About this file

This document is a Justification and Approval for Other Than Full and Open Competition for U.S. Customs and Border Protection (CBP) Special Response Team (SRT). CBP seeks to procure a sole source, brand-name procurement of INVISIO COMMUNICATIONS INC communication systems, specifically generation II T7-over-the-ear headset systems and associated peripherals. The specific products include 50 PS Kit - V50 Gen II - T7 - Tan, 50 PS Kit - V10 Gen II - T7 - Tan, 150 INVISIO T7 Headsets, communication cables, and helmet adapter mounts, totaling multiple line items in tan color.

The justification emphasizes the need for these specific INVISIO products due to compatibility with existing 200 government-owned push-to-talk equipment. Alternative products would require approximately $1 million in replacement costs and significant training, and would not integrate with current in-ear systems. The market research confirmed that only INVISIO can provide products directly compatible with their currently owned equipment. The procurement is being conducted under FAR authority for sole source brand-name acquisition, with funding available and the solicitation to be posted on SAM.gov. The document is version 4.0 and dated April 2024, with certifications from CBP's Office of Field Operations and the Contracting Officer.

Attachment 1 U.S. Customs and Border Protection

Justification and Approval or Other Than Full and Open Competition for contracts above the Simplified Acquisition Threshold (SAT)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. Agency and Contracting Activity.

U.S. Customs and Border Protection (CBP) Office of Field Operations (OFO), Special Response Team (SRT), and Office of Acquisition, proposes to enter into a contract on a basis other than full and open competition.

2. Nature and/or description of the action being approved.

This justification seeks approval for a firm-fixed price sole source brand name procurement of INVISIO COMMUNICATIONS INC (INVISIO) communication systems, including over-the-ear headsets and associated peripherals, to support the SRT Headquarters' operational requirements. The estimated total value of this procurement is

3. Description of Supplies/Services.

It is the intent of CBP, OFO, SRT to procure generation II T7-over the ear headset systems, and applicable peripherals, as a part of existing equipment modernization efforts. SRT requires that over-the-ear headsets be compatible with the current INVISIO Push-to-Talk (PTT) systems with in-ear attachments, being used by the team.

The supplies to be acquired include the following INVISIO products:

PS Kit - V50 Gen II - T7 - Tan (Qty: 50) PS Kit - V10 Gen II - T7 - Tan (Qty: 50) INVISIO T7 Headset, Headband, Left, Tan - HC01 (Qty: 150) Com Cable - CC01 - 12-Pin (Motorola MTP850S/APX/SRX) - Tan (Qty: 100) Com Cable - CC01 - USB-C (Phone - Samsung Galaxy) - Tan (Qty: 200) T7 Helmet Adapter Mount, Upper Rail, ARC, Tan (Qty: 70) T7 Helmet Adapter Mount, Upper Rail, TW, Tan (Qty: 180)

4. Identification of Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 41 U.S.C.

3304(a)(1) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.103-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements”, which includes instances where a brand-name product is required, per FAR 6.302-1-1(c).

5. Demonstration That the Nature of the Acquisition Requires Use of the Authority Cited.

There are other products that are similar to the functions of the brand name products required by the Government. However, they will not function with the 200 current Government

Justification and Approval or Other Than Full and Open Competition for contracts above the Simplified Acquisition Threshold (SAT)

Version 4.0 April 2024 owned operator push-to-talk equipment, discussed in paragraph 3 above, and procuring new systems would require up to a million dollars, and training to ensure understanding of the functions of the new equipment. The training is anticipated to be 2 hours for training per officer, and 2 hours to set the new equipment to the Officer’s preference on their body armor kit, and run repetitions to test the new setup. Further, SRT requires uniformity of systems for encryption cabling, programmable cabling, Officer function, operational situational awareness, and the safety of the public. Over-the-ear headsets provide clarity, clear communication signals, especially in large crowds, or louder areas. The ability to switch between in-ear, and over-ear systems is mission critical. Therefore, if a different system was utilized for this over the ear requirement, CBP would then require corresponding acquisition of compatible in-ear devices, which would cost the Agency approximately one million dollars, increasing the cost of this current requirement by approximately 250%.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.

In accordance with Federal Acquisition Regulation (FAR) Subpart 5.102(a)(6) and 5.2 and represents the primary effort made to ensure that any other potential sources who believe they can meet the Government's requirements are afforded an opportunity to express their interest and provide supporting documentation within the specified timeframe.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable.

The contracting officer has determined that the anticipated price(s) will be fair and reasonable based on historical prices paid, independent government price estimates, and quotes received in response to the solicitation.

8. Description of Market Research.

The internet was searched for a list of contractors that could provide the equipment, or compatible equipment that would interface with the currently owned INVISIO equipment.

Additionally, the technical team attended tradeshows, and conducted vendor discussions. The market research showed that only INVISIO can provide products made to work directly with the currently owned products, and there are other distributors, including the manufacturer.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition.

Not applicable.

10. A Listing of the Sources, if Any That Expressed, in Writing, an Interest in the Acquisition.

None.
