About this file
This is a Justification for an Exception to Fair Opportunity (J&A) for a sole source award above the Simplified Acquisition Threshold (SAT).
The U.S. Pacific Fleet (USPACFLT), Maritime Fires Executive Agent (MFEA) at Pearl Harbor, HI, through NAVSUP Fleet Logistics Center (FLC) Pearl Harbor Contracting Department, is awarding a new firm fixed-price task order to Patch Plus Consulting (PPC), a Woman-Owned Small Business (WOSB). PPC will provide technical and functional staff support services for program management, technical analysis, and subject matter expertise in the alignment of Navy and Marine Corps naval fires and targeting requirements across the DOTMLPF-P framework (Doctrine, Organization, Training, Materiel, Leadership and Education, Personnel, Facilities, and Policy). The period of performance consists of an 8-month base period (15 August 2026 – 14 April 2027) and a 4-month option period (15 April 2027 – 14 August 2027). The acquisition is conducted under 10 U.S.C. 3406(c)(5) using the GSA OASIS+ WOSB multiple award contract (Contract #47QRCA24DW101) and will be awarded in accordance with FAR Subpart 16.507.
The exception to fair opportunity is justified under FAR 16.507-6(b)(1) based on urgent agency need that would result in unacceptable delays from competition. The MFEA, recently established by direction of the Chief of Naval Operations and Commandant of the Marine Corps to address critical warfighting gaps in all-domain naval fires and targeting, faces immovable operational deadlines: transition must commence 15 August 2026, a CNO/CMC Joint Order executes in late August 2026 requiring immediate transition to Full Operational Capability, and current external contract funding expires 15 September 2026. PPC is the incumbent subcontractor currently performing these services and is the only source capable of providing immediate operational continuity without a catastrophic support gap. PPC personnel hold active Top Secret clearances, possess necessary base access credentials, and possess unique institutional knowledge required to manage the Naval Fires and Effects Training Continuum and integrate all-domain naval fires and targeting systems. Onboarding a new vendor would require 90 to 120 days for security vetting and credentialing and an estimated 6-month familiarization period, creating an operational gap incompatible with the FOC transition mandate. The Contracting Officer has determined the anticipated price/cost will be fair and reasonable. The Government plans to conduct extensive market research and initiate a recompete process 180 to 270 days prior to expiration to facilitate competition for future long-term acquisitions.

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
SOLE SOURCE (ABOVE SAT)
1. Identification of Requiring Activity and Contracting Activity.
The requiring activity is U.S. Pacific Fleet (USPACFLT), Maritime Fires Executive Agent (MFEA), Pearl Harbor, HI; the contracting activity is NAVSUP Fleet Logistics Center (FLC) Pearl Harbor, Contracting Dept.
2. Nature and description of contract action. This acquisition is conducted under the authority of 10 U.S.C. 3406(c)(5). This action is an exception to the fair opportunity process to be awarded as a new task order to Patch Plus Consulting (PPC), a Woman-Owned Small Business (WOSB) to provide USPACFLT MFEA with technical and functional staff support services. The placement of a firm, fixed-price order is anticipated.
This is a new requirement for program support services. This procurement action supports the transition of technical, analytical, and program management services that are currently performed under Contract number FA8075-18-D-0004, Task Order FA807522F0035. The existing contract fit the intent of the initial stand-up phase of the MFEA; however, the current vehicle has reached its funding ceiling, and the existing funding and task order expires on 15 September 2026.
3. Description of Required Supplies/Services . The proposed acquisition is to have a contractor provide USPACFLT MFEA with technical and functional program support services. The contractor shall provide comprehensive subject matter expertise, technical analysis, and program management support for the global alignment of Navy and Marine Corps (naval) fires and targeting requirements across the Doctrine, Organization, Training, Materiel, Leadership and Education, Personnel, Facilities, and Policy (DOTMLPF-P).
The period of performance consists of an 8-month base period and 4-month option. The name of the proposed contractor is Patch Plus Consulting (PPC). The estimated value of the base requirement is , with a total estimated value of inclusive of all options.
Period of Performance / Independent Government Cost Estimate POP Estimate Base 15 August 2026 14 April 2027 Option Period 15 April 2027 14 August 2027
4. Identification of the Exception to Fair Opportunity and Supporting Rationale - Including The statutory authority that permits not providing each awardee a fair opportunity to be considered for each order exceeding the micro-purchase threshold issued under a multiple award contract is 10 U.S.C.
3406(c)(5), as implemented by FAR 16.507-6(b). The applicable exception to the fair opportunity process for this justification for the award of an order exceeding the simplified acquisition threshold is:
The exception to the fair opportunity process is FAR 16.507-6(b)(1), The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
The Maritime Fires Executive Agent (MFEA) is a newly established entity tasked by the Chief of Naval Operations (CNO) and the Commandant of the Marine Corps (CMC) with resolving critical warfighting gaps in all-domain naval fires and targeting (ADNF-T). The urgency of this request is driven by a hard operational deadline and an unalterable administrative constraint that leaves no room for standard procurement lead times:
Critical Milestone Target Date Operational Impact & Constraint
Transition Start 15 August
Transition must officially commence to allow a 30-day knowledge transfer and prevent any lapse in critical services.
