ANNEX 1 – JUSTIFICATION AND APPROVAL

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Supply Systems Command, Fleet Logistics Center Puget Sound, Code 210

2. Description of the Action Being Approved.

Award of a bridge contract on a sole source basis for telephone switch maintenance services in support of Naval Computer and Telecommunications Station (NCTS) Far East. A Request for Authorization to issue a Bridge Contract (RABC) was signed and submitted by Elizabeth Nashold, SES Deputy Commander Naval Information Forces, on 12 September 2023, and approved by NAVSUP 02 on 26 September 2023.

3. Description of Supplies/Services.

Provide 24 hour a day, 7 days a week, (24x7) sustainment support for all Navy-owned Nortel\Avaya\GenBand Telephone Switching systems and their associated equipment. This sustainment support will also include routine and emergency technical assistance, as well as repair and return of unserviceable telephone switch and power supply components throughout the NCTS Far East Area of Responsibility (AOR).

This bridge contract will be funded with FY 23 Operation and Maintenance, Navy (OM&N) funds.

The six-month base period of performance will begin 30 September 2023 and end 29 March 2024.

An additional three-month option period will be included under the 52.217-9 clause and have a period of performance from 30 March 2024 through 29 June 2024 if exercised.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(1). Unusual and compelling urgency.

5. Rationale Justifying Use of Cited Statutory Authority.

A sole source bridge contract based on unusual and compelling urgency is necessary because the Navy would be seriously injured in the event there was any lapse in these routine and emergency sustainment support services. Without this bridge contracting action, the NCTS Far East AOR would lose routine and emergency technical assistance to critical Nortel/Avaya/GenBand telephone and digital switching systems. These are legacy systems that require specific skills that are beyond the local national and military technician’s expertise. A lapse of these critical communication services would affect the NCTS Far East AOR’s communication capabilities to provide command and control to elements both ashore and afloat. The 7th Fleet depends on these services to maintain voice communications to conduct daily operations.

Although the Navy believed it had received the requirement with sufficient time to award a new contract and avoid a lapse in these vital support services, the initial review of the Performance Work Statement (PWS) indicated that multiple changes and additions were necessary to clarify the Navy’s requirement before the PWS could be included in a solicitation. While efforts are underway to address the issues identified during the initial review of the PWS, they are still not complete for the follow-on requirement. In addition, because of market research into this requirement, the follow-on requirement will be set aside for small business set aside that will require a 30-day phase-in period.

This phase-in period is necessary because the incumbent contractor is not a small business and will be unable to compete for the follow-on contract. The estimated time to complete the award process and provide the 30-day phase-in period extends well beyond the end date of the current contract.

The current contract does not include the 52.217-8 clause to allow for a six-month extension.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

This is a bridge contract, only the incumbent contractor will be solicited for this acquisition. The follow-on contract for this bridge action will be competed as a 100% SDVOSB set-aside.

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable using all applicable parts under FAR 15.404-1.

8. Actions to Remove Barriers to Future Competition.

This is a bridge contract for a six-month base period of performance and a three-month option period to allow ample time to properly compete the follow-on contract. There are no anticipated barriers to future completion, the follow-on will be competed as a 100% SDVOSB set aside.

Upon the basis of the above justification, I hereby approve, as Contracting Activity Competition Advocate, the solicitation of the proposed procurement(s) described herein using other than full and open competition, pursuant to the authority of 10 U.S.C. 3204(a)(x)(provide appropriate citation).
