About this file

This document is a Justification for Other Than Full and Open Competition for a lease renewal for the Federal Bureau of Investigation (FBI) in Augusta, GA. The General Services Administration (GSA) is seeking to negotiate a succeeding lease for 5,979 ABOA/6,875 rentable square feet at 1 10th Street, with the current lease expiring on 11/30/2025. The new lease term will be 5 years with a 2-year firm term, commencing on 12/01/2025.

The solicitation requires the space to be contiguous, located on the second floor or higher, and capable of meeting Facility Security Level (FSL) 2 requirements. Market research conducted by PBS on May 19, 2025, identified only one potentially acceptable location within the delineated area. An advertisement was posted on SAM.gov on June 12, 2025. The incumbent lessor (One Tenth Street LLC) was the only party expressing interest, with the proposed rental rates deemed fair and reasonable by the GSA Lease Contracting Officer based on market surveys. The justification cites 41 U.S.C. 3304(a)(1) as the statutory authority, arguing that relocation would result in substantial unnecessary costs to the government.

Justification for Other Than Full and Open Competition, Succeeding Lease

U.S. General Services Administration

6P1RW

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

PROJECT NUMBER: 0GA2176

Agency Name: FEDERAL BUREAU OF INVESTIGATION

1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

The General Services Administration currently leases 5,979 ABOA/6,875 rentable square feet (RSF) of office space at Augusta Riverfront, 1 10th Street, Augusta, GA under lease number LGA60327 for the Federal Bureau of Investigation (FBI). The current lease expires 11/30/2025. Approval is requested to negotiate a succeeding lease with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The procedures for pursuing a succeeding lease are detailed in GSAR 570.402: Succeeding Leases.

2.

(INCLUDING ESTIMATED VALUE).

FBI submitted a continuing need letter on 02/01/2023 for 10,994 rentable square feet of office and related space. This was later reduced via a project kick-off meeting on May 15, 2025 to 6,875 rentable square feet of office and related space. To satisfy the FBI mission requirements, the facility must meet the following requirements:

Offered space must be contiguous.

Offered space must be located on the second floor or higher.

Offered building must be capable of meeting Facility Security Level (FSL) 2 requirements, as determined by the Government in its sole discretion.

facilities with potential environmental threats (e.g. gas stations, chemical manufacturing facilities, and railroad lines transporting hazardous material) and bulk storage sites (e.g., hazardous materials storage sites, water purification centers, above ground fuel storage, and rail yards).

probation offices, the Internal Revenue Service (IRS), and jails.

the Tenant's National Security Threat List.

This requirement is for 5,979 ABOA/6,875 RSF of space for a 5-year term/2-year firm term to commence on 12/01/2025. The estimated cost of this lease is $ per rentable square feet per year for an annual cost of $ and a total contract value of $ . The delineated area is as follows:

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION.

41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.402. In accordance with GSAR 570.402, use of the sole source authority is appropriate where it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.

4.

NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.

It is in the best interest of the Government to remain at the current location. Award to other than the current Lessor would require relocation of the entire requirement and would cause FBI to incur move and replication costs that would not be recovered through competition. Relocation costs are estimated to be $ . Additionally, this allows the Government to make use of existing tenant improvements, security, furniture and equipment, avoiding replication costs of $ . A cost-benefit analysis was completed following the procedures set forth in GSAR 570.402-6. The cost of relocating FBI using the low cost quote exceeds the cost of remaining at 1 10th Street, August, GA. The total savings to the Government is $

5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS

MANY POTENTIAL SOURCES AS IS PRACTICABLE.

Per the requirements of GSAR 570.402, the GSA Lease Contracting Officer placed an advertisement on the Contracting Opportunities domain of SAM.gov on June 12, 2025 for 13 days. In addition, Public Properties, LLC, GSA broker contractor conducted market research using CoStar.

6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE

GOVERNMENT WILL BE FAIR AND REASONABLE.

Recent market surveys conducted by PBS in AUGUSTA, GA showed the rental rate within the delineated area ranges from $ -$ per RSF. (Source:CoSTAR)

Therefore, the proposed rental rates for this succeeding lease of $ /RSF, are within the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.

7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.

GSAR 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition.

On May 19, 2025, PBS conducted market research using CoStar and identified one (1) potentially acceptable location (zero (0) delineated area. In addition, PBS posted an advertisement conforming to GSAR 570.402-2 on the Contract Opportunities domain of SAM.gov website on June 12, 2025.

expression of interest indicated that the rate would be $ per RSF. Since there were no other interested parties that submitted an expressions of interest submitted, the available property in CoStar with the lowest listed rental rate per RSF was utilized as the lowest priced alternative in the Cost Benefit Analysis.

See Figure 1 below for the results of the market research and SAM.gov advertisement, including the incumbent.
