About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) for a succeeding lease under GSA lease number GS-05B-18628 for the General Services Administration (GSA) in Columbus, Ohio. The GSA currently leases 2,267 ABOA/2,639 rentable square feet (RSF) of office and related space, along with 5 structured, secured, and reserved parking spaces, at 10 W Broad St, Ste 550, Columbus, OH. The current lease expires on 11/30/2023, and the GSA is seeking to negotiate a succeeding 10-year lease (5-year firm term) with the incumbent lessor without full and open competition. The estimated cost of the lease is $ /RSF for the firm term and $ /RSF for the soft term, with a total contract value of $ . The GSA has a justification to remain at the current location due to existing tenant improvements, building-specific amortized capital, and mission-critical security features that would be difficult and costly to replicate elsewhere. Market research indicates the proposed rental rates are fair and reasonable within the delineated area.

Justification for Other Than Full and Open Competition, Succeeding Lease

U.S. General Services Administration

GSA Region 5

Real Estate Division

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

PROJECT NUMBER: 0OH2362

Agency Name:

1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

The General Services Administration currently leases 2,267 ABOA/2,639 rentable square feet (RSF) of office space at 10 W Broad St, Ste 550, Columbus, OH under lease number GS-05B-18628 for the

The current lease expires 11/30/2023. Approval is requested to negotiate a succeeding lease with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The procedures for pursuing a succeeding lease are detailed in GSAR 570.402: Succeeding Leases.

2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS

(INCLUDING ESTIMATED VALUE).

confirmed their continuing need for 2,267 ABOA square feet of office and related space, and 5 structured, secured, and reserved parking spaces when they signed the Client Project Agreement from GSA on 5/22/2023. To satisfy the mission requirements, the facility must be on the 3rd floor or above, must have a loading dock accessible for secure property movement, and must be collocated with the Federal Courthouse.

This requirement is for 2,267 ABOA/2,639 RSF of space for a 10 year/5 year firm term to commence on 6/1/2024. The estimated cost of this lease is $ /RSF for the firm term of the lease, $ RSF for the soft term of the lease for an annual cost of $ for the firm term and $ for the soft term and a total contract value of $ . The estimated cost of an extension of 24 months at the expiring lease’s current rate is $ . The delineated area is the Central Business District of Columbus: North: Interstate 670, East: Interstate 71, South: Interstate 70, West: Scioto River.

There is vacant federal space available, however the agency has a justification to stay in place because their current building has been altered to accommodate a large vault for their Asset Forfeiture Division.

The Federal Bricker building also does not have parking available or a sufficient loading dock, which the agency requires.

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.402. In accordance with GSAR 570.402, use of the sole source authority is appropriate where it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.

4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

It is in the best interest of the Government to remain at the current location. Award to other than the current Lessor would require relocation of the entire requirement and would cause to incur move and replication costs that would not be recovered through competition. Relocation costs are estimated to be $ . Additionally, this allows the Government to make use of existing tenant improvements and building specific amortized capital, avoiding replication costs of $ . This includes a secured waiting area, an alarmed high value vault for storage and evidence, a sufficient loading dock for secure property movement (including electronics and weapons), a server room with 24/7 access, and all security requirements for an FSL II location. A cost-benefit analysis was completed following the procedures set forth in GSAR 570.402-6 and is attached to this JOFOC for reference. The cost of relocating using the low-cost quote exceeds the cost of remaining at 10 W Broad St, Columbus, OH. The total savings to the Government is .

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

Per the requirements of GSAR 570.402, the GSA Leasing Specialist placed an advertisement on the Contracting Opportunities domain of SAM.gov on 9/5/2023 for 28 days. In addition, Leasing Specialist Kiomi Kunugi conducted market research using a Bullseye Report on 7/19/2023 and CoStar on 7/25/2023.

6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE.

Recent market research conducted by Leasing Specialist Kiomi Kunugi in Columbus, Ohio showed the rental rate within the delineated area ranges from $ - $ per RSF when using the agency’s full TI allowance and FSL II BSAC allowance. Net of TI and BSAC, recent market research conducted by Leasing Specialist Kiomi Kunugi in Columbus, OH showed the rental rate in the delineated area ranges from $ - $ . This data was derived from CoStar, market knowledge, and GSA pricing policy.

Therefore, the proposed rental rates for this succeeding lease of $ /RSF for the firm term of the lease and $ /RSF for the soft term of the lease are within the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.

7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.

GSAR 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition.

On 7/25/2023, Leasing Specialist Kiomi Kunugi conducted market research using CoStar and identified 21 potentially acceptable locations (20 plus the incumbent) that might meet the agency’s needs within the delineated area. Further research indicated that 5 buildings could not meet the parking requirements for the agency, 1 building could not meet the SF required, and 15 buildings could realistically meet the agency’s requirements. In addition, PBS posted an advertisement conforming to GSAR 570.402-2 on the Contract Opportunities domain of SAM.gov website on 9/5/2023. The incumbent Lessor’s expression of interest indicated that the rate would be $ /RSF for the firm term of the lease and $ /RSF for the soft term of the lease. Additionally, a second party responded to the advertisement offering a building at

Columbus, OH. This offeror indicated that the rate would be /RSF for the lease term.

12. PREPARER’S TECHNICAL CERTIFICATION.

I certify that the supporting data used to form the basis of this Justification is complete and accurate to the best of my knowledge and belief.
