This J&A is based upon the authority of 10 USC 3204(A) (1), only one or a limited number of responsible sources will satisfy agency requirements.

The Government does not own the data or the rights to the data needed to purchase / contract repair of this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. If only one source has the rights or data to manufacture/repair this item, A/RMCs 3, 4, or 5 are valid. If two or more sources have the rights or data to manufacture/repair this item, A/RMCs 1 or 2 are valid.

This acquisition will be solicited to

ABB Motors & Mechanical Inc. (84ZA4) Based on the market research performed by the technical team, it has been concluded that the only sources of procurement is ABB Motors & Mechanical Inc. (84ZA4). It has been deemed uneconomical to pursue the acquisition of this data because the data and its content are not available. There is no authorized substitutes of this item, as this is the only item known to meet performance and compatibility requirements. Furthermore, there is no data to support an open and full competition. The item has to be tested within approved testing specifications procedures, design protocols, and internal QA requirements. The Government does not own the data, or the rights to the data needed to openly compete this procurement requirement. The sources listed above maintains the design and manufacturing standards via design drawings, manufacture procedures, and quality assurance procedures. The Government does not have the data/or is not authorized to use the data, to approve alternate sources. The AMC/AMSC of 1R is controlled by the Navy, however ABB Motors & Mechanical Inc. (84ZA4) is the only manufacturer of the item.

A Request for Information / Sources Sought Notice was entered on the government-wide point of entry on 03/18/2026 and as a result Sources Sought is not required. The solicitation was released for 30 days under SAT Emergency Acquisition procedures. D.P. Brown of Pennsylvania Corp was interested and submitted a quote. (Solicitation open date 3/18/2026 and close date 4/17/2026)

The proposed contract action was synopsized on the government-wide point of entry on 03/18/2026 and as a result Not applicable as solicited in accordance with FAR 13 procedures

Market research was conducted in accordance with far part 10. The results of the market research conducted (or the reason(s) market research was not conducted) are as follows

All market research sites were checked which include UNICOR, Ability One, GSA, SAM, and WebFLIS. A review of the mandatory sources of supply was conducted in accordance with FAR 8.002 and DFARS 208.002. None of the mandatory sources are capable of providing this requirement. A review of the UNICOR/FPI site results in no matches found; meaning this FSC is not on the list of FSC’s requiring UNICOR to be considered as a source of supply. Ability One and GSA are not valid sources for this requirement. The requirement is coded 1R meaning it is suitable for competitive acquisition for the second or subsequent time. The Government does not own the data or the rights to the data needed to purchase this part from additional sources. It has been determined to be uneconomical to buy the data or rights to the data. It is uneconomical to reverse engineer the part. This code is used when the Government did not initially purchase the data and/or rights. The OEM/approved source of supply being ABB Motors and Mechanical Inc. (Cage: 54ZA4), who is a large manufacturer. Even though the Navy codes the as 1R, the only approved manufacturer is ABB Motors and Mechanical Inc.
