The contractor is responsible for pickup and delivery at NCBC Gulfport Fire and Emergency Services Department, Building 321, 5000 7th Street, Gulfport, MS 39501. The contractor must obtain all necessary licenses, permits, and base access passes at no additional cost to the Government and comply with all local, state, and federal environmental, safety, and occupational health regulations. All contractor personnel must possess valid identification badges displaying company name, personnel name, and photo, and must be either U.S. citizens or authorized to work in the United States. The contractor must comply with the Drug Free Workplace Program, smoking policies, and all installation security procedures. The contract is not technically complex and does not require a Contracting Officer Representative, though a Designated Government Representative will verify delivery and acceptance. PERFORMANCE WORK STATEMENT (PWS)
Advanced Cleaning and Inspection of Firefighter Personal Protective Equipment (PPE)
NAVAL CONSTRUCTION BATTALION CENTER FIRE & EMERGENCY SERVICES
General Requirements
Background The Naval Construction Battalion Center (NCBC) Fire and Emergency Service mission is dedicated to enhancing Naval fighter readiness by protecting life, property, and the environment. We accomplish this mission through continued risk assessment, fire prevention inspections, public education, and emergency response to fires, hazardous materials incidents, medical emergencies, and man-made and natural disasters.
To reduce health and safety risks associated with the improper maintenance, contamination, or damage of firefighting PPE; NCBC Fire and Emergency Services requires Contractor support for the cleaning and inspections of the departments Personal Protective Equipment.
Scope Advanced cleanings shall be performed by a verified ISP (Independent Service Provider). Verified vendors will be found in the Intertek Directory of NFPA 1851 Verified ISPs or UL Solutions’ list.
The Contractor shall provide for the selection, care, and maintenance of firefighting PPE to reduce health and safety risks associated with improper maintenance, contamination, or damage. The Contractor shall provide advanced cleanings and inspections of PPE in accordance with the standards promulgated by the National Fire Protection Association (NFPA) Standard 1851 – Standard on Selection, Care, and Maintenance of Protective Ensembles for Structural Fire Fighting and Proximity Fire Fighting (2020).
The Contractor shall, provide advanced cleanings twice annually; and advanced inspections of all elements at least annually, or as needed based on findings found during routine inspections. The program manager bags and tags all equipment for cleaning/inspection. Equipment is staged in an area. The contractor is escorted on the base, sometimes we load in our pickup and do the transfer at the front gate and loads the gear in their vehicle. To return the gear, the contractor contacts the PPC to schedule return to the base.
Replacement Gear. The Contractor shall provide one-for-one replacement (loaner) items while NCBC gear is being serviced. All loaner items shall meet or exceed NFPA standards.

LICENSE AND PERMITS
The Contractor shall be responsible for obtaining all licenses and permits (if required) at no additional cost to the Government and complying with applicable laws, codes and regulations at delivery location.
PERSONNEL
· The Contractor shall provide sufficient personnel to perform all work specified within this PWS.
· The Contractor shall comply with Public law 105-270, Section 5(2)(A). This law states that Contractors shall not perform inherently Governmental functions. Section 5(2)(A) of this Public law defines the term Inherently Governmental Function” as “a function that is so intimately related to the public interest as to require performance by Federal Government employees. Per Section 5(2)(B), Inherently Governmental Functions include activities that require the exercise of discretion in applying Federal Government authority or the making of value judgements in making decision for the Federal Government, including judgements relating to monetary transactions and entitlements. Per Section 5(2)(C), inherent Governmental functions DO NOT normally include, (i) gathering information for or providing advice, opinions, recommendations, or ideas to Federal Government officials or (ii) any function that is primarily ministerial and internal in nature.”
