About this file

This is a Statement of Qualifications (SOQ) document for Pinal County Sheriff's Office (PCSO) in Arizona regarding towing services. The solicitation seeks to establish term contracts with towing service companies to provide comprehensive towing and related services 24 hours per day, 7 days per week throughout Pinal County. Required services include accident scene towing, accident site cleanup, abandoned and confiscated vehicle towing, stranded motorist roadside assistance, and vehicle storage. Contractors must provide all necessary equipment, hardware, personnel, labor, storage facilities, and insurance to support PCSO's high-volume incident response operations. The SOQ process establishes the qualifications and capabilities that prospective vendors must demonstrate to be considered for contract award.

The document establishes the evaluation criteria and requirements for vendor qualification to provide towing services to PCSO. Qualified contractors must demonstrate adequate insurance coverage, appropriate licensing and certifications, sufficient equipment and storage capacity, experienced personnel, and financial stability to support continuous service delivery. The contract structure anticipates term agreements with multiple vendors to ensure service availability across the county's geographic area and to manage demand fluctuations. This master solicitation approach allows PCSO to establish pre-qualified vendors capable of responding to emergency and non-emergency towing needs while maintaining operational flexibility and service redundancy.

EXECUTIVE SUMMARY

OFFICIAL SOLICITATION DOCUMENTS: Pinal County officially distributes solicitation documents through the Bonfire Purchasing System. Copies of solicitations obtained from any other source are not considered official copies. Only those Vendors who obtain solicitation documents from the Bonfire Purchasing System website will be in receipt of officially posted and relevant information regarding solicitations issued by Pinal County. The County cannot be held responsible for incorrect information, nor can it attest to the accuracy of information found on websites other than the Bonfire Purchasing System.

PURPOSE OF SOLICITATION: Pinal County is issuing this Solicitation for the purpose of entering into a contract for services as specified herein from a Vendor(s) that will provide prompt and efficient service to the County for Towing Services.

Although this Solicitation specifies exact services to be completed, it is understood and agreed that the County may, during the term of the contract, request additional services be performed by the successful Vendor(s) at other locations within Pinal County. This option, if exercised, is the prerogative of the County and shall be honored by the Vendor(s) throughout the contract period. No guarantees are made that additional services will be requested.

TERM OF CONTRACT: The awarded contract shall commence on April 15, 2026 and shall remain in effect through April 14, 2027.

OPTION TO RENEW FOR SUBSEQUENT YEARS (WITH PRICE ADJUSTMENT): The prices or discounts quoted in this Solicitation shall prevail during the specified term of the contract, at which time the County shall have the option to renew the contract for four additional one-year periods. Continuation of the contract beyond the initial term is a County prerogative and not a right of the Vendor and will be exercised only when such continuation is clearly in the best interest of the County.

During the option period, the County will consider an adjustment to the pricing structure if the manufacturer or supplier notifies the Vendor of a price adjustment. It shall be understood that such price adjustments shall not exceed the amount passed on to the Vendor/supplier by the manufacturer. The Vendor shall notify the County of such adjustments during the option period at least ninety calendar days prior to the end of the then current contract year and must include detailed justification for the requested adjustment. The County reserves the right to reject any price adjustments submitted by the Vendor and/or to terminate the contract with the Vendor based on such requested price adjustments.

The County may consider an adjustment to the pricing structure outside of the option period if such adjustment would be detrimental to the Vendor. The Vendor shall submit an immediate request for such an adjustment in writing to the Purchasing Division and must include detailed justification for making the requested adjustment outside of the option period.

This consideration is a County prerogative and there is no guarantee that the request will be accepted outside of the option period. The County reserves the right to accept, reject, or negotiate any price adjustments submitted by the Vendor and/or to terminate the contract with the Vendor based on such requested price adjustments.

