About this file
This is a Draft AIA Document A101-2017 Standard Form of Agreement between Pflugerville Independent School District (Owner) and a Construction Manager-at-Risk (Contractor) for the construction of multipurpose room additions at Dessau Middle School and Pflugerville Middle School in Texas. The agreement, dated May 30, 2020, establishes the contractual framework for the project under the provisions of Texas Government Code 2269. The document references a one-step proposal process for contractor selection and incorporates the AIA Document A201-2017 General Conditions of the Contract for Construction, Pflugerville ISD's Construction Standards and Procedures (CSP) Document, and other contract documents to be finalized. Key contract representatives include Craig Pruett, Executive Director of Facilities and Support Services for Pflugerville ISD, as the Owner's representative. The date of commencement shall be established by notice to proceed from the Owner, while the substantial completion date and specific project scope remain to be determined at contract execution.
The contract sum is listed as "To Be Determined" ($0.00) in this draft, subject to additions and deductions as provided in the final contract documents. Progress payments shall be made monthly based on Applications for Payment submitted by the Contractor and Certificates for Payment issued by the Architect, with payment due no later than the last day of the following month if applications are received by the architect's deadline, or within 45 days if received after the deadline. The Owner may withhold 5% retainage from each progress payment until substantial completion, at which point the retained funds become due. Final payment is due within 30 days of the Architect's issuance of the final Certificate for Payment. Liquidated damages are assessed at $750 per project, per day for delays beyond the substantial completion date. Unpaid amounts shall accrue interest in accordance with the Texas Prompt Pay Act, Texas Government Code Chapter 2251. The contract includes provisions for termination, with the Contractor to be compensated for all work performed prior to termination for the Owner's convenience. Dispute resolution shall be resolved through litigation in a court of competent jurisdiction.
