About this file

This document is a Justification and Approval (J&A) for a sole source contract under FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items. The requirement is for 64 replacement parts for the stem ramp on an Expeditionary Fast Transport (EPF) vessel operated by the Military Sealift Command (MSC). The parts must be provided by the original equipment manufacturer (OEM), Lake Shore Systems, Inc., as they are considered critical safety items. Market research confirmed there are no other sources capable of providing the required parts. The anticipated cost is deemed fair and reasonable based on price analysis. The J&A was approved by the Contracting Activity Competition Advocate and the NAVSUP N7 Senior Executive Service. The related federal contract opportunity is a sole source award of contract N0040624C0026 to Lake Shore Systems, Inc. for $1,059,906.03.

The stem ramp onboard the is scheduled for maintenance. Required replacement parts included in the kit need to be delivered prior to the start of the maintenance period of performance. Stem ramps are considered a Critical System in accordance with COMSC INSTRUCTION 4490.lC. The designation of ship critical safety item means that any part, assembly, or support of this ship's critical safety item that has a failure, malfunction, or absence could cause catastrophic or critical failure resulting in loss or serious damage to the ship or unacceptable risk of personal injury or loss of life. See 10 USC

§2319 and DFARS 209.2 The stem ramp contemplated in this contract is on the following critical safety items: #15 -Mission Equipment (Vehicle Ramps; Cargo Cranes; Cargo Hold Watertight Doors and Ramps) (structural, electronics and hydraulic control systems; not hydraulic components and hoses, and other common components). Only authorized field service technicians have access to necessary technical data and have the expertise to identify and provide direct replacement parts for existing equipment, which must be compatible in terms of form, fit, and function with existing equipment or configurations. This ensures equipment reliability. Improperly installed or deficient parts could cause system failure and loss of the affected system or equipment while at sea. This

EPF class ship already contains these parts on its stem ramp and so replacement with parts from another manufacturer or introducing altemateand untested parts is not authorized and poses unacceptable risk to the success of missions performed and to the life and safety of personnel on board the vessel.
