachutists to practice emergency procedures while wearing military equipment, i.e. parachutes and equipment bags in a controlled environment. This training is vital to keeping parachutists safe and proficient in order to accomplish their mission as it relates to Explosive Ordnance Disposal.

EODGRU TWO requires a qualified Contractor (within a 75 mile radius of Joint Expeditionary Base

Little Creek, Virginia Beach, VA) to provide a vertical wind tunnel facility and training in order to elevate the proficiency levels of military freefall parachutists assigned to EODGRU TWO and subordinate commands.

The contract will contain one (1) five-year ordering period with the option to extend for an additional six

(6) months in accordance with FAR 52.217-8. The ordering period is from 01 June 2023 to 30

November 2028, if 52.217-8 is exercised.

Task Orders will be funded utilizing Navy Operations & Maintenance (O&MN) appropriations of the fiscal year in which the Task Order is issued.

4. Statutory Authority Permitting Sole Source.

The statutory authority permitting this sole source action is 15 U.S.C.657f(c), Procurement Program for

Small Business Concerns Owned and Controlled by Service-Disabled Veterans, as implemented by FAR

19.1406, Sole Source awards to Service-Disabled Veteran-Owned Small Business Concerns.

5. Rationale Justifying Use of Cited Statutory Authority.

In accordance with 15 U.S.C.657f(c) and FAR 19.1406, the Contracting Officer considered a contract award to a SDVOSB concern on a sole source basis, before considering small business set-asides, since the requirement is commercial and none of the exclusions at FAR 19.1404 apply, and –

(1) Through market research detailed in section 6, it was determined that there is not a reasonable expectation that offers would be received from two or more service-disabled veteran-owned small business concerns. Market research revealed that iFly Virginia Beach, the incumbent contractor, is the only known service-disabled veteran-owned small business that is capable of satisfying the requirement due to the location of the facilities that must be within a 10 mile radius of Joint Expeditionary Base (JEB)-Little Creek.

(2) The anticipated award price of the contract, including options will not exceed $4 million;

(3) The requirement is not currently being performed by an 8(a) participant under the provisions of FAR subpart 19.8 or has been accepted as a requirement by SBA under FAR subpart 19.8;

(4) The service-disabled veteran-owned small business concern has been determined to be a responsible contractor with respect to the performance; and

(5) Award can be made at a fair and reasonable price.

Additionally, this is a follow-on to contract N0018918D0033 that was awarded as a sole source

SDVOSB set-aside after it was determined that there were no other businesses capable of meeting the requirement. A sources sought, as described in the section below, also verified iFly Virginia Beach as the sole company capable of providing the required services.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable, including a

Description of Market Research, if applicable, and a List of Interested Sources, if any.

Market research included a review of potential sources, contacting knowledgeable individuals in the

Government, querying the Government-wide database of contracts and other procurement instruments intended for use by multiple agencies, a review of previous acquisitions for similar requirements, and reviewing publicly available information regarding market capabilities.

Additionally, a Sources Sought notice was posted to the Government-wide Point of Entry (GPE) on 31

January 2023 to determine capable vendors. Zero (0) responses from any additional vendors were received. After review of the market research results, it was determined that there are no additional vendors capable of providing the support services required.

These services are classified under the North American Classification System Code 611620, Sports and

Recreation Instruction, with a size standard of $9M, which iFly Virginia Beach qualifies as a SDVOSB.

Therefore, market research indicates there is only one (1) SDVOSB, iFly Virginia Beach, capable of satisfying the requirement.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined that the anticipated cost to the Government of the services covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP Fleet Logistics Center (FLC) Norfolk has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, FLC Norfolk will assess whether competition for future requirements is feasible.

In accordance with DFARS 206.303-2(b)(i) and PGI 206.304(a)(S-70)), a sources sought notice was issued on 31 January 2023.

To date, no other sources expressed an interest in this requirement.

Furthermore, market research has determined that iFly Virginia Beach can meet the government’s minimum needs.

In addition, and IAW DFARS 213.501(a)(i), a copy of the previous justification was included in the review package to assist the approval authority in determining whether the planned actions to remove any barriers to competition cited on the previous justification were completed.

As such, the planned actions to attempt to remove the barriers to competition cited on the previous justification have been completed. Any subsequent follow-on requirements will be handled on a case-by-case basis. Market Research will be conducted for any future requirements to determine if there are any potential sources for competition.
