About this file
This document is a Sole Source Justification and Approval form for a federal contract opportunity with the Military Sealift Command. The requirement is for Curtiss-Wright Electro-Mechanical Corporation (CW) to perform 18,000-hour maintenance on two high pressure air compressors (HPACs) and conduct an electrical and condensate drain upgrade for a US T-AO class fleet replenishment oiler. The contract will be a firm-fixed price, commercial supply type contract using FY24 Navy Working Capital funds, with CW being the sole source due to their status as the Original Equipment Manufacturer (OEM) and holder of proprietary rights to technical data and replacement parts.
The contract specialist conducted market research and confirmed that CW is the only known provider capable of performing the specialized HPAC repairs, as they hold exclusive proprietary rights to technical information, drawings, and replacement parts. No other authorized service providers or distributors exist for these specific HPAC models. The Naval Supply Fleet Logistics Puget Sound will post a notice of the proposed action and will assess competition if another potential source emerges in the future, though currently no actions to increase competition are planned.

2. Description of Action:
The purpose of this requirement is to perform the required 18,000-hour maintenance on two of the ship’s HPACs and perform the electrical and condensate drain upgrade due to obsolete equipment onboard an US T-AO class fleet replenishment oiler. The requested Period of Performance is from
The work contemplated in this requirement is on the following critical safety items under the following category: Mission Equipment. Per COMSCINST 4490.1C, MSC N7, the Design Control Activity, has determined that only qualified sources may produce and service these critical safety items.
CW is the OEM of HPAC Model N20NL-11C. The OEM has confirmed via email that it does not have any authorized service providers or distributors.
Required services are to be provided by:
Curtiss-Wright Electro-Mechanical Corporation (CW) 1185 Feather WAY Bethlehem. Pennsylvania 18015-9404, United States Cage Code 0UBG9 (valid thru 22 December 2023) - Large Business
For Official Use Only
6. Actions to Increase Competition: Current market research indicates that CW is the only known source who can provide the required services. There were not actions taken to increase competition.
7. Market Research:
The required mandatory sources in accordance with FAR Part 8 and FAR Part 10 were screened on 10 October 2023 and are not provided by AbilityOne, GSA, nor UNICOR.
Similar required services are available in the commercial market place. The demand for HPAC repair is recurring and supporting businesses are available in the commercial market place.
Currently there is only known one provider for the overhaul for these HPAC models. The contract specialist contacted another company, that has worked on similar requirements, specifically Low Pressure Air Compressor units (LPACs). LPACs are not the same as HPAC units in this requirement confirmed they were unable to perform the work in their response email and recommended we direct our attention towards CW.
Additionally, the same and similar requirements have been solicited as commercial items and awarded as Firm Fixed Price contracts with standard commercial terms and conditions. The market research conducted indicates that only CW is capable of providing the required HPAC repairs, as they hold proprietary rights to technical data, process, specifications and material on the HPACs.
8. Actions to Remove Barriers to Future Competition For the reasons set forth in Paragraph 4, NAVSUP FLC Puget Sound has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVSUP FLC Puget Sound will assess whether competition for future requirements is feasible
9. Any Other facts supporting the use of other than full and open competition.
