About this file
This is a Justification for Other Than Full and Open Competition (Sole Source Justification) for a federal contract under the Federal Supply Schedule (FSS).
The Naval Munitions Command Atlantic in Yorktown, VA requires the procurement of replacement components for existing military equipment through NAVSUP Fleet Logistics Center in Norfolk. The acquisition is for manufacturing one RF Module (P/N 4524400) and one Photonics Module (P/N 4524500) for the MK666MOD3 system (NIIN 6625-01-542-1675), with a total estimated cost of $261,121.00 ($164,592 for the RF Module and $96,529 for the Photonics Module). The delivery requirement is 240 days after contract award. This is a firm-fixed-price order to a small business and is considered a new requirement. The acquisition is restricted to a single supplier identified as the original equipment manufacturer and is being justified as an exception to full and open competition under GSAR 538.7104-3(a).
The justification is based on three primary factors: the supplies must be compatible in form, fit, and function with existing systems; proprietary manufacturing processes and designs limit competition; and these are direct replacement parts for existing equipment. Market research was conducted in accordance with FAR Part 10 and among mandatory supply sources, concluding that other vendors could only provide similar items rather than identical replacements. The sole source is justified because the manufacturer is the only known source capable of producing components that meet the Navy's stringent quality standards and time-sensitive requirements for this critical repair application.

Source Selection Information – FAR 2.101 and 3.104
In conclusion, the requested supplies or services represent the minimum requirements of the government.
☒ The supplies or services must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have now and how the new item/service must coordinate, connect, or interface with the existing system.
The RF Module (P/N 4524400) and Photonics Module (P/N 4524500) manufactured by are fully compatible in form, fit, and function with the existing MK666MOD3 (NIIN 6625-01-542-1675) currently in use. The existing equipment relies on these modules to perform its primary function. As the original and sole manufacturer of these modules and the MK666MOD3, produces a replacement part that is identical to the one originally installed. The parts are specifically designed to connect and interface seamlessly with the MK666MOD3, ensuring perfect form and fit. Functionally, because utilizes proprietary processes, their modules are the only components guaranteed to meet the precise performance and quality specifications required for the MK666MOD3 to operate effectively. Therefore, sourcing from is the only way to ensure the repaired MK666MOD3 will function identically to the original system. As this requirement is for replacement parts to conform with existing equipment, it is more cost effective than having to completely replace the equipment. Replacing the existing equipment would result in undue additional cost to the government.
The required replacement parts are proprietary to as they are the OEM for this equipment and do not have authorized resellers for their products.
☒ A patent, copyright or proprietary data limits competition.
The required replacement parts are proprietary to as they are the OEM for this equipment and do not have authorized resellers for their products.
☒ These are "direct replacement" parts/components for existing equipment.
Other information to support a sole source action:
Provide a description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Market research was conducted IAW FAR Part 10 along with a query of the mandatory sources for supplies. The results of that market research concluded that other vendors could only provide items similar to the salient characteristics of the supplies required in the SOW. Therefore, it is recommended this requirement be solicited on an Other than Full and Open Competition (J&A) to (Small Business).
