Bids must include Bid Security in the form of a certified check or surety bond equal to five percent of the total bid amount, with bid security retained for 70 days following bid opening. The project is subject to MAC's Project Labor Agreement requirements. Contractors must comply with Minnesota Statute Section 473.144 affirmative action requirements and submit evidence of compliance within one MAC business day following bid opening. The project establishes an eight percent Small Business participation goal; bidders failing to demonstrate good faith efforts to achieve this goal will have their bids deemed non-responsive. Affirmative action goals for minority and female workforce participation are 32 percent and 20 percent respectively in Hennepin and Ramsey Counties, or 22 percent and 15 percent respectively in Anoka, Carver, Dakota, Scott, and Washington Counties. NOTICE TO CONTRACTORS

Electronic Bid Submission for the project listed above will be received by the MAC, a public corporation, via QuestCDN https://qcpi.questcdn.com/cdn/posting/?projType=all&provider=8002769&group=8002769 until the official time and date as displayed in QuestCDN Online.

This project provides for:

The refurbishment and relocation of one (1) Passenger Boarding Bridge, new boarding bridge fixed walkway, and all associated controls, equipment, accessories and foundations. Building architectural and electrical improvements are also included in the project. Security cameras and boarding door card readers to conform with the current MAC design standards are also included in this project. Bids shall be submitted electronically via QuestCDN. No other Bid Form is acceptable.

Consistent with Minnesota Statute, Section 473.144, MAC may not accept a bid or proposal for a contract or execute a contract in excess of $100,000 with any business unless said business is in compliance with certain requirements concerning affirmative action plans. Evidence of compliance must be submitted within (1) one MAC business day following opening of bids. Bids will be considered non-responsive if the compliance requirements are not met. Compliance requirements are outlined in the project specification.

SMALL BUSINESSES (SB)

The goal of the MAC for the utilization of Small Businesses on this project is 8%.

Within (1) one MAC business day following the opening of the bids, all bidders who wish to remain in competition for the contract will be required to submit the following information:

1. Refer to Information for Bidders for bid submittal requirements.

Bidders will be prohibited from entering into agreements with a SB in which the SB promises not to provide subcontracting quotations to other bidders.

A bidder's failure to show a good faith effort to achieve the specified contract goal for the participation of SBs in the completion of this project will be grounds for finding the bid non-responsive.

A bidder should contact the MAC’s Small Business Program Manager at (612) 726-8193 for information on qualifying for the SB programs or for assistance in identifying SB businesses.

STATE NOTICE OF REQUIREMENTS FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY

The following clause applies to state-assisted construction contracts in excess of $100,000.

1. The Bidder's attention is called to the "equal opportunity clause" set forth herein.

2. The goals and timetables for minority and female participation, expressed in percentage terms for the contractor's aggregate workforce in each trade on all construction work in the covered area are as follows:

These goals are applicable to all the contractor's construction work (whether or not it is state or state-assisted) performed in the covered area.

The contractor's compliance with Minnesota Statutes, section 363A.36 and part 5000.3520 shall be based on its implementation of the equal opportunity clause, specific affirmative action obligations required by the specifications in part 5000.3540, and its efforts to meet the goals established for the geographical area where the contract resulting from this solicitation is to be performed. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade, and the contractor must make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from contractor to contractor or from project to project for the sole purpose of meeting the contractor's goals is a violation of the contract, Minnesota Statutes, section 363A.36 and part 5000.3520. Compliance with the goals will be measured against the total work hours performed.

3. The contractor must provide written notification to the Compliance Division of the Minnesota Department of Human Rights within ten working days of award of any construction subcontract at any tier for construction work under the contract resulting from the solicitation. The notification must list the name, address, and telephone number of the subcontractor; employer identification number, estimated dollar amount of the subcontract; estimated starting and completion dates of the subcontract; and the geographical area in which the contract is to be performed.

4. As used in this notice, and in the contract resulting from this solicitation, the "covered area" is the geographical area where the contract is to be performed, which may be Hennepin and Ramsey Counties, or Anoka, Carver, Dakota, Scott, and Washington Counties.

TITLE VI SOLICITATION NOTICE

The MAC, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4), 28 CFR § 50.3, and 49 CFR Part 21, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, all contractors will be

afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of the owner’s race, color, national origin, sex, creed, age, or disability in consideration for an award.

BID SECURITY

Each bid shall be accompanied by a "Bid Security" in the form of a certified check made payable to the MAC in the amount of not less than five percent (5%) of the total bid, or a surety bond in the same amount, running to the MAC, with the surety company thereon duly authorized to do business in the State of Minnesota. Such Bid Security to be a guarantee that the bidder will not, without the consent of the MAC, withdraw its bid for a period of (70) days after the opening of bids, and, if awarded the Contract, will enter into a contract with the MAC, and in connection therewith, give Performance and Payment Bonds as required by law and on forms furnished to the Contractor by the MAC. In the event the Bidder fails to enter into a Contract, the amount of the certified check will be retained or the bond enforced by the MAC.

The Bid Security of the three (3) lowest bidders will be retained until the contract is executed, but in no event longer than (70) days. The Bid Security of the lowest responsible bidder shall be retained in any event until the contract is executed and Payment and Performance Bonds furnished as herein provided.

The bid of the lowest responsible bidder, provided said low bidder has made a good faith effort to meet any SB contract goal, will be accepted on or before the expiration of (70) days after the date of the opening of bids. The MAC, however, reserves the right to reject any or all bids and to waive any minor irregularities, informalities or discrepancies.

PROJECT LABOR AGREEMENT

This project is subject to the MAC’s Project Labor Agreement requirements. A copy of the Project Labor Agreement and Contract Riders are included in the Appendix D.
