About this file

This document is a sole source justification for replacement parts for a ship service diesel generator onboard a Military Sealift Command vessel. The Navy requires brand name replacement parts from Bergen Engines, the original equipment manufacturer, to be procured through its authorized U.S. distributor, Motor Services Hugo Stamp Inc. The parts are critical safety items necessary to maintain the generator and ensure the vessel's ability to complete its mission. Bergen Engines owns the proprietary technical data for the parts and has an exclusive agreement with Motor Services Hugo Stamp Inc. to distribute parts in the U.S. market. The solicitation will be synopsized as a brand name procurement with firm-fixed pricing through the Navy supply system. The total value of the procurement is estimated at less than $750,000 to be funded through fiscal year 2024 Navy working capital funds.

b. Reason for Authority Cited:

Direct re lacement pa1i s for the T-AO vessel' s SSDG number four cmTently installed onboard the is required to procure from the OEM, Bergen Engines U.S. based pruiner / authorized distributor MSHS Inc. Bergen Engines is the original equipment manufactmer and owns the drawings, technical manuals, and design infonnation for the SSDG onboru·d the T-AO class vessels. Using other than brand name repair pruts creates an unacceptable risk of personal injmy , loss of life, and catastrophic fa ilure resulting in a loss of or serious damage to the ship through pre-matme failure or nonconfo1mance to f01m-fit-function. The material is critical to the ships overall mission and without these pruis, the engine will have to nm at a reduced operating hourly capacity until approved for unlimited rnnning hours by technical authorities MSC N7 & ABS. This significantly limits the ability for the crew to operate the electrical plant unde1w ay with redundancy and not allow the vessel to complete its mission. The work contemplated in this contract is on the following critical safety items: Ship Se1v ice Diesel Engines/Ships Se1v ice Turbine Generators.

BRAND NAME

The required material must be compatible with existing vessel's SSDG. All MSC work item specifications are written to a standard taken from the technical manual with OEM input and vetted for approval by an MSC Technical Review board for consistency across the class of vessel.

This is critical equipment; without this material, the ship may not be able to operate the SSDG.

Unauthorized substitute pa11s may further damage and negatively impact mission readiness.

Bergen Engines holds the proprieta1y rights to drawings and technical info1mation of the material.

Bergen Engines is a foreign company headqua11ered in Bergen, No1way. Bergen Engines was contacted on 11/17/2023 via email in order to identify authorized distributors; the representative stated rurnngement have been for MSHS to handle all inquiries and fulfillment for the US Market.

CRITICAL SAFETY ITEM

The work contemplated in this contract is on the following critical safety items: Ship Se1vice Diesel Engines/Ships Se1v ice Turbine Generators. Per COMSCINST 4490.l C, MSC N7, the Design Control Activity, has dete1mined that only qualified sources may produce and service these critical safety items. Only authorized field se1v ice technicians have access to necessruy technical data and have the expertise to identify and provide direct replacement pa11s for existing

This ensures equipment reliability. Improperly installed or deficient parts could cause system failure and loss of the affected system or equipment while at sea. The identified contractor has been qualified by MSC to work on this system as shown on https://www.msc.usff.navy.mil/Business-Opportunities/Contracts/Qualification-for-Items Critical-to-Shipboard-Safety-on-MSC-Vessels/ .

In accordance with Technical Manual T9233-AN-MMC-010_0_2. Bergen Engines is the OEM and holds proprietaiy rights to technical info1mation, drawings and replacement paiis required to fulfill the required repairs of the SSDG number 4. Although Bergen Engines does not sell directly to the US market, Bergen Engines does have one authorized distributor, Motor Services Hugo Stamp Inc. (MSHS). This agreement allows MSHS to handle all inquiries and fulfillments in the US market.

Further con espondence with MSHS, concluded other parties may procure Bergen Engine spares in support of MSC vessels, such as Eriksen Diesel Repair, Inc. Based on the Critical Safety Item list, MSHS and Eriksen Diesel Repair, Inc. are cmTently the only qualified non-oem providers.

5. Efforts to Obtain Competition: This requirement will be synopsized and solicited via Sam.Gov as a Brand Name, Finn-Fixed price supply type contract, other than full and open competition. An email dated 11/17/2023 with Bergen Engines confoms that through a paiinership agreement, all US based sells will be handled by their only authorized U.S. distributor MSHS. An email dated 12/05/2023 with MSHS confmned Eriksen Diesel Repair, Inc. may also procure Bergen Engines paiis. Based on this info1mation there ai·e no fniiher effo1is to obtain competition. The contracting Officer shall publish the notices required by FAR 5.201 .

6. Actions to Increase Competition: CmTent market research, indicate that MSHS is the only contractor that can provide the requested materials for the US. No other sources have been identified at this time.

7. Market Research:

The required mandato1y sources in accordance with FAR Part 8 and FAR Part 10 were screened on 11/09/2023, are not provided by AbilityOne, UNICOR or GSA, and cannot be fulfilled via required sources of supply. National stock numbers (NSNs) do exist for some of the pa1is requested, however, the stock items were either out of stock and/or will not meet the required delive1y date due to long lead times. In accordance with FAR Part I 0, a detennination has been

Source Select ion Information (with content) - See FAR 2.101 and 3.104 made that the required supplies ai-e of a type offered and sold competitively in substantial quantities in the commercial marketplace based on competitive market prices and under standard commercial te1ms and conditions. However, as cited in section four of this document, the parts requested are required to be manufactured by Bergen Engines.

Based on the partnership agreement between Bergen Engines and Motor-Se1v ices Hugo Stamp Inc. (MSHS) in September of 2022. This paitnership agreement only allows MSHS to handle all US based requirements.

Fmihe1more, the MSC ship critical safety item website has identified one other potential authorized non-OEM company, which is listed on the reason for authority cited section above.

MSHS confumed Eriksen Diesel Repair, Inc. may procure and quote on Bergen Engine spai·es only in suppo1t of MSC vessels. All companies have been seai·ched in SAM.gov and ai-e actively registered.

8. Actions to Remove Barriers to Future Competition For the reasons set fo1t h in Paragraph 4, NA VSUP FLC Puget Sound has no plans at this time to compete future contracts for the types of supplies/se1v ices covered by this document. If another potential source emerges, NA VSUP FLC Puget Sound will assess whether competition for future requirements is feasible

9. Any Other facts supporting the use of other than full and open competition.

Small business distributors do exist, however, the manufacturer Bergen Engines is a lai·ge business. There is no non-manufacturer rule waiver cunently in place for NAICS 333618.
