About this file

The document is a Local Vendor Preference (LVP) policy for the City of Alpharetta, Georgia, designed to encourage local businesses to compete for city contracts with values between $50,000.01 and $500,000.00. The policy provides a preference mechanism for Alpharetta-based vendors participating in Invitations to Bid (ITB) and Requests for Proposal (RFP), allowing local businesses to receive preferential treatment in the contract award process.

To qualify for the local vendor preference, businesses must have a permanent place of business within Alpharetta city limits for at least six months, employ full-time staff, possess a valid city business license, and be current on all city taxes and fees. For Invitations to Bid, an Alpharetta vendor can be awarded the contract if their bid is within 3% of the lowest responsive and responsible bid from a non-local vendor. For Requests for Proposal, the local vendor preference is applied as a 3% evaluation criterion. The policy includes several exceptions, such as projects over $500,000, public works construction projects over $100,000, sole source agreements, and emergency purchases, where the local vendor preference may not apply.

CITY OF ALPHARETTA

LOCAL VENDOR PREFERENCE (LVP)

It is the policy of the City to invest in the local community when appropriate through securing goods/services from local businesses at competitive pricing and terms. This is to encourage local businesses to compete for City Business for formal procurement with a contract value of $50,000.01 to $500,000.00.

To apply for the Alpharetta LVP, the Vendor must meet the following requirements:

• Has a permanent place of business with full-time employee(s) within City limits for a minimum of six months prior to the issuance date of any formal solicitation to which said business is responding;

• The permanent place of business must distribute goods/services and cannot be a post office box or a residence;

• Has a valid business license from the City; and

• Is not delinquent on any taxes/fees owed to the City (e.g. property taxes, business license fees, etc.).

For preference, Alpharetta Vendors must complete and return the Local Vendor Certification Form located at the end of this document. Every Vendor seeking qualification for local preference must include this form with vendor’s response to this eligible procurement. The completed form must be accompanied with all required documentation noted on the form.

An Alpharetta vendor that has submitted the Local Vendor Certification Form with all required information and has been confirmed as eligible by City personnel will be given preference in contract award for their responsive and responsible bid (ITB)/proposal (RFP) if:

For an ITB: If the lowest responsive and responsible Bidder is a non-Alpharetta vendor:

• Alpharetta vendor will be given preference in contract award if their responsive and responsible bid is within three percent (3%) of the lowest responsive and responsible bid.

• If multiple Alpharetta vendors are within three percent (3%) of the lowest responsive and responsible bid, then contract award will go to the Alpharetta vendor with the lowest responsive and responsible bid.

For an RFP: Alpharetta Vendor preference of three percent (3%), or equivalent unit of measure, shall be provided as an evaluation criterion.

Exceptions:

a. Formal solicitations with a contract value of $500,000.01 or greater;

b. Public Works Construction Projects totaling $100,000.00 and greater (O.C.G.A. Chapter 91 of

Title 36);

c. Sole Source, Single Source, Name Brand, and Cooperative Purchasing Agreements;

d. Federal or State law prohibits the use of local preference;

e. The work is funded in whole or part by a governmental entity that prohibits the use of local preference;

f. The Alpharetta vendor is either non-responsive or non-responsible;

g. All bids submitted exceed the budget amount and supplemental funding is not available;

h. Emergency purchases; and

i. The procurement Official, City Administrator, and/or City Council may exempt any formal solicitation from the Alpharetta Vendor Preference.
