About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition to procure six (6) Tri-Star Helicopter Engine Wash Pads. The Tri-Star wash pads are essential to the government's requirements as they provide a heavy-duty, surface-mounted, and relocatable wash deck that can contain hazardous wash water from aircraft engine flushing operations. The wash pads are currently in use at Naval Air Station North Island and are only available from the manufacturer, Polystar Inc., through the authorized distributor, Containment Corporation. The total estimated value for the six wash pads, including freight to San Diego, CA and Oahu, HI, is $205,634.35. The procurement will be a sole-source, firm-fixed-price contract awarded under FAR Part 13 Simplified Acquisition Procedures.
The related federal contract opportunity is a Special Notice issued by the Department of the Navy Naval Supply Systems Command (NAVSUP) for the same requirement. NAVSUP intends to award a sole-source contract to Containment Corporation for the six Helicopter Engine Wash Pads. Interested parties may submit capability statements by 04 September 2024 to be considered for a potential competitive procurement, but the decision to compete the contract is at the government's discretion.

USE OF OTHER THAN FULL AND OPEN COMPETITION SAT
1. Identification of Agency and Contracting Activity
N44326
FLEET READINESS CENTER SOUTHWEST
NAS NORTH ISLAND
BUILDING 661 BAY 3 ROGERS ROAD
SAN DIEGO CA 92135 5000
2. Nature and/or Description of the Action Being Approved
The request for six (6) Helicopter Engine Wash Pads requirement was made due to an anticipated increase of aircraft inventory at Naval Air Station North Island (NAS) North Island and for the need of additional helicopter wash pads on Marine Corps Base Kaneohe Bay, Hawaii. The containment pads are required to meet Environmental Protection Agency regulations for Hazardous Material containment of wash water from aircraft engine flushing operations. The flight lines at Naval Air Station North Island (NASNI) and Marine Corps Base Kaneohe, Hawaii, (MCBH) are located adjacent to inland water ways. Due to the saltwater corrosive environment the aircraft fly in, the squadrons are required to perform engine washes after every flight or series of flights. Without the containment pads, the engine wash affluent can easily migrate into those water ways causing environmental pollution and potential EPA violations for the U.S. Navy.
3. Description of Supplies/Services to Meet the Agency's Needs Including Estimated Value
The supplies being procured are six (6) Tri Star Wash Pad Containment Systems with integral ramps for spill containment. The wash pads are made in the USA and currently in use at NAS North Island by Navy helicopter squadrons to perform engine washes after every flight or series of flights. The wash pads help contain the wash water containing salts and other hazardous materials. The wash pads are surface mounted and are installed directly on the flight line. The wash pads are assembled from prefabricated modular steel panels, encapsulated in 1/16" nominal fiberglass protective coating, 2" Trilinear sidewalls, 62mil fiberglass protective coating, bolts and caulking, four (4) hold-down clips, and no drain points. They are designed for heavy loads, the under carriage of the wash pad and ramp are honey combed with steel gussets designed to support heavy loads. The wash pads have a modular design that uses panels. The seams feature a two-inch over-lapping joint, with a gasket and caulking compressed between the two flanges. The slope of the deck assists in flowing wash water down slope, away from the seams. The ramp is designed to index into the entry end of the wash pad and is constructed in two sections that index together.
The estimated value for all six (6) Tri-Star Wash Pads including freight to the San Diego, CA and to Oahu, HI is $205,634.35. Delivery/installation within 30 days of contract award.

4. Statutory Authority Permitting Other Than Full and Open Competition
1. FAR 13.106 1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106 3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS BASED ON THE FOLLOWING:
A. ONLY ONE RESPONSIBLE SOURCE Yes
1. Restrictive Rights No The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
2. Exclusive Licensing Agreements Yes The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
Identify the OEM and explain the circumstances surrounding why the item or service is only available from the OEM.
OR
Identify the distributor(s)/authorized technical representative(s) for the item or service. Provide evidence of the exclusive licensing agreement as an attachment to this document. NOTE: If there is more than one distributor/authorized technical representative for an OEM part, then Part B, BRAND NAME SOLE SOURCE, is applicable, and Part A, ONLY ONE RESPONSIBLE SOURCE, should be left blank
The Tri Star Containment Pads are manufactured by Polystar Inc. and sold to state and Federal Agencies by Containment Corporation, CAGE Code 0K2N9, under GSA Contract No.: GS-07F-0092T (ends: Nov 14, 2026).
Containment Corporation (CAGE 0K2N9) is the identified distributor of the Tri-Star Containment Pads.

3. Other Reasons No Provide details on mission impact if requirement is not solicited from only one source
B. BRAND NAME Yes
Item required must be a brand name product, or feature of a product, particular to one manufacturer. Discuss why you are precluding consideration of a product manufactured by another company. Describe how the particular brand name, product, or feature is essential to the Government's requirements and why a "brand name or equal" purchase description cannot be used (see FAR 11.104). Describe how market research indicates other companies' similar products or products lacking the particular feature do not meet, or cannot be modified to meet, the agency's needs
The Tri-Star Wash Pad is essential to the Government's requirement because it provides a heavy duty, drive on wash deck which is surface mounted and can be relocated if needed. The system is designed to flow wash water to the closed end of the system where it can be recovered from a collection area. The panels are encapsulated in a thick fiberglass coating bonded to the steel surface for maximum protection against fuels, industrial cleaners. weather and rough handling. The wash pads have a proven track record with their intended use, there are currently 24 of the Tri-Star Containment Pads installed and being used by Navy helicopter squadrons on board NAS North Island.
C. UNUSUAL AND COMPELLING URGENCY No
The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
Discuss why you are precluding consideration of a product manufactured by another company. Describe how the particular brand name, product, or feature is essential to the Government's requirements and why a "brand name or equal" purchase description cannot be used (see FAR 11.1014). Describe how market research indicates other companies similar products and products lacking the particular feature do not meet, or cannot be modified to meet, the agency's need.
