About this file
This document is a Memo to File explaining the lack of competition for a lease renewal under Project 0FL2303 in Jacksonville, FL. The lease for the Prudential Building, occupied by the U.S. Fish and Wildlife Service (FWS) and the Environmental Protection Agency (EPA), will expire on January 31, 2024. The government requires a 120-month lease renewal with an estimated net annual rent of $117,210.75, which is within the Simplified Lease Acquisition Threshold (SLAT).
The renewal is justified under 41 U.S.C. 3304(a)(1) as only a responsible source can satisfy the agency's requirements, and awarding to any other offeror would result in substantial duplication of costs that cannot be recovered through competition. The contract provides the right to renew the lease, and the rental rate is determined to be fair and reasonable based on current market information. The renewal is necessary to protect the government's occupancy rights and avoid the costs associated with a holdover tenancy.

Documentation to Explain the Absence of Competition – Lease Extension Within SLAT
Lease number LFL62486 occupied by FWS and EPA, located at the Prudential Building, 701 San Marco Blvd, Jacksonville, FL will expire on January 31, 2024. It has been determined that the government requires a renewal for 120 months as noted in the Acquisition Plan located in the lease file.
The estimated net annual rent of this action is $117,210.75, which is within the Simplified Lease Acquisition Threshold (SLAT).
41 U.S.C. 3304(a)(1): Only responsible source and no other supplies or services will satisfy agency requirements.
This statutory authority is implemented through GSAR 470.401. In accordance with GSAR 470.401, the contract provides the right to renew the lease and current market information confirms that the rental rate in the option is fair and reasonable. The decision to pursue a lease renewal below the Simplified Lease Acquisition Threshold is supported by GSAR 570.203. in which the contracting officer may solicit offers from only one source where it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.
This renewal for a lease below the simplified lease acquisition threshold is necessary as:
Cost based rationale
Lease renewals represent short-term contracting actions which are necessary to protect the occupancy rights of the government when the government cannot vacate the premises by the expiration of the existing contract term.
Renewals avoid the costs associated with holdover tenancies. Additionally, the government cannot reasonably expect to recover the costs associated with relocation of the tenant agency through full and open competition of a separate short-term lease to cover the term of this renewal.