· When performing work associated with this PWS, The Contractor (to include subcontractors) shall provide all personnel an Identification (ID) Badge, which includes at a minimum, the Company Name, Contractor (to include subcontractors) personnel Name and a color photo of the Contractor (to include subcontractors) personnel. ID Badges shall be worn at all times during which the Contractor (to include subcontractors) personnel is performing work under this contract. Each Contractor (to include subcontractors) personnel shall wear the ID Badge in a conspicuous place on the front of exterior clothing and above the waist except when safety or health reasons prohibit. The Contractor (to include subcontractors) shall be responsible for collection of ID Badges upon completion of the contract or termination of Contractor (to include subcontractor) personnel. A listing of issued identification cards shall be furnished to the Designated Government Representative prior to the contract performance date and updated as needed to reflect Contractor and subcontractor personnel changes.
Employment of Federal Government personnel The Contractor shall not employ or enter into a contract with any person to perform work under this contract any personnel of the United States Government, either military or civilian, unless such person receives approval IAW applicable Federal and DOD regulations.
Personnel Compliance.
The Contractor shall ensure that Contractor personnel observe and comply with all local and higher authority policies, regulations, and procedures concerning fire, safety, environmental protection, sanitation, security, traffic, parking, energy conservation, flag courtesy, “off -limits” areas, and possession of firearms or other lethal weapons. When two or more directives or instructions apply, the Contractor shall comply with the more stringent of the directives or instructions.
Smoking/Drug/Alcohol Policy The Contractor shall comply with local command smoking policies and workforce requirements. The Contractor shall also comply with all Federal statues, laws, and regulations to implement a Drug Free Workplace Program (DFWP) as well as work force requirements and local command policies.
Personnel Conduct The selection, assignment, reassignment, transfer, supervision, management, and control of Contractor personnel performing the work specified herein shall be the responsibility of the Contractor. The Contractor shall be responsible for the performance and conduct of the Contractor and subcontractor personnel at all times. The Contractor shall ensure that personnel present a professional appearance. Contractor personnel entering the installation shall abide by the security regulations listed in the contract and shall be subject to such checks by the Government as deemed necessary. The Contractor shall not engage for performance under this contract any person whose involvement would result in a conflict of interest with the Government’s standards of conduct.
Personnel Removal Government rules, regulations, laws, directives, and requirements that are issued during the term of the performance period relating to law and order, installation administration, and security shall be applicable to all Contractor personnel and representatives who enter the installation. Violation of such rules, regulations, laws, directives, or requirements shall be grounds for removal (permanently or temporarily as the Government determines) from the work site or installation. Removal of Contractor personnel does not relieve the Contractor from the responsibility for the work defined in this performance work statement. The Contractor is expected to provide support services despite personnel removal or other unforeseen condition(s). Should replacement become necessary, the Government reserves the right to review all resumes of proposed candidates.
• Removal by Installation Commander: The Installation Commander may, at his/her discretion, bar an individual from the installation under the authority of 18 U.S.C. 1382 (1972), for conduct that is determined to be contrary to good order, discipline, or installation security and safety.
• Removal Requested by Designated Government Representative: The Designated Government Representative may require the Contractor to remove any personnel working under this contract for reasons of misconduct or security violations. Contractor personnel shall be subject to dismissal from the premises upon determination by the Designated Government Representative that such action is necessary and in the interest of the Government.
• Removal by Military Police: Contractor personnel may be denied entry to or may be removed from the installation by Military Police if it is determined that his/her presence on the installation may be contrary to good order, discipline, or installation security and safety.
• Removal for Unsatisfactory Performance: The Government reserves the right to require the Contractor to remove and replace any personnel who provide unsatisfactory performance, demonstrates insufficient knowledge, or possess inadequate skill levels necessary to complete assigned tasks. The skill level of the personnel provided shall be current and consistent with new technologies.
