About this file

This is a Limited Sources Justification memorandum for a firm fixed-price contract valued at $75,584.72 under the Multiple Award Schedule Program. The USS Gerald R. Ford (CVN-78) requires urgent installation of a Commercial Navigation FURUNO Radar System between January 22, 2026 and January 31, 2026. The radar system is critical for detecting other vessels, land, buoys, and weather to ensure safe navigation, collision avoidance, and support fishing operations, particularly in poor visibility conditions. The existing FURUNO radar system has been inoperative, and ship's force technicians have made multiple unsuccessful repair attempts.

The justification cites FAR 8.405-6(a)(1)(A) regarding an urgent and compelling need that would result in unacceptable delays if standard ordering procedures were followed. Market research identified Donatini, Inc., d/b/a Johnson Hicks Marine Electronics, an authorized FURUNO distributor, as the only vendor capable of providing required radar components (pedestal, antenna, cable assembly, and installation parts) as a direct bolt-on replacement compatible with the CVN-78's configuration. No alternative parts are currently authorized for corrective maintenance. Donatini, Inc. has available technicians for on-site installation and parts readily available for immediate shipment upon contract award. The vendor is a small business with a valid General Services Administration contract. The contracting officer determined the order represents best value consistent with FAR 8.4, with GSA having already negotiated fair and reasonable pricing for schedule contract services.

MEMORANDUM TO THE FILE

Subj: LIMITED SOURCES JUSTIFICATION 26-J003

This acquisition is conducted under the authority of the Multiple Award Schedule Program.

1. NATURE AND/OR DESCRIPTION OF ACTION BEING PROCESS

Contract Type: Firm fixed-price contract

Estimated Dollar Value (including all options): $75,584.72

Required Period of Performance: 01/22/2026 – 01/31/2026

2. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEED

The USS Gerald R. Ford (CVN-78) requires the urgent installation of a Commercial Navigation FURUNO Radar System. The purpose of this radar navigation system is to provide crucial situational awareness and safety at sea by detecting other vessels, land, buoys, and weather, especially in poor visibility (fog, night) or congested waters, helping prevent collisions, assist in navigation, and support fishing operations through features like collision avoidance, target analysis, and risk visualization.

FURUNO Electric Company is the Original Equipment Manufacturer (OEM) and Donatini, Inc., d/b/a Johnson Hicks Marine Electronics is an authorized distributor to FURUNO. The FURUNO radars have been inoperative and ship’s force technicians have attempted repairs on multiple occasions and were unsuccessful. This is an Urgent and Compelling requirement and is needed for the safe navigation of the ship. If the installation of the radar is not completed, it will impact the ship’s mission due to the increased risk to safety of navigation.

3. IDENTIFICATION OF THE STATUTORY AUTHORITY AND SUPPORTING

RATIONALE

FAR 8.405-6 requires an ordering activity to justify its actions when restricting consideration of schedule contractors to fewer than required in FAR 8.405-1 or 8.405-2. The specific circumstance that justifies restriction for this acquisition is (CHECK ALL THAT APPLY):

FAR 8.405-6(a)(1)(A): An urgent and compelling need exists, and following the ordering procedures would result in unacceptable delays.

CVN-78 requires the urgent installation of Commercial Navigation FURUNO RADAR components, including the pedestal, antenna, cable assembly, and other related installation parts. This equipment serves as both a surface search and secondary navigation radar, crucial to the ship’s operational capabilities.

FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

FAR 8.405-6(a)(1)(C): The new work is a logical follow-on to an original Federal

Supply Schedule (FSS) order provided that the original order was placed in accordance with the applicable FSS ordering procedures. The original order was not issued under sole source or limited source procedures.

FAR 8.405-6(b): The item is peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.

4. DESCRIBE WHY YOU BELIEVE THE ORDER REPRESENTS THE BEST VALUE

CONSISTENT WITH FAR 8.4 TO AID THE CONTRACTING OFFICER IN

MAKING THIS BEST VALUE DETERMINATION

In accordance with FAR 8.404(d), Services offered on the schedule are priced either at hourly rates, or at a fixed price for performance of a specific task (e.g., installation, maintenance, and repair). GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. Therefore, ordering activities are not required to make a separate determination of fair and reasonable pricing, except for a price evaluation as required by 8.405-2(d). By placing an order against a schedule contract using the procedures in 8.405, the ordering activity has concluded that the order represents the best value (as defined in FAR 2.101) and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs. Although GSA has already negotiated fair and reasonable pricing, ordering activities may seek additional discounts before placing an order (see 8.405-4).

Though a separate determination is not required, this order represent the best value consistent with FAR 8.4.

5. DESCRIBE THE MARKET RESEARCH CONDUCTED AMONG SCHEDULE

HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON MARKET

RESEARCH WAS NOT CONDUCTED

In accordance with Federal Acquisition Regulation (FAR) part 10, market research was conducted to determine the most suitable approach to acquiring the installation of commercial navigation Furuno Radar components. This is a new requirement for CVN-78.

In accordance with FAR part 8.002(a)(2), Ability-One was reviewed to determine capability, a review of the procurement list does not identify the installation of FURUNO Radar components. GSA Advantage was reviewed to determine availability of products providing for radar components. The search identified the radar components and installation were available on GS Schedule with Donatini Inc. that meets the Navy requirements.

Market research conducted via Google search engine indicates FURUNO is a commercial off the shelf (COTS) product. Donatini Inc. is the only vendor capable of providing the required items as a direct bolt-on replacement to the USS Gerald Ford’s configuration. No alternative parts are currently authorized for corrective maintenance requirements. USS Gerald R. Ford is currently deployed and requires a Commercial Navigation RADAR available for safety of Navigation. FURUNO RADAR has been inoperative and Ship's Force technicians have attempted repairs on multiple occasions but were unsuccessful.

The Contracting Officer considered reasonably available information about the supply or service offered under MAS contracts by surveying at least three schedule contractors through the GSA Advantage! on-line shopping service, by reviewing the catalogs or pricelists of at least three schedule contractors and determined Donatini Inc. has an available technician ready to assist Ship's Force with parts installation and restoration of FURUNO RADAR system. Parts are readily available to ship as soon as contract is awarded.

Market research indicates Donatini Inc. is the only entity capable of meeting the commands’ requirements through both on-site replacement of components with qualified personnel to deliver required supplies by delivery date. As a result, the requirement will not be set aside due to the urgency, however, Donatini Inc. is a small business vendor with valid GS contract.

6. ANY OTHER FACTS SUPPORTING THE JUSTIFICATION