NON-APPROPRIATION. Pursuant to A.R.S. §35-190, as amended, the financial obligations of the County as set forth herein after the current fiscal year are contingent upon funds for the purpose being appropriated, budgeted and otherwise available. The awarded agreement will automatically terminate on July 1st of the first fiscal year for which funds are not appropriated. The County shall give the Vendor written notice of such non-appropriation.

e) Vehicle Storage Rates. Vehicle storage rates shall apply to each calendar day (a calendar day is defined as midnight to midnight) in which the vehicle is securely in accordance with this contract. Rates shall not apply for the calendar day in which a vehicle is picked up. Additionally, should a vehicle be stored pursuant to A.R.S. §28-3511, storage rates/charges shall not exceed $25.00 per day.

i) No additional fee may be charged by the Contractor where it is necessary for the Contractor to deliver the vehicle/unit(s) to the public roadway access adjacent to his/her property from the storage area.

f) The Contractor shall charge the contract price for any miles added to existing highways due to new construction, for any new roadway within the Contractor’s region, or for any realignment of regions after contract is in place. A contract amendment will be issued to incorporate any changes. The Contractor shall charge contract price regardless of whether vehicle is towed from an Interstate, U.S. Highway, State Route, or surrounding city or county roadways, as long as the request for towing is generated by PCSO and it does not overlap or conflict with any other tow contract that the County has (i.e. towing of a disabled county vehicle as this is covered under separate contract).

I. Complaints against the Contractor.

a) The Contractor shall make every effort to treat vehicle owners or operators in a fair and courteous manner. The Contractor shall not charge in excess of fees specified in Attachment G – Maximum Allowable Rate Schedule, nor shall the owner be charged for any services not authorized in this Contract without the prior approval of the vehicle owner or authorized agent. Complaints will be investigated in accordance with PCSO policies and procedures to the extent deemed necessary by PCSO. Any complaints brought to the attention of the Contractor by PCSO or a vehicle owner or operator shall be answered in writing to the PCSO by Contractor within three (3) days of notification.

Any vehicle owner or vehicle operator complaints deemed sustained may result in suspension or termination of this Contract.

J. Contract Violations. The County requires the Contractor to comply with all contract provisions at all times.

a) If more than one complaint is received against the Contractor, the County reserves the right to terminate or suspend the Contractor from the contract. An inspection may be required to confirm a violation, and a follow-up inspection to confirm the violation is corrected, in which case the Contractor will be responsible for a $500 administrative fee. The length of any suspension shall be at the sole discretion of PCSO.

b) The failure on the part of the County to exercise any right granted to it in this Section when that right first accrues shall not be deemed a waiver on the part of the County to exercise that right at a later time. The County may terminate this contract for cause in a calendar year following the year in which the violation threshold was exceeded.

c) The Contractor will be notified in writing, to include email, by the County of a violation and the Contractor will have ten (10) calendar days from the date of mailing to respond in writing. The County’s notice shall include a brief narrative apprising the Contractor of the time, place and nature of the violation and shall set forth those facts in the possession of the County substantiating the violation. The Contractor’s mailed response will be considered timely if postmarked within this ten (10) day period. Failure of the Contractor to respond within this time period will be deemed an admission that the violation occurred.

The response will be evaluated by PCSO. The violation may be upheld or reversed at the sole discretion of PCSO.

d) Suspension/Termination. The County reserves the discretion to immediately suspend or terminate the Contractor.

e) Notice of suspension/termination shall be made by telephone, email or US mail to the Contractor stating the reason(s) therefore. If suspension/termination is made by telephone, a written confirmation via email or US mail of the action will follow within three (3) business days. If suspension occurs, notification will contain the length of suspension and reinstatement will be dependent upon the Contractor demonstrating that the cause for the suspension has been corrected.

f) The Contractor agrees that the County may immediately suspend or terminate this contract in situations that include but are not limited to any of the following:

i) Failure of the Contractor to comply with all provisions of this contract.

ii) Evidence that the Contractor is now or has engaged in illegal or unlawful practices, pursuant to Arizona law or regulation.