CNO & CMC
Joint Order
Late August
Joint Order executes; MFEA must transition from initial operational status to Full Operational Capability (FOC) immediately.
Task Order Expiration
15 September
Funding expires and the current external task order ceases permanently.
This urgent requirement is not the result of a lack of advance planning, but rather an unpredictable convergence of operational mandates and external contract limits. The forthcoming CNO & CMC Joint Order mandates an immediate, accelerated pivot to FOC for the MFEA by late August 2026. Simultaneously, the current technical support is being executed via an external agency's contract vehicle, which has unexpectedly reached its maximum ceiling.
Because USPACFLT is not the Procuring Contracting Officer (PCO) for this external vehicle, the Navy lacks the authority to modify the contract to increase the ceiling or extend the period of performance. Compelling to a standard of fair opportunity competition would require a procurement lead time that extends well past both the late August 2026 FOC stand-up and the 15 September 2026 hard-stop expiration.
Patch Plus Consulting (PPC) is the only source capable of providing the highly specialized technical and functional program support services required to transition the USPACFLT MFEA to FOC without a catastrophic gap in support.
Immediate Operational Continuity: PPC is the incumbent subcontractor currently executing the technical and functional program support services. Because the existing prime contract has reached its maximum ceiling on an external vehicle, an immediate transition directly to PPC is required to preserve the specialized subject matter expertise (SME) cadre currently in place.
Pre-Existing Security & Base Access: This requirement necessitates contractor personnel to hold an active Top Secret (TS) clearance. All PPC personnel assigned to this effort currently hold active TS clearances and already possess the necessary credentialing, Common Access Cards (CAC), and physical base access for USPACFLT facilities.
Specialized Expertise: PPC possesses the unique, non-transferable expertise required to manage the Naval Fires and Effects Training Continuum (NFETC) and integrate ADNF- T systems. This institutional knowledge cannot be rapidly acquired by a new vendor.
Additionally, PPC has been executing as a subcontractor and have provided Government approved critical deliverables supporting Government tasking.
Impact to Mission: If the new contract is not awarded by 15 August 2026, the MFEA will experience an immediate capability gap and work stoppage precisely as the Joint Order is signed, paralyzing the transition to FOC. Without uninterrupted SME support to manage the DOTMLPF-P alignment, USPACFLT will be unable to execute MFEA as directed by CNO/CMC. MFEA will lose its ability to identify, document, and resolve operational shortfalls, instantly blinding Pacific Fleet (PACFLT) and DON leadership to critical vulnerabilities in global strike capabilities. Uprooting the established expert cadre introduces an extreme risk to naval fires initiatives, halting joint maritime fires and targeting integration during an exceptionally sensitive geopolitical window in the Indo-Pacific theater.
Impact to Government: Attempting to compete this order could result in the need to onboard a new vendor, which would require a minimum of 90 to 120 days for security vetting, credentialing, and badging, resulting in an operational gap where critical mission-support seats sit empty. Furthermore, it would force the Government to fund an estimated 6-month familiarization and learning curve and these funds are not expected to be recovered through competition. A gap in services would derail the transition to FOC, delaying critical naval fires capability deployment and wasting prior Government investments.
5. Fair and Reasonable Determination.
In accordance with FAR 16.507-6(d)(2)(v), the contracting officer has made the determination that the anticipated price/cost to the Government will be fair and reasonable.
6. Any other facts supporting the justification. This procurement uses a MAC (GSA OASIS+ WOSB, Contract #47QRCA24DW101) and will be solicited and awarded in accordance with FAR Subpart 16.507.
PPC, as the performing subcontractor on the current contract, possesses the highly specialized, embedded expertise and immediate capability to execute on day one under the OASIS+WOSB, completely eliminating transition delays and delivering immediate cost efficiencies.
Transitioning immediately to a dedicated, properly structured Support Services contract is research and comparative analysis of potential vehicles and vendors were conducted between December 2025 and April 2026, as documented in the Market Research Report, determining that the GSA OASIS+ WOSB represents the optimal strategic vehicle. PPC is the proposed contractor as they provide the required corporate knowledge and highly specialized expertise necessary for an immediate, zero-delay transition.
7. Actions Taken to Remove Barriers to Competition.
The Government expects to obtain a stabilized operational baseline, a mature technical data package, and established ADNF-T career fields that will support competition for future acquisitions of the same or similar services. Once the MFEA's core architecture and initial Naval Fires and Effects Centers (NFECs) are fully established by the end of the proposed period of performance, the agency plans to conduct extensive market research to facilitate a competitive acquisition for future long-term support requirements. USPACFLT expects to establish a schedule that initiates the recompete process with the contracting activity 180 to 270 days prior to the expiration of this urgent requirement to allow for competition in future acquisitions.
