JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

Crash Phones System

(>MicroPurchase Threshold but not exceeding the SAT)

1. Identification of Requiring Activity and Contracting Activity.

2. Nature and description of contract action. The acquisition of the supplies or services described below is an exception to the fair opportunity process to be awarded as a new follow-on contract to the XOP Networks identified in paragraph (2) below. The placement of a firm-fixed-price order is anticipated.

This procurement action supports the provision of

2.1 Oceana location: To extend support for currently installed XOP Network Ringdown Fire bar Emergency conference System (RFC) w/16 x 2 wire FSX Ports.

2.2 Norfolk location: To extend maintenance support for currently installed XOP Network Ringdown Fire bar Emergency conference System (RFC) w/32 x 2 wire FSX Ports.

2.3 Support is required in order to receive critical firmware updates, technical support and Software Assurance (SA). Firmware updates are essential to the security information assurance vulnerability compliance of the network. Lack of maintenance support could adversely impact Command’s ability in meeting its overall mission requirements.

That are currently performed under Contract number N0018918P0944. Contract number N0018918P0944 was awarded on a sole source/brand name to XOP Networks, a small business;

the existing contract expires on 10 Aug 2023.

3. Limited to the following source(s). The proposed acquisition is to provide maintenance for Crash phone system at Oceana and Norfolk. The Crash phone systems located at Chambers Field Naval Station Norfolk and NAS Oceana require maintenance and sustainment base plus 4 option year’s contract. Equipment was purchased and installed in FY16 and requiring updates, software assurance, and technical support needs to be purchased in FY23 for FY23 service.

Estimated cost for Norfolk is per year and Oceana will be per year. The estimated total is including option periods. Expected performance date is 11 August 2023 through 10 August 2024 for the base year.

4. Identification of the justification rationale. The statutory authority that permits not providing each awardee a fair opportunity to be considered for each order exceeding the MPT issued under a multiple award contract is 10 U.S.C. 2304c, as implemented by FAR 16.505(b)(2)(i). The applicable exception to the fair opportunity process for this justification for the award of an order exceeding the MPT, but not exceeding the simplified acquisition threshold, is:

FAR 16.505(b)(2)(i)(B) - Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized;

If Brand Name then add the following language: This is a justification for the use of items particular to one manufacturer, under the authority of 10 U.S.C. 2304c, as implemented by FAR 16.505(a)). The equipment was purchased from XOP Networks. Only XOP Networks is proprietary and authorized re-sellers are capable of performing the maintenance support and any software and security assurance updates and patches on the XOP equipment system.

5. Specific characteristics of the supplies or services support an exception to the fair opportunity process (i.e., unique features, function of the item, etc.). Describe in detail why only this/these supplies/services and/or awardee(s) can furnish the requirements to the exclusion of other supplies/services and/or awardees.

The equipment was purchased from XOP Networks. Only XOP Networks is proprietary and authorized re-sellers are capable of performing the maintenance support and any software and security assurance updates and patches on the XOP equipment system.

6. Market Research. Provide a description of the market research conducted among awardees and the results thereof OR a statement of the reason market research was not conducted.

XOP Networks’ Crash Phone system is proprietary and no other vendor can provide the maintenance, continuous software, and security updates.