Interaction with other activities Contractor performance shall not interfere with Government work in the area where any service or maintenance work is being performed. In the event the Contractor believes that Government and other Contractor personnel are interfering with the performance of the tasks described in this PWS, the Contractor shall notify the Designated Government Representative immediately. The Contractor is obligated to continue performance of the effort described in this contract unless there is authorization from the Contracting Officer or Designated Government Representative to stop work. Failure by the Contractor to notify the Designated Government Representative and receive necessary instructions could result in denial of any additional costs incurred in performance of the contract under such conditions. Other Government Contractors may be performing required services in areas that interrelate with the requirements of this contract. The Government will facilitate initial contact between Contractors performing other contracts and this contract. The Contractor shall provide all further required coordination between other Contractors for any task specified in this contract that relates to or impacts on any other contracted work.
Inclement Weather The Contractor shall perform cleaning services as scheduled including during periods of inclement weather unless specific approval to delay is requested by the Contractor and approved by the Designated Government Representative. Such approval shall normally be granted only in cases of particularly severe weather, such as hurricanes or tornados, etc. The Contractor shall not request additional cost for schedule changes due to inclement weather.
Corrective Actions If at any time, it is determined by the Contracting Officer that the quality control system, personnel, instructions, controls, tests, or records are not providing results which conform to contract requirements, action shall be taken by the Contractor to correct the deficiency. If a Contract Deficiency Report (CDR) is issued the Contractor shall develop a Corrective Action Plan (CAP) which identifies the root cause, Corrective Action (CA) for the root cause, CA for specific non-conformance and CA to the root cause to prevent recurrence and a corrective action including the timeline for completion.
Contractor Access and Use of Premises The Contractor shall be responsible for securing the necessary permits and base access passes for Contractor personnel, vehicles and equipment for the duration of the contract. Station Security Forces reserve the right to refuse issuance of a pass to any Contractor personnel for any reason deemed valid by the Government. U.S. owned company personnel shall be required to provide the security forces with vehicle registration, proof of insurance, and driver’s license.
Environment and OSHA The Contractor shall comply with all local, State, and Federal environmental and occupational safety laws, rules, and regulations. Any apparent conflict between compliance with such local, State, and Federal environmental and occupational safety laws, rules, regulations, and compliance with the requirements of the contract shall be immediately brought to the attention of the Contracting Officer or Designated Government Representative for final resolution. The Contractor shall notify the Contracting Officer or Designated Government Representative in writing in addition to any verbal notification of such conflict. The Contractor shall be liable for all fines, penalties, and costs which result from violations of, or failure to comply with, all such local State, or Federal laws, rules, and regulations. All unsafe acts or conditions fostered by the Contractor or Contractor personnel may be grounds for the Contracting Officer or Designated Government Representative to halt any and all Contractor performance with a commensurate deduction of monies due to the Contractor until such unsafe conditions are corrected. The Contractor shall take due caution not to endanger personnel during performance of this contract. Upon discovery of a serious hazard such as, but not limited to, fire, or large fuel spill, the Contractor shall notify the Contracting officer or designated representative and Designated Government Representative.
The Contractor shall dispose of all debris and trash off-site, according to Florida regulations and best commercial business practices. The Contractor shall also provide repair quotations for additional repairs as needed. Authorization to Work. Contractor’s personnel shall either be a United States Citizen or authorized to work in the United States or possess a valid U.S. Immigration T-151 or I-94, Alien Registration Card. If Contractor person is not a US Citizen they must submit a foreign national visit request through the State Department and their embassy. This process can take up to 60 days. Speaking, Reading, and Understanding English. Contractor shall hire and staff personnel who can communicate with Government representatives and where reading, understanding, and discussing environmental, health, and safety warnings are an integral part of a personnel’s duties, Contractor personnel shall be able to understand, read, write, and speak the English language fluently. English shall be the only language used with regard to this contract for written correspondence, discussions and other business transactions.
Supervision of Contractor personnel The Government will not exercise any supervision or control over Contractor or Subcontractor personnel while performing work under the contract. Such Contractor personnel shall be accountable solely to the Contractor. The Contractor, in turn, shall be accountable to the Government for Contractor or Subcontractor personnel.
