About this file
This is a Justification for Other Than Full and Open Competition (J&A) under FAR 6.302-1 for a sole-source acquisition by the Defense Logistics Agency (DLA) Weapons Support (Columbus).
The acquisition seeks 3,692 units of Battery Storage (NSN 6140-016627350) for Fighting Vehicle Systems on a firm-fixed price basis with a fixed quantity and 100% option. The solicitation number is SPE7L126Q0671. The contracting officer has determined the anticipated cost will be fair and reasonable through price analysis comparing proposed prices to historical prices paid and certified cost or pricing data as required. The Government requires spare parts that are form, fit, and functionally interchangeable with currently used components, and the sole-source restriction is based on 10 U.S.C. 3204(a)(1) and AMC 3 (acquire for the second or subsequent time directly from the manufacturer). Enersys Energy Products, Inc. (CAGE 0WY95) is the only approved source known to have the capability to furnish the required supplies and is currently approved by the design control activity. The data needed to acquire this part competitively is not physically available, cannot be obtained economically, and adequate competitive specifications cannot be drafted (AMSC D). A Sources Sought Notice posted on SAM.gov on December 15, 2025, for five business days yielded no results. A market survey conducted on December 15, 2025, contacted only Enersys Energy, which responded confirming it is a large business manufacturer with the item available in inventory, a minimum order of four units, and estimated delivery of four weeks after order receipt. The solicitation will be synopsized on February 6, 2026, for one day, posted to the DLA Internet Bid Board System for a minimum of ten days, and dealers of the approved source will be solicited. The contract value exceeds $900,000, requiring Competition Advocate approval, which has been obtained.