This acquisition is not technically complex, and for that reason, it does not require a Contracting Officer Representative (COR). However, a DESIGNATED GOVERNMENT REPRESNTATIVE will report to the Contracting Officer that all products and/or services from the Contractor have been delivered and accepted.

*Additional federal holidays as authorized by the President of the United States and/or executive orders shall be considered part of this list.
When one of the above designated Federal holidays falls on a Sunday, the following Monday will be observed as the Federal holiday. When a Federal holiday falls on a Saturday, the proceeding Friday is observed as the Federal holiday. This list of holidays relates to Government duty days and is not intended to supplement or otherwise alter the provisions of any Wage Determination regarding applicable paid holidays.
It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not be a reason for an additional period of performance, or entitlement of compensation, except as set forth within the contract. In the event Contractor personnel work during the holiday, the Contractor may reimburse them; however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked, unless stipulated otherwise. This provision does not preclude reimbursement for authorized overtime work if applicable.
When the Department of Defense grants excused absence to its personnel, the Contractor agrees to continue to provide sufficient personnel to perform critical tasks already in operation or scheduled, and shall be guided by the instructions issued by the Contracting Officer (KO) or the DGR. Changes in personnel work schedules shall comply with the terms and conditions of the contract, to include payment provisions.
If Government personnel are furloughed, the Contractor shall contact the KO or the Designated Government Representative (DGR) to receive directions. It is the Government’s decision as to whether the contract price/cost will be affected as a result of Government shutdown and/or furloughed Government personnels. In the event of a Government shutdown or furloughed Government personnel(s) impacts contract price/cost, a negotiated settlement will be reached as deemed appropriate by the KO.
DBIDS
For contractors, vendors and suppliers, only:
• If you were issued an NCACS credential PRIOR to 17 April 2017, your NCACS credential will remain in effect for base access through 14 August 2017, when NCACS credentials will no longer be valid.
• If you are issued an NCACS credential between 17 April and 30 June 2017 you will also be required to obtain a DBIDS credential in order to obtain base access.
• Any new contractor, vendor or supplier requesting base access AFTER 30 June will be required to obtain a DBIDS credential. NCACS credentials will no longer be issued.
• Only DBIDS credentials will be issued to ALL contractors, vendors and suppliers seeking base access AFTER 30 June 2017.
News Article: Navy Installations Underway with Transitioning to Defense Biometric Identification System Defense Biometric Identification System (DBIDS) increases installation security and communications by receiving frequent database updates on changes to personnel/credential status, law enforcement warrants, lost/stolen cards, and force protection conditions. The system provides a continuous vetting anytime the DBIDS card is scanned at an installation entry point.
If you currently have an Navy Commercial Access Control System (NCACS) card, the following is required to get a DBIDS credential:
· Present your NCACS Card and a completed copy of the SECNAV FORM 5512/1 to the base Visitor Control Center representative.
· The VCC will pull up your information in the computer, ensuring all information is current and correct.
· Once your information is validated, a temporary DBIDS credential is provided.
· Your temporary credential will have an expiration date, prior to which you will need to obtain your permanent DBIDS credential (~ 180 days).
· For each additional U.S. Navy installation to which you need access, the first time you visit you only need to bring your DBIDS credential and statement of purpose for base access when arriving at the Visitor Control Center.
· The representative will enter base access authorization and then you may proceed to work.
If you do NOT have an NCACS Card, the following is required to obtain a DBIDS credential:
· Present a letter or official document from my government sponsoring organization that provides the purpose for your access.
· Present valid identification, such as a passport or Real ID Act-compliant state driver's license.
· Present a completed copy of the SECNAV 5512/1 form to obtain your background check.
· Upon completion of the background check, the Visitor Control Center representative will complete the DBIDS enrollment process, which includes your photo, finger prints, base restrictions, and several other assessments; after all this is done, you will be provided with your new DBIDS credential.
· You may now proceed to work.
